Box 1114 North Wilkesboro, North Carolina 28659 RE: Supplemental Information for Application for a Mining Permit Bamboo Road Quarry Watauga County Dear Mr. Cecile: This office has completed its review of the supplemental information your attorney, Mr. Randal Marsh, submitted to this office on your behalf dated July 7 , 1993 , which was received by the Land Quality Section on July 13 , 1993. Although many of the issues raised by this office in its letter to you dated May 14, 1993 have now been addressed, there are several issues that still need clarification before this office `can continue its review of your application. These remaining items are as follows: ✓1 ) Although an overall mining permit boundary has been indicated on the mine maps , said boundary still does not clearly include all existing and proposed land disturbing activities. The permit boundary, as indicated on the ✓ revised mine map, runs down the centerline of the access roads around and above the quarry excavation. In addition, the highwall barriers have been indicated outside of the permit boundary. Please note that all aspects of the mining operation must be located inside the proposed permit boundary. The reason for this is to ensure that these areas, which will be used for the mining operation, are covered by the mining permit which will require proper installation, maintenance and reclamation of these areas under the Mining Act . Therefore, please adjust the mining permit boundary to ✓ encompass all access roads and highwall barriers to be utilized around the pit area. In addition, if this adjustment results in a significant change in the acreage to be permitted (currently proposed as 13 .96 acres) , a revised acreage ,Must be provided for the overall permit area. •'/'2) Please note that this office has not received the additional application processing fee of $750 .00 for the additional acreage that was added to the permit application. The required fee for a quarry with a permitted acreage of 10 but less than 25 acres is a total of $1,000.00. To date, this office has only received the initial check in the amount of $250.00. Please note that a decision on your mining permit application cannot be made until this remaining fee ($750.00) is paid. -/3) Although the sediment basin has been removed from its previous location on the map adjacent to the riverbank, perimeter dike symbols (indicated as "PD" and drawn by Municipal Engineering) are still indicated on the map to convey runoff to the basin's previous location. This is also true on the east side of SR 1514 in front of the scales and primary crusher. As these items are no longer applicable, please delete these symbols from the mine map. In addition, no reference has been made on the revised mine maps as to how and when the area between the permit ,/boundary and the riverbank will be permanently revegetated with native and wildlife species and remain undisturbed. Will it be revegetated in place or will the fill area be removed then the subsequent area revegetated? T-actl y� Mr, March at ntir .Tune 7; 1993 meeting in Raleigh, agreed to forward to this office copies of ✓supporting documentation and calculations compiled by the engineer who certified the flood elevations on the map. To date, this office has not received such documentation to verify these elevations. ,/4) As noted in my May 14, 1993 letter, a revised construction detail is needed for the perimeter dike proposed to divert_ all surface water runoff from the Processing' -Center to ' Sediment .-Basin- No: - I.. -- -The dike detail must clearly indicate that an excgvated channel will be installed at the inside toe of the dike to Mr. Cecile Page 3 sufficiently carry the runoff to the basin without breaching or overtopping the berm. Design calculations are also needed for the perimeter dike/channel system to support the size and proper stabilization of the channel. �/ 5) This office's review of the storage capacity of Sediment Basin No. 1 noted that the proposed dimensions must be increased or the basin, as proposed, must be cleaned out every six months and after every significant rainfall to prevent failure of the structure. In addition, the Silt Basin Schedule on the second sheet still indicates the elevations of the initial basin proposed adjacent to the riverbank. This schedule must be revised to clarify the frequency of cleanout and the correct elevations for the basin bottom, spillway and berm sections. ✓6) Although "landscaping" has been proposed in various areas at the Processing Center, information has not been provided as to the type and size of the plantings to be utilized. Will the "landscaping" be flowers, shrubs and/or trees? What types do you propose to plant and when? It appears that plantings for visual screening can be safely provided between SR 1514 and the road that runs parallel and directly in front of the shop. These plantings will be far enough back away from