The cover letter to the draft permit references the inclusion of a bond form,assignment of savings
account form and irrevocable standby letter of credit form reference that were not included in the
attachment. In an attempt to secure something today,can you please send these as soon as possible so I
can forward on?
Also,moving forward,can the related approval documents be addressed to Justin M. Old,Registered
Agent for APVA,LLC instead of Clay Cartwright for Allied Properties,LLC?Mr. Cartwright will be
the operator,however,the property owner and permit holder will be in the name of APVA,LLC. I'm
trying to avoid confusion at the county review level.

I am following up to see if you can please provide an update on this permit review.The County has a
deadline on May 27th that will allow this project to be reviewed at the next Commissioner's meeting.
The mine permit is the only outstanding item needed and if its not provided by the 27th it can't be
submitted until the end of June for the August meeting.Anything you can do to try to have the mine
permit issued before the 27th of this month would be very much appreciated.

It has been a few months and I hope all is still well.We have finally secured the following approvals for
the Ballance Tract Mine and they are attached for your records.
• Railroad Crossing Agreement- CARR210112469
• NCDEQ Dewatering Discharge COC-NCG020972
• NCDOT Driveway Permit—D011-027-21-00008
• NCDEQ Stormwater Permit—SW7210207
• USACOE Nationwide Permit 3 - Action ID 2020-01827
• Dominion Power Encroachment Agreement—TE020071006
I believe this provides the remaining items needed to issue the Mine Permit for this project.We are up
against a hard deadline with the local municipality where if we do not provide the approvals (including
the mine permit) in the next several days,review of the project will be delayed another month. If it is at
all possible for you to get the mine permit issued within the next 2 days,it would be very much
appreciated.At this point all we need is an electronic copy so you can email me a copy to expedite
