In order for this office to complete its review of the referenced project in accordance with N.C.G.S. §74-50 and §74-51 of the Mining Act of 1971, please provide the additional or revised information in accordance with the following comments: 1. Please clearly identify the existing and proposed mine permit boundary. 2. Please clarify and provide proof that permits for watershed and flood zone development permits from Yancey County cover the entire proposed mine permit boundary. 3. Streams, buffers, permit boundaries and contours are not easily distinguishable. Please provide a color map similar to the last permitted map received February 1, 2021 or consider changing line weights or symbology to make the map more legible. 4. Please refer to Section D of the mine permit application and provide a reclamation map that clearly illustrates the reclamation plan for the entire site. The map should clearly illustrate the post mining use of the entire site. It should also include all italicized items listed in the application. 5. Please provide a reclamation map showing post mining contours and cross sections. 6. Please provide a map showing the proposed state of the site once the riparian buffers have been repaired. 7. Please clearly label and indicate on the mine map the lay down yard identified in question D.6 of the mine permit application. Please clarify the screening activity on site. The narrative in the cover letter states that there will be wet screening, however the response in C.3 of the application states that there is no washing. 9. Please clarify how mining is occurring below the water table without dewatering. 10. Please clearly identify and label on the mine map all structures on the mine map that are 300 ft from the permitted and proposed excavation. 11. Please provide proof, such as copy of the signed return receipts from certified mail, that Doris Darlene Hollfield has been properly notified. Your response to C.3.b states that there will be no discharge of water from the permitted area. Please clarify where the wash water from the wet screen is going to be discharged. Please clarify where the proposed sediment basin is discharged. Please note, this office may request additional information, not included in this letter, as the mining application review progresses. Be advised that our review cannot be completed until all of the items listed above have been fully addressed. If you are unable to meet this deadline and wish to request additional time, you must submit information, in writing, to the Director clearly indicating why the deadline cannot be met and request that an extension of time be granted. If an extension of time is not granted, a decision will be made to grant or deny the mining permit based upon the information currently in the Department's files at the end of the 180-day period. Though the preceding statement cites the maximum time limit for your response, we encourage you to provide the additional information requested by this letter as soon as possible.