the road's connection with SR 1514 to allow proper visibility. In addition, as the Surplus Material Storage has been / relocated outside of the proposed visual screening, / plantings must be provided between it and SR 1514 to screen it from public view: As stated earlier, this revised screening should provide a direct visual screen for these aspects of the operation while providing a recessed screen that will not interfere with sight distance on SR 1514. Locations and details for this revised screening, or other similar alternative, must be provided on the mine maps. \/9) As noted earlier, all access roads to be utilized to access any stripping and mine areas on the east side of SR 1514 must be located within the mining permit boundary and must have properly designed and constructed erosion and sedimentation control measures to prevent offsite sedimentation. As you are aware, runoff down the access road located- at -the -northern end of the existing pit has caused failure and offsite sedimentation at the curve in the road. As a result, you had constructed a rock dam in the wash area to prevent further erosion and sedimentation problems. Please locate this rock dam, and Mr. Cecile Page 4 any other structures that exist or are needed to control runoff on these access roads , on the mine map. Locations , design calculations and construction details are needed for each structure to ensure that their proposed dimensions will be sufficient. At our meeting on June 7, 1993 , it was indicated that you would install a water bar across the access road that exits onto the east side of SR 1514 to slow runoff and ✓ prevent stone from the road from washing onto SR 1514 . However, this issue was not addressed on your revised mine map. Therefore, please provide a construction detail of the water bar and indicate its location on the mine map. ✓10) Although you have indicated the locations of the discharge pump and its corresponding pipe on the mine map, it appears that the pipe will end at the upstream end of the culvert. If so, please provide details of how the outlet point of the discharge pipe will be stabilized to prevent erosion and offsite sedimentation. A rip-rap lined sediment basin/pool may be necessary to prevent scour at the discharge point prior to the water entering the culvert under SR 1514. This issue must be clarified on the mine map. ✓11) Although a typical cross-section of the pit has been provided on the second sheet of the mine maps, several items have not been provided on the cross-section as previously requested. The cross-section must clearly indicate the permit boundary, buffer zone width, highwall barrier and corresponding safety ledge in addition to the 2 horizontal to 1 vertical or flatter overburden slope, the minimum 20 foot wide safety bench at the toe of said slope, and the quarry face that you provided. Again, please be sure to clearly label on the mine maps ✓ the width of the undisturbed buffer zone that will be maintained between the top of the mine excavation and the permit boundary on all sides of the site. ✓ 12) Clarification is still needed regarding notification of adjoining landowners as outlined in my letter to you dated April 29 , 1993 and May 14 , 1993 . This office still has not received copies of all return receipt cards for ----- all persons notified of this application. in addition, the Castiblancos and the AusEins have not been located on the adjoining landowners map. Which adjoining landowners on the map have now been replaced/conveyed their properties to the persons noted above? Mr. Cecile Page 5 ✓ 13 ) The size and boundaries of the Surplus Material Storage area containing all scrap metal , junk equipment and parts, and other refuse has not been clearly indicated on the mine maps. In addition, how will it be accessed now that it has been relocated behind the perimeter dike leading to the sediment basin? How and when will this material be removed from the site and properly disposed of offsite? Again, how do you propose to visually screen this area from SR 1514? Please clarify these issues. PLEASE BE ADVISED THAT THIS OFFICE CANNOT CONTINUE ITS REVIEW OF YOUR APPLICATION UNTIL ALL OF THE ABOVE ITEMS HAVE BEEN ADEQUATELY ADDRESSED. Although significant progress has been made in clarifying the issues raised in my previous letter, the remaining issues noted above must be addressed before a decision can be made on your application. It is strongly recommended by this office that you solicit assistance from an experienced surveyor or engineer regarding the technical issues addressed in this letter. In addition, this office has been advised that you have not, to date, received an air quality permit nor a water quality discharge permit for this site. Even if your application for a mining permit is approved, please be advised that no crushing or mine dewatering can be conducted at this site without first obtaining appropriate air quality