Describe in detail the sequence of events for the development and operation of the mine and reference the sequence to the mine map(s).Attach additional sheets as needed. The proposed operation will involve the removal of sand and gravel by excavator or long reach excavator with zoned dewatering the mine excavation. Mining will begin at the southern end of the site in Pit#land progress north towards View Nicholson Road. Mined material will be placed into trucks and hauled off site. Material will be sized in each pit as needed. No Mining activities will commence until all erosion and sedimentation control measures have been installed and maintained. In addition to the erosion and sedimentation control measures,the mine excavation, plant and stockpile area, and visual screening berms will be located as shown on the attached mining plan set. 2. Describe specific erosion control measures to be installed prior to land disturbing activities and during mining to prevent offsite sedimentation(include specific plans for sediment and erosion control for mine excavation(s),waste piles,access/mine roads,and process areas),and give a detailed sequence of installation and schedule for maintenance of the measures.Locate and label all sediment and erosion control measures on the mine map(s)and provide typical cross-sections/construction details of each measure.Engineering designs and calculations are required to justify the adequacy of any proposed measures. Erosion and sedimentation control measures have been proposed throughout the project area to protect surrounding properties.These include a construction entrance,buffer zones,perimeter silt fence with silt fence outlets,temporary diversions,earthen berms for screening as well as sediment containment,and temporary sediment basins throughout the site that will be maintained until it has been removed by mining and all runoff directed into the mine excavation.All erosion and sedimentation control are shown on Sheets C3-5.The installation and removal of all erosion and sedimentation control measures are specified within the construction sequence also provided on Sheet C3-5.The sediment basins and all diversions have been designed using a 25-year design storm event,the design calculations along with the construction and maintenance details of which are provided on Sheet C14-C20. 3. A)Will the operation involve washing the material mined,recycling process water,or other wastewater handling? 1X-1YES F ]NO If yes,briefly describe all such processes including any chemicals to be used. By nature of the removal of sand and gravel from below the water table within the mine excavation,the material will be wet with some drainage occurring back into the mine excavation when the material is placed on the ground prior to being loaded into a haul truck.A mobile screen will be used to screen the material into different product sizes,and to remove any organics that may exist.Some water from the mine excavation will be added during this process to reduce the potential for dust.The minor amount of water used to reduce dust potential in the plant area will be contained within the pit inside of the perimeter berm system and allowed to naturally infiltrate into the ground. B)Will the operation involve discharging fresh or wastewater from the mine or plant as a point discharge to the waters of the State? FX]YES FINO If yes,briefly describe the nature of the discharge and locate all proposed discharge points(along with their method of stabilization)on the mine map(s). During the initial clearing of the project area,sediment basins with temporary diversions will be used to capture stormwater runoff along with perimeter silt fence that has silt fence outlets located in low points in existing topo.Any dewatering during the initial excavation that may be required to create the initial pit area shall be discharged through silt bags. The site will be excavated by dewatering the active excavation area into the previously excavated area/no outlet sediment basins proposed in the phase areas.The active excavation areas and previously excavated areas will be separated by temporary berms/dams between the wet and dry areas.Once these areas are complete the temporary berms/dams are to be dug out to connect the pit areas. ZYES ] NO If yes,do you intend to dewater the excavation(s)? aYES a No 3 800 000.00 Estimated withdrawal rate in gallons per day. If yes,what impact,if any,will mine dewatering have on neighboring wells?Locate all existing wells on the mine map(s)that lie within 500 feet of the proposed excavation area.Provide data to support any conclusions or statement made,including any monitoring well data,well construction data,and current water withdrawal rates.Indicate whether the proposed mine locale is served by a public water system or private wells. The estimated depth of the mine will be 40 feet+/-with the