RE: A& H Mine - Mining Permit No.47-16

Dear Mr. Lindsay:
To date,this office has not received all of the information requested in the July 20, 2020 letter regarding
your application for the A&H Mine in Hoke County. As required by 15A NCAC 5B.0013, you were advised that
you have 180 days from the date of your receipt of that letter to submit all of the requested information. The
above referenced letter was signed for on July 24, 2020. Therefore,your deadline to submit all of the requested
information is January 20, 2021.
We have reviewed the modification request your company submitted for the referenced mine site. In order
for this office to complete its review of the referenced project in accordance with GS 74-50 and 51 of the Mining
Act of 1971, please provide the additional or revised information in accordance with the following comments:
1. Please provide post mining contours for the entire site, including mined areas. Post mining contours for
existing mining area are not shown.
2. Please show and label the associated erosion control measures (vegetated diversion berm and silt fence)
for the stream crossing.
3. Please show the locations of the baffles,dewatering devices, and outlets for all the Sediment Basins,
including the existing Sediment Basins in the existing permit area.
4. Please show how runoff will be conveyed to all Basins, by detailing ditch, etc. on map. Detail is missing
from existing basins.
5. Provide maintenance requirements for the visual barrier berm and for the temporary slope drain berms.
6. Please remove Weeping Love Grass from the permanent groundcover specifications, which appears on
sheet D2
7. Please provide an explanation as to how the new mining site will be accessed, as there are no roads
shown on the Mine Map leading to the new mining site. During a recent field inspection, it appeared
that there was an access road to the new mining site,which should be shown on the Mine Map.

Please be aware that items 2, 3, and 4 have been requested since the ADI letter dated June 19, 2019 and
have not been answered in full. Item 1 has been requested since the ADI letter dated September 16, 2019 and
has not been answered in full. Items 5, 6, and 7 have been requested since the ADI letter dated July 20, 2020
and has not been answered in full.
Please note,this office may request additional information, not included in this letter, as the mining
application review progresses. Be advised that our review cannot be completed until all of the items listed
above have been fully addressed.
In order to complete the processing of your application, please forward two (2) copies of the requested
information to my attention at the following address:

As required by 15A NCAC 56.0113, you are hereby advised that you have 180 days from the date of your
receipt of this letter to submit all of the requested information. If you are unable to meet this deadline and wish
to request additional time,you must submit information, in writing, to the Director clearly indicating why the
deadline cannot be met and request that an extension of time be granted. If an extension of time is not granted
or you do not respond to our request by the January 20, 2021 deadline, a decision will be made to grant or deny
the mining permit based upon the information currently in the Department's files at the end of the 180-day
period.
Though the preceding statement cites the maximum time limit for your response, we encourage you to
provide the additional information requested by this letter as soon as possible. Your prompt response will help
us to complete processing your application sooner.
