I will respond to each item in your letter in the same order for clarity: 1. A copy of the Certified Mail receipt and the signed return receipt from notification of Beaver Dam, LLC is attached. 2. The entire site is within the 100 year floodplain, and this notation has been added to the site maps. 3. A letter from Thomas Shrader, Pitt County floodplain manager is attached. 4. The wetlands delineation report from Environmental and Soil Science Inc is attached. 5. The Affected Acreage Table has been corrected. 6. The berms shown around the plant and some mining areas in the northern part of the permitted are classified as in the Affected Acreage Table as "waste areas", as was previously requested by your office in an earlier permitting action. 7. The Affected Acreage Table has been corrected. 8. It is acknowledged that no land disturbance is permitted in areas not approved in the modification. Per the email and plan received,this proposed development will be located largely in the floodway, and has an existing no-rise certification on file. This project also wetland and buffer determinations that are on file,but may require additional buffer determinations moving forward depending on the pit areas. This preliminary plan is approved,but will require the mentioned documentation before a floodplain development permit can be issued from this office. Additionally, no further mining, including test pits, should occur before the rezoning process is complete and a floodplain development permit has been issued. USACE Jurisdictional Determination...............................................................8 1 Summary At the time of our investigation the site was being used to grow timber and serve as wildlife habitat.It is understood a portion of the site is being proposed as a borrow pit.The objective of this report is to provide the owner with a preliminary wetland delineation and jurisdictional determination to determine areas that may be available for the borrow pit without impacting potential wetlands. Due to continued and accelerated degradation of the Nation's waters,the United States Congress enacted the Clean Water Act.The Act was enacted to maintain and restore the waters of the United States. Section 404 of the Act gives authorization to the Secretary Of the Army, acting through the Chief of Engineers to issue permits for the discharge of dredge or fill material into waters of the United States,which includes wetlands. Before any land disturbing activity can begin on a site which has wetlands,those wetlands must be delineated and determined to be jurisdictional or non jurisdictional by the US Army Corps of Engineers(USAGE). However, no matter what the wetland is determined to be,all wetlands are still regulated. 1.0 Introduction This report and wetland determination was done using the 1987 US Army Corps of Engineers (USACE)Wetland Delineation Manual and the Atlantic and Gulf Coast Regional Supplement as references. The location of wetlands needed to be known to determine if the proposed borrow pit may or may not impact wetlands or waters of the US. 1.1 Site Description The site was located between Stokes Road and the Tar River in north central Pitt County,North Carolina(Figure 1). The +/- 38.8 acre project area was located on a portion of+/-101.66 areas that were identified as parcel numbers 10812, 84331, 56789 and 66597.The upland areas of the site consisting mainly of pines.There were some cleared areas for wildlife food plots and travel ways in the upland areas.The wetland areas paralleled the Tar River and consisted mainly of hardwood bottoms and flats.A logging road and culverts were in place and were used to access the project area. The topography was undulating,which are typical of the floodplains located adjacent to the river. Elevations of the site typically ranged from 5 feet above sea level adjacent to the river to about 25 feet on upland areas and 18 feet in wetland areas'.The Tar River was the closest named water body.The Tar River is a navigable water. 1.2 Methods Wetland determinations are made by the technique of delineating. The process first starts with a review of items such as aerial photos,USGS maps,soil survey maps,flood maps and a physical inspection of the property. When on site,hydrophytic vegetation,hydrology and hydric soil indicators are used to identify the wetland boundary. All three of these criteria must be present for an area to be classified as a wetland. When the three criteria are identified,Wetland Determination Data Forms are filled out.The actual wetland boundary is identified by being flagged.An on-site meeting is then held with the USACE to verify the findings. ' Google Earth 2 If requesting an Approved Jurisdictional Determination(AJD)the flag locations are located by a professional land surveyor and a wetland delineation map is prepared by the professional surveyor,which if approved,is signed by a representative of the USACE.Jurisdictional Determination(JD-Rapanos)forms are filled out to determine if the wetland is under the jurisdiction of the USACE. If the USACE agrees with the information submitted, an AJD is issued by the USACE.There may be other requirements that apply depending on the specific situation. AJD's are valid for a period of five(5)years. If requesting a Preliminary Jurisdictional Determination (PJD)the flag locations do not have to be located by a professional land surveyor;however,the flagged wetland line is still reviewed by the USACE. Either a surveyed delineation map or a generic delineation map can be submitted to the USACE for a PJD.Wetland Determination Data Forms must be submitted to the USACE but no JD-Rapanos forms are required when requesting a PJD. When issuing a PJD,the USACE does not sign off on an approved wetland delineation map.If the USACE agrees with the information submitted, a PJD is issued.There may be other requirements that apply depending on the specific situation. PJDs have no expiration. In this case,a PJD was requested. 2.0 Wetland Determination 2.1 Wetland Delineation The initial wetland investigation took place in April and May,2019.The purpose of the initial wetland delineation was to determine if potential wetlands were present at either end of an area proposed for the borrow pit. After determining that wetlands were present at either end of the area proposed for a borrow pit,the remainder of the potential wetlands were identified. The potential wetland and upland areas were identified and the potential wetland line was flagged.The potential wetland flags were located with a GPS unit capable of sub-meter accuracy. Preliminary wetland maps were then formed by ESS(Figures 2,3,4,5,6,7 and 8).The maps presented herein are the final maps that were submitted to the USACE after some revisions were made.A PJD request form and signed agent authorization form were submitted to the USACE prior to a site meeting that was held with Ms.Emily Thompson on November 21,2019.Copies of upland and wetland data sheets(Appendix 1),a USGS topographic map(Figure 9),preliminary wetland maps(Figures 2,3,4,5,6,7 and 8),and a copy of the Pitt County Soil Survey (Figure 10)were also presented to the USACE. After some discussion on site and discussion about the boundary of the project area, Ms.Thompson concurred with the wetland delineation. 2.2 Jurisdictional Determination Ms.Thompson determined that all wetlands/Waters of the US identified by ESS would be under the regulatory jurisdiction of the USACE.Appendix 2 is the jurisdictional determination form issued by the USACE(SAW-2019- 01683). 3.0 Conclusions A wetland delineation of the property revealed the presence of potential jurisdictional 404 wetlands. Any impact to the areas shown as wetlands or water of the US shown on the preliminary wetland delineation maps (Figures 2, 3, 4, 5, 6, 7 and 8)would be subject to 404 permitting requirements and approval from the USACE and NCDWR.
