Balance Tract Mine
Currituck County
Please find attached for your review a copy of the mining permit application request for the above
referenced project.
Please review this information and advise as to the probability of this operation having unduly adverse
effect on wildlife and freshwater fisheries (G.S. 74-51 (2)). Please respond by January 18, 2021 so that we may
complete our review of this request within our statutory time limits.
As is the case in our review of all mining permit applications, renewals and modifications,this office will
carefully review all proposed erosion and sediment control measures to ensure that they are sufficient to restrain
erosion and off-site sedimentation. However, any comments your agency can provide regarding effects on wildlife
and freshwater fisheries would be greatly appreciated. If your staff wishes to perform a site inspection, it is
recommended that they contact the person submitting this request to set up a convenient date and time. Also,
please send a copy of your comments to the person noted in the application.

SUBJECT: Mining Permit Modification for Allied Properties,LLC,Balance Tract Mine,
Currituck County,North Carolina.
Biologists with the North Carolina Wildlife Resources Commission (NCWRC)reviewed this permit
application with regard to impacts of the mine on fish and wildlife resources. Our comments are provided
in accordance with provisions of the Fish and Wildlife Coordination Act(48 Stat.401,as amended, 16
U.S.0 661-667d), Section 401(b) of the Clean Water Act of 1977 (as amended),and the North Carolina
Mining Act of 1971 (as amended, 1982;G.S. 74-76 et. sec(., 15 NCAC 5).
The applicant is applying for a 99.87 acres sand mine to excavate a 57.36 acre mine area. The average
depth would be-25'.A NPDES Stormwater General Permit is currently being reviewed.The majority of
the setting is in an open,agricultural setting.
The NCWRC has reviewed the application and has minimal concern with the mine's direct impacts to
wildlife resources.However,we request changes be made to the reclamation area to include a different
seeding mix.NCWRC staff have discussed appropriate seeding mixtures with NCDEMLR staff and
request the following be considered:

Soil Amendments
Lime- 2000 lbs/acre or follow recommendations from a soil test.
Fertilizer- Sulmmer- 1000 lbs/acre 8-8-8 or 10-10-10,or follow recommendations from soil
test.
Fall,Winter and Spring 400 lbs/acre 8-8-8 or 10-10-10 or follow recommendations
from a soil test.
Mulch- All seeded areas shall be mulched using small grain straw at a rate of
2000 lbs/acre and anchored appropriately.
Whenever possible, disturbed areas should be vegetated with native warm season grasses such as switch
grass,Indian grass, bluestem and gamma grass.
In addition,the permittee may consult with a professional wildlife biologist with the NCWRC to enhance
post-project wildlife habitat at the site.
