Box 1728 Kings Mountain, North Carolina 28086 RE: Oglebay Norton Specialty Minerals , Hawks Mine Mining Permit No. 23-03 Cleveland County Broad River Basin Dear Mr. Chapman: i Thank you for your letter dated July 25, 2001 regarding the recent blasting test conducted at the above referenced mining facility. As we discussed on the telephone, Oglebay Norton (ON) has approval from the Department to conduct test blasting at its mine site, provided that specific conditions in its mining permit are followed. On July 23, 2001, ON conducted such a blasting test. Attached are copies of all of the documents provided by ON and as required by Mining Permit No. 23-03. 1 have analyzed these records and the results of my investigation are also attached. It has been concluded that ON has complied with its mining permit conditions and has conducted its blasting test well below the levels that would result in blasting damage to nearby structures. Hawks Mine Cleveland County - Permit No. 23-10 for the operation of a Mica Mine which shall provide that the usefulness, productivity and scenic values of all lands and waters affected by this mining operation will receive the greatest practical degree of protection and restoration. MINING PERMIT EXPIRATION DATE: May 1 , 2001 Page 2 of 8 In accordance with the application for this mining permit, which is hereby approved by the Department of Environment, Health and Natural Resources , hereinafter referred to as the Department, and in conformity with the approved Reclamation Plan attached to and incorporated as part of this permit, provisions must be made for the protection of the surrounding environment and for reclamation of the land and water affected by the permitted mining operation. This permit is expressly conditioned upon compliance with all the requirements of the approved Reclamation Plan. However, completed performance of the approved Reclamation Plan is a separable obligation, secured by the bond or other security on file with the Department, and may survive .the expiration, revocation or suspension of this permit. This permit is not transferable by the permittee with the following exception: If another operator succeeds to the interest of the permittee in the permitted mining operation, by virtue of a sale, lease, assignment or otherwise, the Department may release the permittee from the duties imposed upon him by the conditions of his permit and by the Mining Act with reference to the permitted operation, and transfer the permit to the successor operator, provided that both operators have complied with the requirements of the Mining Act and that the successor operator agrees to assume the duties of the permittee with reference to reclamation of the affected land and posts a suitable bond or other security. In the event that the Department determines that the permittee 'or permittee's successor is not complying with the Reclamation Plan or other terms and conditions of this permit, or is failing to achieve the purposes and requirements of the Mining Act, the Department may give the operator written notice of its intent to modify, revoke or suspend the permit, or its intent to modify the Reclamation Plan as incorporated in the permit. The operator shall have right to a - riearirig at a designated timewarid"place on any proposed modification, revocation or suspension by the 'Department. Alternatively and in addition to the above, the Department may institute other enforcement procedures authorized by law. Definitions Wherever used or referred to in this permit, unless the context clearly indicates otherwise, terms shall have the same meaning as supplied by the Mining Act, N.C.G.S. 74-49 . Modifications October 28_, 1994 : This permit has been transferred in its entirety from KMG Minerals, Inc. to Franklin Industries, Inc. March 29 , 1996 : This permit has been modified to include and allow mining on 18 . 13 acres as indicated on the mine map dated February 1996 . i Page 3 of 8 Expiration Date This permit shall be effective from the date of its issuance until May 1 , 2001 . Conditions This permit shall be subject to the provisions of the Mining Act, N.C.G.S. 74-46 , et. seq. , and to the following conditions and limitations: OPERATING CONDITIONS: 1 . A. Any wastewater processing or mine dewatering shall be in accordance with the permitting requirements and rules promulgated by the N.C. Environmental Management Commission. B. Any stormwater runoff from the affected areas at the site shall be in accordance with any applicable permit requirements and regulations promulgated by the Environmental Protection Agency and enforced by the N.C. Environmental Management Commission. It shall be the permittee's responsibility to contact the Water Quality Section, Division of Environmental Management, to secure any necessary stormwater permits or other approval documents . 2'. A. Any mining process producing air contamination emissions shall be subject to the permitting requirements and rules promulgated by the N.C. Environmental Management Commission. B. During mining operations, water trucks or other means that may be necessary shall, be utilized to prevent dust from ...___ _- __ _. -_leaving the__permitted area.