I will respond to each item in your letter in the same order for clarity: 1. The pump will be located on the southern end of the pond, while the discharge will be located on the northern end, to maximize the settling effectiveness of the pond. This is indicated on the mine map. 2. The discharge structure has been revised to address the concerns expressed in your letter and our telephone conversations. The discharge will now pass through a doughnut-shaped rock-filter before entering a 15-inch corrugated plastic pipe. The pipe will pass through the perimeter berm, and will carry the discharge directly to the creek, where it will discharge into the stream. This will protect the area between the berm and the stream slope from erosion. A detail of the doughnut shaped rock filter is enclosed. 3. Contour data would not show well on the mine map. The area between the perimeter berm and the stream bank is essentially flat. The slope going into the stream is essentially vertical, dropping approximately 8 feet. Any contour representations on the map would consist of a single line overlying the stream bank line. 4. The NOI for the NPDES Permit is attached 5. The CCPCUA Permit was applied for and has already been approved, # CU3364 6. As described in item#2 above, the discharge water will be carried in a 15-inch corrugated plastic pipe from the perimeter berm down to the stream, thus preventing any erosion of the buffer and stream bank. The"settling pond" is a previously excavated portion of the mining area. It will be surrounded by a perimeter berm which will prevent water from flowing back into the excavation or discharging except at the discharge point. The perimeter berm detail is on the mine map. This pond remain separate from the rest of the mining area until mining is completed in the remaining mining area. At that point, the pump will be removed, and the discharge structure will be removed and sealed. There will be no discharge at that point. The area separating the pond from the remainder of the mining area will then be excavated under water, similar to the underwater mining now being done. Once this area is excavated,the mine will be reclaimed and released. Please let me know if you need any additional information. Sincerely, James C.
