PO Box 122 Raeford, North Carolina 28376 RE: A& H Mine Mining Permit No.47-16 Hoke County Cape Fear River Basin Dear Mr. Lindsay: We have reviewed the application/modification request you/your company submitted for the referenced mine site. In order for this office to complete its review of the referenced project in accordance with GS 74-50 and 51 of the Mining Act of 1971, please provide the additional or revised information in accordance with the following comments: I. Please provide proof that our company has obtained any permits or provided any notifications to the Division of Waste Management for said landfilling activities. Please note that a separate Sediment and Erosion Plan approval and Industrial Stormwater Permit is required for the LCID since it is located in an already mined area. The area must be removed from the mining permit boundary. 2. Please provide post mining contours for the entire site, including mined areas. 3. Please modify the label "2 Acre LCID Landfill' to "Inactive 2 Acre LCID Landfill' 4. Please show and label all stream locations with the 75-foot undisturbed stream buffers that is located near Basins 1 and 3. This includes showing the existing stream crossing location and the associated erosion control measures (vegetated diversion berm and silt fence)which is located near Sediment Basin 1. Please address the location of Sediment Basin 1,which appears to be located in the wetland associated with the previously mentioned stream. 6. Please show the locations of the baffles,dewatering devices, and outlets for all the Sediment Basins, including the existing Sediment Basins. 7. Please show how runoff will be conveyed to the Basins, by detailing ditch, etc.on map 8. Include a construction drawing, specification,and maintenance requirements for the perimeter berm. Provide maintenance requirements for the surface dewatering device(skimmer). 9. Please remove Weeping Love Grass from the permanent groundcover specifications. 10. Please provide an explanation as to how the new mining site will be accessed, as there are no roads shown on the Mine Map leading to the new mining site. 11. A field inspection has revealed that the silt fence on Basin 1 has been undermined and sediment was observed on the downslope of the riprap apron. Please provide proof that your company has brought the measures into compliance. Please note,this office may request additional information, not included in this letter, as the mining application review progresses. Be advised that our review cannot be completed until all of the items listed above have been fully addressed. In order to complete the processing of your application, please forward two (2) copies of the requested information to my attention at the following address: Division of Energy, Mineral and Land Resources Department of Environmental Quality 1612 Mail Service Center Raleigh, NC 27699-1612 As required by 15A NCAC 5B.0113,you are hereby advised that you have 180 days from the date of your receipt of this letter to submit all of the requested information. If you are unable to meet this deadline and wish to request additional time,you must submit information, in writing, to the Director clearly indicating why the deadline cannot be met and request that an extension of time be granted. If an extension of time is not granted, a decision will be made to grant or deny the mining permit based upon the information currently in the Department's files at the end of the 180-day period.