___ 3 . A. Sufficient buffer (minimum 100 foot undisturbed) shall be maintained between any affected land and any adjoining waterway or wetland to prevent sedimentation of that waterway or wetland from erosion of the affected land and to preserve the integrity of the natural watercourse or wetland. B. Any mining activity affecting waters of the State, waters of the U. S. , or wetlands shall be in accordance with the requirements and regulations promulgated and enforced by the N. C. Environmental Management Commission. Page 4 of 8 4 . A. Adequate mechanical barriers including but not limited to diversions, earthen dikes, silt check dams, silt retarding structures , rip rap pits, or ditches shall be provided in the initial stages of any land disturbance and maintained to prevent sediment from discharging onto adjacent surface areas or into any lake or natural watercourse in proximity to the affected land. B. All erosion and sedimentation control measures shall be constructed and maintained as indicated on the mine map dated February 1996 to prevent off-site sedimentation. C. The surface of the haul road shall be stabilized with crushed stone. The drainage ditches for the haul road shall be revegetated or rip-rapped to prevent erosion and off-site sedimentation. 5 . All mining permit boundaries ( 29 acres) shall be permanently marked at the site on 100 foot intervals unless the line of sight allows for larger .spacing intervals. 6 . The angle for graded slopes' and fills shall be no greater than the angle which can be retained by vegetative cover or other adequate erosion control measure, structure , or device. - in any event, exposed slopes or any excavated channels , the erosion of which may cause off-site damage because of siltation, shall be planted or otherwise provided with ground cover, devices or structures sufficient to restrain such erosion. 7 . The affected land shall be graded so as to prevent collection of pools of water that are, or likely to become, noxious or foul . Necessary structures such as drainage ditches or conduits shall - ----be. constructed__or__installed when -required to_prevent such conditions. 8 . A. Existing vegetation or vegetated earthen berms shall be maintained between the mine and public thoroughfares whenever practical to screen the operation from the public. B. Existing vegetation or vegetated earthen berms shall be maintained as indicated on the mine map dated February 1996 to screen the mine site from public view. Said berms shall be constructed a minimum 5 foot high with a 16 foot top width and minimum 2 horizontal to 1 vertical side slopes. 9 . A. Sufficient buffer (minimum 100 foot undisturbed) shall be maintained between any excavation and any mining permit boundary or right-of-way to prevent caving of adjacent property. Page 5 of 8 B. A minimum 25 foot wide undisturbed buffer shall be maintained between the .Overburden/Schist Wastepile Area, including its associated erosion and sedimentation control measures , and the eastern permit boundary. 10 . A physical barrier consisting of a fencq or earthen berm, etc. , shall be maintained around the perimeter of any highwall . 11 . Refuse Disposal. A. No on-site disposal of refuse or other solid waste that is generated outside of the mining permit area shall be allowed within the boundaries of the mining permit area unless authorization to conduct said disposal has first been obtained from both the Division of Solid Waste Management and the Land Quality Section, Department of Environment, Health and Natural Resources . The method of disposal shall be consistent with the approved reclamation plan. B. Mining refuse as defined by G.S. 74-49 ( 14) of The Mining Act of 1971 generated on-site and directly associated with the mining activity may, be disposed of in a designated refuse area. All other waste products must be disposed of in a disposal facility approved by the Division of Solid Waste Management. No petroleum products , acids, 'solvents or their storage containers or any other material that may be considered hazardous shall be disposed of within the permitted area. 12 . An Annual Reclamation Report shall be submitted on a form supplied by the Department by February 1 of each year until reclamation is completed and approved. 13 . The operator shall notify the Department in writing of the desire to delete, modify or otherwise change any part of the mining, reclamation, or erosion/sediment control plan contained in the approved application for a mining permit and any approved revisions to it. Approval to implement such changes must be obtained from the Department prior to on-site implementation of the revisions. 14. The security which was posted pursuant to N.C.G.S. 74-54 in the form of a $5001000.00 Blanket Bond is sufficient to cover the operation as indicated on the approved application. This security must remain in force for this permit to be valid. The total affected land shall not exceed the bonded acreage. 15. A. Authorized representatives of the Division of Archives and History shall be granted access to ' the site to determine the presence of significant archaeological resources. � r � 1 Page 6 of 8 B. Pursuant to N. C. G. S. 70 Article 3 , "The Unmarked Human Burial and Human Skeletal Remains Protection Act, " should the operator or any person in his employ encounter human skeletal remains , ,immediate notification shall be provided to the county medical examiner and the chief archaeologist, North Carolina Division of Archives and, History. Page 7 of 8 APPROVED RECLAMATION PLAN The Mining Permit incorporates this Reclamation Plan, the performance of which is a condition on the continuing validity of that Mining Permit. Additionally, the Reclamation Plan is a separable obligation of the permittee, which continues beyond the terms of the Mining Permit. The approved plan provides: Minimum Standards As Provided By G.S. 74-53 1 . The final slopes in all excavations in soil , sand, gravel and other unconsolidated materials shall be at such an angle as to minimize the possibility of 'slides and be consistent with the future use of the land. 2 . Provisions for safety to persons and to adjoining property must be provided in all excavations in rock. 3 . All overburden and spoil shall be left in a configuration which is in accordance with accepted conservation practices and which is suitable for the proposed subsequent use of the land. 4 . No small pools of water shall be allowed to collect or remain on the mined area that are, likely to become noxious, odious or foul . 