water table depth to be estimated at 5-6 feet below the natural ground surface. The mining process of pumping the active excavation area to previously excavated areas with the separation of temporary berms/dams will result in no dewatering of the mine. There are no wells within 500 ft of the pits. This project has been registered in the Dewatering Program through the Department of Water Resources. D)If you answered yes to any of the above questions,provide evidence that you have applied for or obtained the appropriate water quality permit(s)(i.e.,non-discharge,NPDES,Stormwater,etc.)from the Stormwater Program.In addition,the applicant is required to register water use with the Division of Water Resources,Ground Water Management Branch,if the operation withdraws more than 10,000 gallons per day and needs a capacity use permit from the Division of Water Resources,Ground Water Management Branch,if the operation lies in a capacity use area and withdraws more than 100,000 gallons per day. A discharge permit has been applied for and the documents have been provided as an attachment to this application. The temporary dewatering of the pit areas will be discharged into previously mined areas. Each previously mined pit will serve as water storage area to which the currently mined pit will be dewatered This project has been registered in the dewatering program through DWR to track water use for the project. 4. A)Will the operation involve crushing or any other air contaminant emissions? RYES ]NO If yes,indicate evidence that you have applied for or obtained an air quality permit issued by the Division of Air Quality or local governing body. A mobile sand screen will be used to screen the material into different product sizes,and to remove any organics that may exist.Water from the mine excavation will be added during this process to reduce the potential for dust.A letter and an accompanying projected emissions spreadsheet have been submitted to DAQ Wilmington Regional Office for review.We are requesting a permit determination by DAQ to confirm that a DAQ permit is not required for the use of the specified mobile sand screen given that the project level of emissions to DAQ is below the threshold where a permit is required.An attachment of the DAQ submittal documents is attached to this application. B)How will dust from stockpiles,haul roads,etc.,be controlled? The access road, stockpiles, mobile sand screen, and internal haul roads will be sprayed with water from the mine excavation several times a day, as needed, to control fugitive dust. A)A buffer will be required between any mining activity and any mining permit boundary or right-of-way.It may be an unexcavated buffer(no excavation,but roadways,berms,and erosion&sedimentation control measures may be installed within it),an undisturbed buffer(no disturbance within the buffer whatsoever),or a combination of the two, depending upon the site conditions.Note that all buffers must be located within the mining permit boundaries. How wide a buffer will be maintained between any mining activity and any mining permit boundary or right-of-way at this site?A minimum buffer of 25 feet is recommended,although a wider buffer may be needed depending on site conditions.Show all buffer locations and widths on the mine map(s). A proposed 50-foot minimum undisturbed buffer with an additional 50 foot wide by 6-foot-high vegetated earthen berm will provide an overall vegetated buffer of 100 feet between mining related activities and any mining permit boundary. B)A minimum 50 foot wide undisturbed buffer will be required between any land disturbing activities within the mining permit boundaries and any natural watercourses and wetlands unless smaller undisturbed buffers can be justified. Depending on site conditions,a buffer wider than 50 feet may be needed. How wide an undisturbed buffer will be maintained between any land disturbing activities within the mining permit boundaries and any natural watercourses and wetlands at this site?Show all buffer locations and widths on the mine map(s). A 30-foot minimum undisturbed buffer with a 20-foot by 2.5-foot-high vegetative earthen berm will be maintained between any mining related activities and any streams or wetlands within the mine permit boundary as shown on various sheets in the mine plan set. 6. A)Describe methods to prevent landslide or slope instability adjacent to adjoining permit boundaries during mining. Minimum 2 horizontal to 1 vertical slopes or flatter for clayey material and minimum 3 horizontal to 1 vertical slopes or flatter for sandy material are generally required unless technical justification can be provided to allow steeper slopes. Removal of sand from below the water table within the active mine excavation will result in the side slopes reaching their natural angle of repose. At reclamation a 3:1 shall be maintain for the