In order for this office to complete its review of the referenced project in accordance with N.C.G.S. §74-50 and §74-51 of the Mining Act of 1971, please provide the additional or revised information in accordance with the following comments: Please clarify what activities will occur in the 25' unexcavated buffer. The affected area table indicates that the 2.08 acres of buffer are not included in the affected area. Please clarify if the 25' permitter buffer is unexcavated or undisturbed. 2. The mine map has a label for permit boundary/limits of disturbance 10.83 acres. The affected area table only accounts for 9.20 acres. Please provide an explanation for the discrepancy in the affected area in the table and the disturbed area in the label. 3. Please clearly indicate and label on the reclamation mine map the location of cross section C-C 4. Please clarify how the site will be filled in for reclamation. Please provide information on types of material to be brought on site, timing of reclamation, as well as process of filling and compaction, etc. Please clearly indicate and label on the mine map the structures 300' from the excavation that are located east of SR 1408 (Harris Road). 6. Please clarify your response to C.3.B in the mine permit application where you state that there will be no discharge to waters of the state. The skimmer basin shown on sheet C 101 has an outfall to an existing roadside ditch. Please provide proof that an NOI has been submitted to the Stormwater Program for a NPDES Stormwater permit or provide an explanation as to why a stormwater permit is not necessary. Please note, this office may request additional information, not included in this letter, as the mining application review progresses. Be advised that our review cannot be completed until all of the items listed above have been fully addressed. If you are unable to meet this deadline and wish to request additional time, you must submit information, in writing, to the Director clearly indicating why the deadline cannot be met and request that an extension of time be granted. If an extension of time is not granted, a decision will be made to grant or deny the mining permit based upon the information currently in the Department's files at the end of the 180-day period. Though the preceding statement cites the maximum time limit for your response, we encourage you to provide the additional information requested by this letter as soon as possible.
