RECEIVED June 15, 2020 JUN 15 2020 Ms. Judy Wehner LAND QUALITY NCDEQ, Land Quality Section MINING PROGRAM 1612 Mail Service Center Raleigh, NC 27699 Subject: Modification Permit#47-16, A&H Mine, 401 Sand Company LLC Dear Ms. Wehner; On behalf of 401 Sand Company LLC I am responding to your letter of September 16, 2019, in which you requested additional information for your review of the above- referenced mining permit modification request. We appreciate the extension in time to respond as we discussed in our email request a few weeks ago. As we explained in our extension request, this plan was more complex than initially thought, and it was necessary to hire a Professional Engineer to properly design the sediment and erosion control plan, as well as address the LCID Landfill. Copies of Certified Mail Receipts for notifications of Nature Conversancy, Wayman Faircloth, and Cynthia McRae are attached. The Mine Plan has been completely redrawn, and the requested sediment and erosion control features and details have been added. Supporting calculations are included for all features. Topographic contours have been added based on current field data. The existing operating mine has been reevaluated to assure that the existing sediment and erosion control were constructed according to the approved design and that they are functioning as designed. All existing features are functioning as designed, and there are no current deficiencies in the site as previously approved and constructed. According to the most recent inspection reports, the existing basins were properly designed and functioning adequately. An older inspection report noted that Basin F needed routine maintenance by removing sediment. This basin has been cleaned out and is functioning properly and as designed. No basins at this operation have been noted to be deficient in design or function in any recent inspection report. 401 Sand has been in communication with NCDEQ Division of Waste Management, specifically Mr. Drew Hammonds and Mr. David Powell. The proper permits and notifications are currently being made to obtain the necessary permits and bring the site into compliance. As soon as the final plan for the LCID is approved, we will apply to have the area removed from the Mining Permit boundary, or incorporated as a Reclamation Plan, whichever is appropriate.