first 10 ft of depth under water level. However, any excavation that occurs above the water table will be conducted at a 3 horizontal to 1 vertical or flatter slope. B)Provide a cross-section on the mine map(s)for all fill slopes(berms,waste piles,overburden disposal areas,etc.), clearly indicating the intended side slope gradient,installation of any benches and/or slope drains(with supporting design information)if needed,and the method of final stabilization. Cross-sections and labels defining a minimum slope of 3 horizontal to 1 vertical or flatter for all fill slopes have been provided in the mining plan set.The method of final stabilization for all fill slopes and other areas affected by the mining operation are provided in Sheets C8 and C10 to protect their integrity and promote slope stability. The cut slopes of all excavated diversion ditches and walls of the sediment basin will be maintained at a minimum of 2 horizontal to 1 vertical or flatter.The cut slopes around the perimeter of the mine excavation will be maintained at a minimum of 2 horizontal to 1 vertical or flatter.All cut slopes and other areas affected by the mining operation will be stabilized with vegetation as indicated on Sheet C6-8 to protect their integrity and promote slope stability. D)In hardrock excavations,specify proposed bench widths and heights in feet.Provide cross-sections of the mine excavation clearly noting the angles of the cut slopes,widths of all safety benches and mine benches,and the expected maximum depth of the excavation. There are no hard-rock excavations planned for this mining operations. 7. Describe other methods to be taken during mining to prevent physical hazard to any neighboring dwelling,house, public road,or public,commercial or industrial building from any mine excavation.Locate all such structures on the mine map if they are within 300 feet of any proposed excavation. A lockable gate will be maintained at the site's entrance to prevent access by others outside of normal business hours. Vegetated earthen berms are also provided around the entire perimeter of the mining operation to prevent inadvertent entry. 8. Describe what kind of barricade will be used to prevent inadvertent public access along any high wall area and when it will be implemented.Vegetated earthen berms,appropriate fencing and adequate boulder barriers may be acceptable high wall barricades.A construction detaiUcross-section and location of each type of barricade to be used must be indicated on the mine map(s). A lockable gate will be maintained at the site's entrance to prevent access by others outside of normal business hours. Vegetated earthen berms are also provided around the entire perimeter of the mining operation to prevent inadvertent entry. 9. Are acid roducing minerals or soils present? YES FXINO If yes,how will acid water pollution from the excavation,stockpiles,and waste areas be controlled? A)Describe specific plans(including a schedule of implementation)for screening the operation from public view such as maintaining or planting trees,bushes or other vegetation,building berms or other measures.Show the location of all visual screening on the mine map(s)and provide cross-sections through all proposed berms or proposed spacing, sizes and species for tree plantings. Vegetated earthen berms will be constructed and stabilized with vegetation around the entire perimeter of the mining operation to screen the operation from 6)Could the operation have a significantly adverse effect on the purposes of a publicly owned park,forest,or recreation area?If so,how will such effects(i.e.,noise,visibility,etc.)be mitigated? There is a State of North Carolina owned game land forest on the north side of View Nicholson Road at 2875 View Nicholson Road. The proposed mine will help with ground water transfer on the game land property preventing negative impacts to the existing hardwood tree stand. The site has been designed with a 50 ft undisturbed buffer to along View Nicholson Road and a 50 ft X 6.5 ft tall earthen berm to mitigate noise and visibility. 11. Will ex I sives be used? YES �NO If yes,specify the types of explosive(s)and describe what precaution(s)will be used to prevent physical hazard to persons or neighboring property from flying rocks or excessive air blasts or ground vibrations.Depending on the mine's location to nearby structures,more detailed technical information may be required on the blasting program(such as a third-party blasting study).Locate the nearest offsite occupied structure(s)to the proposed excavation(s)on the mine map and indicate its approximate distance to the proposed excavation. 