and water quality permits for these activities, respectively. Lastly, if the Director determines that your mining permit applLcaLt01-1 Call bt aYpiV'vtd, tilt final ru-1-9 permit cannot be issued for this site until this office has received a reclamation bond in the name of "Radford Quarries of Boone, Inc. " in the amount of $12,500 .00, to cover 10 to 25 acres of affected area at the site. The Department's standard procedure is to, once the application is approved, forward a "draft" permit to the applicant along with various bond forms for securing the required bond. Once the required bond is received by this office, the final mining permit is then forwarded to the Director, Division of Land Resources, for his final consideration and decision. I am advising you of this matter now so that you may begin work on securing the required bond. GENERAL INSTRUCTIONS This section must be completed for facilities required to obtain a toxic air permit by EMC regulation 15A NCAC. 2H . 0610 and for facilities who emit one or more of the regulated air toxics listed in 15A NCAC 211 .0610(h) . Said boundary must be clearly labeled on the mine maps to include all existing and proposed land disturbing activities. All buffer zones , visual screening, highwall barriers, erosion and sedimentation control measures, processing and stockpile areas, primary crusher area, access roads leading to and around the pit area, and all stripping and mining areas must be located inside the proposed permit boundary. Once such line is delineated on the mine maps , all erosion and sedimentation control measures, stockpile areas and processing areas must be relocated outside the floodplain line. The revised mine maps must indicate the new locations of these items and indicate that any disturbed areas between the floodplain line and the top of the river bank will be permanently revegetated with native and wildlife species and -remain undisturbed. 1/4) A revised construction detail is needed for the perimeter dike proposed to divert all surface water runoff from the Processing Center to Sediment Basin No. 1 . The dike detail must clearly indicate that an excavated channel will be installed at the inside toe of the dike to sufficiently carry the runoff to the basin without breaching or overtopping the berm. Design calculations are also needed for the neri.meter dike/channel svctnm to support the size and proper stabilization of the channel . '/5) Design calculations and construction details are needed for Sediment Basin No. 1 to ensure -that it can handle a 25 year 24 hour storm event and maintain a settling efficiency of 70% for the 40 micron particle. In addition, if a riser basin is found to be more appropriate than the rip-rap filter basin presently nrnnncPrt - ctinnnrf i na r-al r-»l afi nnc fnr a 1 1 a-_nPrtc of t-ho principle and emergency spillway systems must be provided. Please note that the basin must be constructed in natural ground below any fill areas and cannot be located in the fill material itself. The emergency spillway must also be constructed in natural ground. ✓6) As required by the attached memorandum from the Department of Cultural Resources, Division of Archives and History, please forward a set of the mine maps directly to Ms. Renee Gledhill-Earley at the address indicated at the bottom of the memorandum. This office has maintained only one copy of the mine maps and does not have the facilities to generate a copy of the mine maps for Ms. Earley's use. Please provide this office verification that said maps have been forwarded to Ms. Earley as requested. Mr. Cecile May 14 , 1993 Page 3 1/7) Attached for your information and consideration is a copy of the May 6, 1993 memorandum sent to this office by the Wildlife Resources Commission regarding their revised comments on your application. The majority of their concerns and recommendations have been incorporated into the contents of this letter. ✓8) The visual screening proposed in the application form and indicated on the mine maps does not appear to be feasible or safe for vehicles entering or exiting both sides of SR 1514 at the proposed operation. It is recommended that this screening be eliminated from the maps and replaced by proposed screening, such as trees and shrubs, directly in front of the shop and processing plant on the west side of SR 1514 and in front of the primary crusher on the east side of SR 1514 . This revised screening will provide a direct visual screen for these aspects of the operation while providing a recessed screen that will not interfere with sight distance on SR 1514. Locations and details for this revised screening, or other similar alternative, must be provided on the mine maps . • ✓9) All access roads to be utilized to access any stripping and mine areas on the east side of SR 1514 must be located within the mining permit boundary and must have properly designed and constructed erosion and