5 . The revegetation plan shall conform to accepted and recommended agronomic and reforestation practices as established by the North Carolina Agricultural Experiment Station and the North Carolina Forest Service. 6'. Permittee shall conduct -reclamation activities pursuant to the Reclamation Plan herein incorporated. These activities shall be conducted according to the time schedule included in the plan, which shall to the extent feasible provide reclamation simultaneous with mining, operations andin any event, provide reclamation at the earliest practicable time after completion or termination of mining on any segment of the permit area and shall be completed within two years after completion or termination of mining. RECLAMATION CONDITIONS: 1 . Provided further, 'and subject to the Reclamation schedule, the planned reclamation shall be to restore the mine excavation to a lake area and to grade and satisfactorily revegetate any adjacent disturbed areas . 2 . The specifications for surface gradient restoration to a surface suitable for the planned future use are as follows : Page 8 of 8 A. The lake area shall be excavated to maintain a minimum water depth of four feet measured from the low water table elevation. B. The side slopes to the lake excavation shall be graded to a 3 horizontal to 1 vertical or flatter above the water level - and 1 1/2 horizontal to 1 vertical or flatter below the water level . C. Any areas used for wastepiles, screening, stockpiling or other processing shall be leveled and smoothed. D. No contaminants shall be permanently disposed of at the mine site. on-site disposal of waste shall be in accordance with Operating Condition Nos. i1.A. and B. E. The affected land shall be graded to prevent the collection of noxious or foul water . 3 . Reveaetation Plan: After site preparation, all disturbed land areas shall be revegetated as recommended by Mr. Dave Leatherwood with the Soil Conservation Service dated January 21 , 1981 . ' In addition, the seeding mixtures and wildlife beneficial plants indicated on the mine map dated February 1996 shall be utilized. 4 . Reclamation Plan: Reclamation shall be conducted simultaneously with mining to the extent feasible. In any event, reclamation shall be initiated as soon as feasible after completion or termination of mining of any - - -mine_ segment-under permit.-" -Final reclamation. including - revegetation, shall be completed within two years of completion or termination of mining. A copy of this letter is attached for your reference. Our response to your specific questions/statements in your letter are as follows: l. Please review our drawing and supporting calculations attached for the sediment and erosion control plan. The design is for a 25-year storm event with minimum 1800 cubic feet of storage per disturbed acre. We have proposed a rock dam sediment basin instead of the previously proposed brick batt dam. 2. Please refer to our drawings for the detailed reclamation plan as requested. An updated re-vegetation plan is included as well. 3. The berm for visual screens will be 5'0" in height in areas shown. We propose to utilize the existing wooded buffer areas as a natural visual buffer as shown in our drawings. 4. We have shown 4-strand barbed wired fencing to prevent inadvertent entry onto the mine site. 5. Please refer to the drawings which indicate areas for waste piles along with the erosion control measures and the detailed reclamation plan. 6. The drawings indicate the location of all buildings within 300 feet of the proposed excavation and all wells within 500 feet of the permit boundaries. 7. The amended re-vegetation plan addresses the comments by the NC Wildlife Resources Commission to add seeding and planting rates and planting dates. The following additional information is needed to complete our review: 1) The sediment and erosion control plan is inadequate . All measures to remain in place for one year or more must be designed for the 25 year storm event as a minimum. Measures to remain in place for less than one year can be designed for the 10 year storm. Sediment basins and pits must have a minimum of 1800 cubic feet of storage per disturbed acre as well as meeting the above listed criteria . The proposed brick Batt dam for the sediment basin will blow out during storm events and must be replaced with rip rap. Design calculations must accompany the plan as well as typical construction details . To verify the adequacy of the proposed sediment and erosion control plan, topographic information must be provided. Furthermore, the outline of the expected clearing limits for this permit must be offered. Finally, all sediment control measures must be oriented such that any sediment-laden runoff is directed into the measures before leaving the site . The basin proposed on the most recently submitted mine map should be moved south west of its proposed location to catch runoff from the construction of the berm. The following additional information is needed to complete our review: 1) The sediment and erosion