12. Will fuel tanks,solvents,or other chemical reagents be stored on-site? Describe your intended plan for the final reclamation and subsequent use of all affected lands and indicate the sequence and general methods to be used in reclaiming this land.This must include the method of reclamation of settling ponds and/or sediment control basins and the method of restoration or establishment of any permanent drainage channels to a condition minimizing erosion,siltation and other pollution. Our intent is to utilize a Terex M2100 three track mounted mobile sand wash plant with a four-cylinder CAT diesel engine(131 HP @ 2200 PRM)to produce up to 200,000 tons of wet sand product per year. The mobile screening operation will be removed from the site no later than 12 months from its placement. We have completed the DAQ emissions calculation spreadsheet based upon the annual 200,000 ton anticipated sand production and have attached the completed spreadsheet for your consideration. Based upon this analysis,our estimated actual emissions of total particulate matter< 10 microns(PM10)for this mobile sand screening operation will be approximately 0.24 tons per year with estimated potential emissions of 2.11 per year. As these values are less than 10 tons per year,it appears that our mobile sand screening operation meets the exemption from obtaining a DAQ permit under 15A NCAC 02Q.0102(d). We have also attached manufacturer information on the Terex M2100 mobile screening system for your information. Havelock Drugstore, LLC. respectfully requests that DAQ review this information and respond in writing confirming that neither a DAQ permit nor registration is required at this time. RESERVATION OF TIMBER, TREES AND PULPWOOD. The party of the first part excepts from its conveyance of the Property and reserves and retains all timber, trees and pulpwood located upon Blocks A, B, C and D of the Property as shown and delineated on Exhibit B attached hereto and incorporated herein by reference (hereinafter collectively called "Timber") and the right to manage, harvest and remove same from the Property and the right of access over the Blocks and the remaining Property and the access roads appurtenant to the Property to pass and repass with people, and machinery as determined by the party of the first part in its sole discretion, to perform harvesting operations of the Timber. The period of the reservation is ten (10) years from the date this Deed for the Property from the party of the first party to the party of the second part which includes the Timber reservation is recorded. In the event the party of the first part has made a good faith effort to harvest the Timber during the ten (10) year period, but weather and river levels have prevented the party of the 2 00-28 0768 first part from completing the harvest, the party of the first part shall have the option, to be exercised prior to the expiration of the original ten (10) year period, to extend the Timber harvesting period for an additional two (2) year term upon the payment by the party of the first part to the party of the second part of the sum of Ten Thousand and No/100 Dollars ($10,000.00) for such extension. The party of the second part agrees to execute an extension agreement for such extended term promptly upon demand by the party of the first part. The benefit of this Timber reservation shall run to the party of the first part and its successors and assigns. Cr ar% 9 00-28 0775 Exhibit C Timber Reservation Additional terms and conditions of the reservation of the Timber on Blocks A, B, C and D of the Property as shown on Exhibit B. The party of the first part is hereinafter called "Coastal" in this Exhibit and the party of the second part is hereinafter called "Havelock" in this Exhibit. a. No laps, tops or other debris is to be left by Coastal on access paths, or across property lines. No non-vegetative logging debris is to be left outside the harvesting areas, and no skidding/decking is allowed outside the harvesting areas without written approval from Havelock. No fuel, trash, oil, cans, garbage, or other human refuse, including harvesting equipment, shall remain on the Property after harvesting operations are complete. b. All harvesting activities shall be performed in accordance with Best Management Practices for the region in which the Property is located as outlined in the most recent edition of the BMP manual published by the North Carolina Forest Service. Coastal also agrees to abide by all N.C. Water Quality laws, which include Stream Obstruction Statutes, the Forest Practices Guidelines, and any applicable Riparian Buffer Protection Rules. All other applicable local, state and federal ordinances, statutes, and laws must also be adhered to and followed by Coastal. c. Coastal agrees to notify Havelock a minimum of twenty-four (24) hours prior to beginning harvesting operations on the Property and also twenty- four (24) hours before moving off the site. Written notification is required each time the harvesting operation is recommenced on the Property of Havelock after having ceased on the Property. Notices