sedimentation control measures to prevent offsite sedimentation. Locations , design calculations and construction details for each structure must be provided. How will the access road be stabilized that exits onto the east side of SR 1514? A construction entrance detail , with corresponding stabilized side ditches, must be provided to prevent,tracking of sediment onto SR 1514 . ✓10) In the application form and on Sheet 2 of 4 of the mine maps, it was indicated that the mine excavation will be dewatered. However, the location of the discharge pump ' and corresponding pipe to the river has not been located on the mine maps. Please indicate the locations of these items as well as the location of the culvert under SR 1514 and the approximate discharge point in the river. It was also noted in -the application form that a closed system "recycling tank" will be utilized at the site. Please indicate its location on the mine maps and provide a schematic diagram of this system. Mr. Cecile May 14 , 1993 Page 4 ✓ 11 ) Is the bold line around the "Quarry Site" on Sheet 2 of 4 of the mine maps the proposed 10-year limit of the mine excavation? A typical cross-section of the pit must be provided to clearly indicate the permit boundary, buffer zone width, highwall barrier, safety ledge , the 2 horizontal to 1 vertical or flatter overburden slope, the minimum 10 foot wide safety bench at the toe of said slope, and subsequent benching of the quarry face. Please be sure to clearly label on the mine maps the width of the undisturbed buffer zone that will be maintained between the top of the mine excavation and the permit boundary on all sides 'of the site. Please note that the application form states that all overburden will be sloped to a 3 horizontal to 1 vertical . This angle does not appear to be practical in some areas if the bold line is the proposed limit of disturbed area. In addition, present , unconsolidated slopes on the south side of the pit area are steeper than a 2 horizontal to 1 vertical slope. As presently indicated on the maps, these slopes could not be• graded to a 2 horizontal to 1 vertical slope within the permit boundaries. Please be advised that this office will not allow any slopes steeper than a 2 horizontal to 1 vertical without a geotechnical report to indicate that a steeper slope will be stable. Therefore, you must clarify this issue. ✓12) If the areas encompassed by the bold lines are intended to be the Ai rhnA areas at the cite th; o nf'f; l.o measured these areas and arrived at the following approximate acreage: a) 2 . 82 acres for the Processing Center b) 8.52 acres for the Quarry Site Furthermore, additional areas that will be utilized by the operation that were not included within the bold lines are as follows: c) 0 .67 acres for the primary crusher along SR 1514 d) 0. 71 acres for access roads south of the Quarry Site shown on the map, used to access the stripping and mining areas Mr. Cecile May 14 , 1993 Page 5 As can be noted from the above information, the acreage to be disturbed that is outlined on pages 2 and 3 of the application will need to be revised. This information also supports the fact that greater than 9 . 75 acres will need to be permitted at this site to include these existing and proposed disturbed areas at the site. The mine maps will also need to be revised to clearly define the acreage and boundaries of all areas to be disturbed as part of the mining operation. In addition,_ the boundaries of all disturbed areas must be_properly marked at the site, once the mine maps -have been revised to include the above information, to facilitate this office's site evaluation of this application during the application review process. /13 ) Sheet 4 of 4 indicates that the disturbed area at the site is 58 acres. Is this supposed to be the acreage to be permitted? Does this include both sides of SR 1514? Please clarify this issue. ✓ 14) Will blasting at the site be designed and conducted by an experienced blasting company? How many times a week or month will shots be pulled at this site? Please be advised that if a permit is issued for this site, it will - rarmi ra that riata i 1 ari hl act rar nraQ ho mn i nta i narl nnr9 a seismograph be utilized for each blast conducted at the site. This is a standard operating condition for quarry operations across the state. i ✓15) Clarification is still needed regarding notification of adjoining landowners as outlined in my letter to you dated April 29, 1993 (copy attached) . In addition to the above, please be sure to provide this office verification that the landowners of the property upon which the site is located have been properly notified. This would appear to be Ms . Jenny Hollar on the east side of SR 1514 and Mr. Raymond Cecile on the west side of SR 1514 . ✓16) on page 2 of the application, items A.4 .a.and b. indicates that the mine depth will be 120 feet. Furthermore, on page 8 of the application, item 