control plan is inadequate. All measures to remain in place for one year or more must be designed for the 25 year storm event as a minimum. Measures to remain in place for less than one year can be designed for the 10 year storm. Sediment basins and pits - must have a minimum of 1800 cubic feet of storage per disturbed acre as well as meeting the above listed criteria. The proposed brick batt dam for the sediment basin will blow out during storm events and must be replaced with rip rap. Design calculations must accompany the plan as well as typical construction details . To verify the adequacy of the proposed sediment and erosion control plan, topographic information must be provided. Furthermore, the outline of the expected clearing limits for this permit must be offered. Finally, all sediment control measures must be oriented such that any sediment-laden runoff is directed into the measures before leaving the site. The basin proposed on the most recently submitted mine map should be moved south west of its proposed location to catch runoff from the construction of the berm. A site visit was conducted with Mr. William Stewart on March 18, 1992 . These comments are provided in accordance with certain provisions of the Mining Act of 1971 (as amended, 1982 ; G. S. 74-46 through 74-68; 15 NCAC 5) and the North Carolina General Statutes (G.S. 113-131 et seq. ) The applicant is requesting a 10-year permit to mine mica and its byproducts on a 29-acre tract by method of dozer and backhoe. A maximum of 9 acres will be disturbed and unreclaimed at any one time. Sediment and ,erosion control measures include silt basins, berms, and revegetation. Currently, the proposed site is used as open agricultural lands. Major vegetation includes fescue, sericea, honeysuckle, broomsedge, sumac, briar, and numerous native weeds and grasses. Mixed shrubs and trees including shortleaf pine, poplar and cherry are common along field borders. This site provides upland wildlife habitat for numerous small game birds and mammals. Major wildlife which can inhabit the areas include raccoon, rabbit, quail, dove, fox and numerous nongame birds, raptors and mammals. There are no fishery resources at the proposed area. We are aware of no threatened or endangered species at the site. -Memo 0 Page 2 OApril 8, 1992 The NCWRC does not object to approving the subject applications, provided the following recommendations are implemented by the applicant: 1) Stringent erosion control measures should be implemented where soil is disturbed and maintained throughout the life of the project, especially on steep slopes. The applicant' s sediment and erosion control plan appears to be adequate. 2) Final revegetation plans should include plantings of VA-70 shrub lespedeza (20 lbs/acre) , Korean lespedeza (15-20 lbs/acre) , and partridge pea (10-15 lbs/acre) on twenty-five percent of noncritical slope areas to provide food and additional habitat for wildlife. 3) Twenty-five percent of reforested sites should include clumps of hardwoods '(i.e. , red oak, white oak, willow oak, sawtooth oak, black gum and dogwood) 3-5 acres, or greater, in size. 4) The final reclamation plans for the proposed 29-acre pond area at the Hawks site should include allowing half of the pond edge to revegetate naturally after soil stabilizati Also, it is recommended that 3 to 5 wood duck nest structures be erected as shown in the directions provided, ' in shallow water areas. ARTIFICIAL HOUSING FOR WOOD 0S (Revised , August 1972) ` The erection of artificial housing for wood ducks is becoming Increasingly important as suitable natural wood duck nesting cavities are becoming extremely scarce. For this reason the North Carolina Wildlife Resources Commission has established a program which will provide $2.50 for each suitable artificial house that is constructed and erected properly by either individuals or groups throughout the state. It is hoped that these etforts will help to perpetuate one of North Carolina' s most important waterfowl species. CONSTRUCTION AND ERECTION OF NEXT BOXES Plans for an approvable wood duck house are shown in full detail on the reverse of this page. Persons desiring the $2.50 payment should follow these specifications care- fully. Pay special attention to the entrance hole measurements, for this is so designed to keep out larger predators. For best results, rough cypress lumber should be used. However, I Inch exterior or marine plywood, or any other suitable lumber that has been treated with a preservative such as copper napthanate or pentachlorophenol may be used. If materials with a smooth inner surface are used, a three-to-four inch wide strip of fine hardware cloth must be attached to the inside front wall from the floor to the exit hole. Boxes should be erected in late winter to insure maximum use. All houses should he securely fastened to some stable structure such as a post or tree In or near the water. They may be erected with no tilt or a slight forward tilt. Never tilt a box backward as this prevents the ducklings from being able to climb the front wall and make their exodus . All cracks or holes , with the exception of the exit hole and several basal drainage holes, should be sealed or covered. Situate boxes in relatively open areas so that they may be readily found by the ducks. Do not shield the entrances with branches as wood ducks fly directly into the box and do not need to perch before enter- ing. Many wood duck boxes have become "death traps" because they were poorly constructed and not made predator-proof. Be careful to select locations that do not