provided for in this Paragraph (d) shall be sent by text, email, or phone message. d. Coastal shall defend, indemnify and hold harmless Havelock from any and all liability and all loss arising from the operation, activities, omissions, and commissions of Coastal (including, but not limited to, its agents, contractors, subcontractors, employees and assigns) incidental or related to the Timber harvesting and hauling operations or Coastal's harvesting activities upon the Property. Coastal further agrees to maintain Worker's Compensation Insurance and Public Liability insurance coverage thereof for itself, its agents, contractors, subcontractors, assigns, and employees, and to provide proof thereof to Havelock upon request of Havelock. Both parties agree and understand that Coastal, the logger, and any and all employees, contractors, subcontractors, assigns, etc. of Coastal's harvesting contractor are independent contractors and are not employees 10 00-28 0776 of Coastal or Havelock. The public liability insurance policy shall be a commercial general liability policy with combined single limit coverage of at least One Million and No/100 Dollars ($1,000,000.00) showing Havelock as an additional insured. Such policy shall insure against all liability arising by reason of the injury or death of a person or persons and for damage or destruction of property arising as a result of the Timber harvesting and hauling operations, Coastal agrees to defend, indemnify and hold harmless Havelock against all loss, cost, liability, claim, suit, damage, fine or expense, including reasonable attorneys' fees, incurred as a result of physical injury to persons or property damage which result from the Timber harvesting and hauling operations of Coastal. e. Coastal agrees to furnish Havelock with a written, recordable release of Coastal's Timber rights on a particular Block at such time as Timber harvesting operations on that Block are completed. f. Coastal shall select the time and exact location on a Block as to the Timber harvesting operation on that Block. g. Coastal, in its sole discretion, will be responsible for the roads within the Blocks and the roads leading to the Property and the Blocks during such period of time as Coastal is actively engaged in using the road in question for its ongoing Timber harvesting operations. Havelock shall make no changes in the road layouts or construct improvements (including pavement or construction) on the road without Coastal's written consent, such consent not to be unreasonably withheld, delayed or conditioned. Coastal shall not be responsible for repairing the road beyond the condition of the road existing at the date the Deed is executed or beyond that which historically has been applicable for logging access roads. If Havelock engages in road improvements beyond what is customary and historically applicable for logging roads, Havelock shall do so at its sole cost and expense and shall be liable for all damages to such improvements caused by Coastal's Timber harvesting operations. h. Until the timber harvesting operation is complete, Coastal will continue to trap beavers on the Property as part of its Timber management activity on the reserved Blocks. To that end, Coastal and its agents will be free to move across the entire Property (even portions on which the Timber is not reserved and on portions which have been released from the Timber reservation) to maintain control of beaver populations, including the breaking of dams and lowering of waters. However, Coastal will not be obligated by the provisions of this Paragraph for the management or trapping of beavers on areas which Coastal deems are not influencing Coastal's Timber management on the Blocks on which the Timber is reserved. 11 00-28 0777 i. After the expiration of the period of removal, including the expiration of the option period set forth above, all rights of Coastal hereunder shall terminate, cease and have no further force or effect and all Timber remaining upon the Property shall be the property of Havelock and Coastal shall have no further interest in such Timber. 12 00-28 0778 Exhibit D Exceptions The Property is conveyed subject to the following: 1. Easements for public utilities visible or of record, if any. 2. Ad valorem taxes and special assessments not yet due and payable which shall be prorated between the parties on a calendar year basis to the date of closing. It is provided, however, that the party of the second part shall be responsible for, and shall assume all deferred taxes encumbering the Property. 3. Zoning ordinances. 4. Restrictions of record. 5. Any matters which a current survey and inspection of the Property would show. 6. The reservation of timber, trees and pulpwood and access to same reserved by the party of the first part in Exhibit C attached hereto and incorporated herein by reference. 7.