10.a. indicates that the depth to the groundwater table at the site is 40 feet. However, item 1o.b. indicates that the excavation will not extend below the groundwater table. In light of the above and the fact that the excavation will be dewatered, how can this be correct? This discrepancy must be addressed. Mr. Cecile May 14 , .1993 Page 6 ✓17) The location and acreage of all scrap metal , junk equipment and parts, and other refuse must be clearly indicated on the mine maps. How and when will this material be removed from the site and properly disposed of offsite? ✓18) The -Revegetation Plan must be revised to provide seeding mixtures, seeding rates and seeding dates for year-round seeding at the site ,/19) The attached Land Entry Agreement- must be completed by you as well as all owners of record of the land upon which the mine site is located ( i .e. , Ms. Jenny Hollar and Mr. Raymond Cecile) . Subsequent to this action, I conducted a site visit with Mr. Randy Marsh on May 6, 1993 . These comments are provided in accordance with certain provisions of the Mining Act of 1971 (as amended, 1982 ) G.S. 74-46 through 74-68 ; 15 NCAC 5) and the North Carolina General Statutes (G.S. 113-131 et seg. ) . During the site visit, I expressed concern to Mr. Marsh that recommendations outlined by the North Carolina Wildlife Resources Commission (NCWRC) in a previous memorandum dated June 4 , 1991 to Ms. Beth Studenberg of your office have never been implemented at the processing site. The applicant indicated willingness to do all work necessary to protect the aquatic resources of the South Fork New River from sedimentation. The applicant and I agreed that the following modifications are necessary to minimize sedimentation: 1) j The existing berm near- the, processing area should be , repaired and maintained starting near the road- and' continuing to the field. The berm should not sncroach upon established vegetation in the riparian zone. The berm may be constructed of rock or earth. If an earthen berm is constructed, it should be immediately seeded with a standard mixture or rescue and sericea lespedeza and covered with temporary ground cover until vegetation becomes established. 2) An undisturbed vegetated buffer zone of at least 50 feet wide should be preserved between the berm and the river. The buffer zone should be measured from the edge of ordinary high water to the edge of the berm. 3) The old sediment basin near the field should be brought up to -current standards and run-off from the processing area directed into this basin. Trapping efficiency should be based on surface area rather than volume. 4) The sediment basin should be dipped out when half full of deposited material so that a major rainfall will not cause the basin to overflow. In nearly two years since our last inspection, little or no effort seems to have been made on the part of the applicant to bring sedimentation controls up to current standards so that they are adequate to protect the river from sedimentation. The NCWRC will not object to the issuance of this mining permit, provided the recommendations outlined in our memorandum of June 4 , 1991 are implemented in a timely manner by the applicant. Stone is mined using shovel and truck in the quarry pit, The surrounding area consists of forested uplands. The pit is dewaiered by pumping storm and waste water into a sedimentation basin, from which it is pumped into a concrete culvert under Bamboo Road and into the South Fork New River. Stone Js conveyed under the road to the processing area, where it ' is washed using a recycling water system. .Stone and spoil are stockpiled nearby and are .separated from; the river in.,some .areas. by, a gravel and riprap berm. ,;The;.processing; site is ,partially situated in the , floodplain' of the .South Fork New River and encroaches upon the riparian, .zone. A�_field ,borders.,the processing site to the east. The NCWRC is concerned over the adverse impact mining operations are having on aquatic resources in the South Fork New River through- sedimentation. ., -,Sedimentation controls are presently inadequate to protect :the •.river; the. .river Memo Page 2 June 4 , 1991 contains a heavy load of silt in this area. Sedimentation and turbidity have the potential to reduce fish numbers through habitat destruction, reduced oxygen levels, lower levels of food and reduced reproduction. . The NCWRC will not object to the renewal of the permit, providing :the • following conditions ,ar,e� met by the applicant: 1) An earthen berm should be built near the processing area starting near the . road-and continuing to the field. We are aware that there have been problems with this operation, including flooding violations, sedimentation of the New River and stockpiling of junk. We are also aware that these and other problems have resulted in litigation involving the quarry, the Town of Boone and the State of North Carolina.
