Dear Mr. Lindsay:
We have reviewed the application your company submitted for the referenced mine site. However, to date, this
office has not received all of the information requested in the letter dated July 20,2020. As required by 15A NCAC
513.0113, you are advised that you have 180 days, from the date of your receipt of that letter to submit all of the
requested information. The above referenced letter was signed for on July 24, 2020. Therefore,your deadline to
submit all of the requested information was December 20, 2020. The Department received your response
on December 29, 2020,but as of this date has determined that not all of the information requested has
been adequately received. The Department will provide 30 days to submit all of the requested
information. Therefore, your deadline to submit all of the requested information is March 5,2021.
In order for this office to complete its review of the referenced project in accordance with G.S. §74-50 and §74-51
of the Mining Act of 1971, please provide the additional or revised information in accordance with the following
comments:
1. Please show how runoff will be conveyed to all Basins,by detailing ditch,etc. on map.
a. Please show and label the vegetated berm which is directing the stormwater to Sediment Basin A
It. Please label the diversion for Basin B and Basin E
c. Please show and label the diversion for Basin F.
2. Please verify Unit Peak Discharge for Type II Rainfall. Peak discharges using the graphical peak method
appear higher than what was shown in ESC Calculations in the December 29, 2020 ADI response
Please note, this office may request additional information, not included in this letter, as the mining application
review progresses. Be advised that our review cannot be completed until all of the items listed above have been
fully addressed.

If you are unable to meet the March 5, 2021 deadline and wish to request additional time, you must submit
information, in writing, to the Director clearly indicating why the deadline cannot be met and request that an
extension of time be granted. If an extension of time is not granted or you do not respond to our request by
the March 5, 2021 deadline, a decision will be made to grant or deny the mining permit based upon the
information currently in the Department's files. Though the preceding statement cites the maximum time limit for
your response, we encourage you to provide the additional information requested by this letter as soon as
possible. Your prompt response will help us to complete processing your application sooner.

Dear Mr. Parr,
We have received your comments regarding the view of the mining plan and
related sedimentation and erosion control plan for the referenced site. At RWK,
P.A, it is our goal to complete this project while meeting the requirements
established by the North Carolina Department of Environmental Quality
(NCDEQ).
1. Please show how runoff will be conveyed to all basins, by detailing ditch,
etc, on map.
a. Please show and label the vegetated berm which is directing the
stormwater to Sediment Basin A.
b. Please label the diversion for Basin B and Basin E.
c. Please show and label the diversion for Basin F.
Response: The plans for the sand mine have been revised to show diversion
ditches and the berm at Sediment Basin A, and these have been
labeled. This was done after a telephone conversation with
Melissa Joyner. She discussed what she would be looking for on
the plans and how Sheet C1 should be revised. Diversions for
Basin B, E and F are shown and labeled. A note was also added
to indicated that any stormwater flow that is not conveyed by a
diversion swale or ditch is conveyed by sheet flow.

2. Please verify Unit Peak Discharge for Type II Rainfall. Peak discharges
using the graphical method appear higher than what was shown in ESC
Calculations in the December 29, 2020 AD] response.
Response: The calculations were revised using the graphical method. The
sedimentation and erosion control devices were also updated in
order to handle the stormwater flows determined from Unit Peak
Discharge for Type 11 Rainfall.
Please find enclosed two (2) sets of revised plans and calculations for the
referenced site. If you have any questions or need additional information, please
contact us.