nffQr over- hanging branches or other pathways for depredating raccoons , snakes , or other hungry animals. if possible use the predator shield that is explained in the reverse diagram. Boxes shuuld be placed a minimum of 3 feet above the water or 10 feet above land. The construction and erection of artificial wood cluck houses can be an interesting and rewarding pastime. Eventually additional boxes may be useful since nesting wood duck colunies tend to increase around such sites. Yearly maintenance will be needed to prior to each nesting season . At this time be sure M remove all useless debris, replace or add wood shavings, check the box stability, and replace all broken or rotten hardware and boards. Any wastewater processing or mine dewatering shall be in accordance with the permitting requirements and rules promulgated by t� N.C. Environmental Management Commission. B. Any stormwater runoff from the affected areas at the site shall be in accordance with any applicable permit requirements and regulations promulgated by the Environmental Protection Agency and enforced by the N.C. B. Any mining activity affecting waters or wetlands shall be in accordance with the requirements and regulations promulgated and enforced by the W. S . Army Corps of Engineers . i Page 4 of 9 4 . A. Adequate mechanical barriers including but not limited to diversions , earthen dikes, silt check dams, silt retarding structures, rip rap pits , or ditches shall be provided in the initial stages of any land disturbance and maintained to prevent sediment from discharging onto adjacent surface areasior into any lake or natural watercourse in proximity t� the affected land. B . All erosion and sedimentation control measures shall be installed and maintained as indicated on the revised mine maps, Sheets 1 through 17 , dated March 9 , 1994 . C. Appropriately designed eresion and sediment control measures shall be installed and maintained, as necessary, below the previous United States Gypsum plant area to prevent offsite sedimentation . D. Appropriately designed diversions and chute spillways shall be provided and maintained, as necessary, to control surface drainage on -the fill area between the plant area and Interstate Highway 85. 5. A. The angle for graded slopes and fills shall be no greater than the angle which can be retained by vegetative cover or other adequate erosion control measure, structure, of device. In any event, exposed slopes or any excavated channels , the erosion of which may cause offsite damage because of siltation , shall be planted or otherwise/ provided with ground cover, devices or structures sufficient to iestrain such erosion. i B . An undisturbed buffer zone of 25 feet along both sides of the gas line shall be maintained`. In addition, all excavated slopes adjacent to the buffer zones along the gas line shall be maintained at a 2 foot horizontal to 1 foot vertical o� flatter slope. 6 . The affected land shall be graded so as to prevent collection of pools of water that are, for likely to become, noxious or foul. Necessary structures such as drainage - ditches or conduits shall be constructed or installed when required to prevent such conditions. 7. A. Existing vegetation or vegetated earthen berms. shall be maintained between the mine and public thoroughfares whenever practilcal to screen the operation from the public. B. Visual screening berms shall be constructed as - indicated on the mine map titled "N.C. Mining Permit No. 23-3 Renewal" last revised February 7 , 1992 . i i / Page 5 of 9 f 8 . Sufficient buffer (minimum 50 foot undisturbed) ,shall be maintained between any excavation and any mining permit boundary or right-of-way to prevent caving of adjacent property. 9 . A physical barrier consisting , f a fence (4 strand barbed wire, a minimum of 4 feet in height) or earthen berm, etc. , shall be maintained around the perimeter of any highwall . 10 . Refuse Disposal A. No on-site disposal of refuse or other solid waste that is generated outside of the mining permit area shall be allowed within the boundaries of the mining permit area unless authorization to conduct said disposal has first been obtained from both the Division of Solid Waste Management and the Lard Quality section, Department of Environment, Health and Natural Resources. The method of disposal shall be consistent with the approved reclamation plan. B. Mining refuse as defined by G.S. 74-49 ( 14 ) of The Mining Act of 1971 generated on-site and directly associated with theimining activity may be disposed of in a designated refuse area. All other waste products - must be disposed oflin a disposal facility approved by the Division of Solid Waste Management. No petroleum products, acids, solvents or their storage containers or any other material that may be . considered hazardous shall be disposed jof within the permitted area. 11 . An Annual Reclamation Report shall be submitted on a form supplied by the Department by Februaryl of each year until reclamation is completed and approved. 12. The operator shall notify the Department in writing of the desire to delete, modify or otherwise change any part of the mining, reclamation, lor erosion/sediment control. plan contained in the approved application for a mining permit and any approved revisions to it. approval to implement such changes must be obtained from -the Department prior to on-site implementatr(ion of the revisions . 13 . The security which was posted pursuant to N.C_G.S. 74-54 in the form of a $500,1000 .00 Blanket Bond is sufficient to cover the operation as indicated on the approved application.
