COUNTY OF CARTERET EASEMENT
THIS EASEMENT made and entered into this 1,_�_ day of June, 2020, by and between
DAWN CONSTANCE HEPLER CIOKAN of 245 Moonlight Drive, Atlantic Beach, NC hereinafter
called "GRANTOR," and PERCY S. LEES and wife, LAURA LEE of 1439 Loop Road, Clayton, NC
27527, hereinafter called "GRANTEE;"
WHEREAS, GRANTOR is the owner of Lot 26 in Beach Mobile Home Court as depicted on
that map recorded in Map Book 303, Page 286, Carteret County Registry.
WHEREAS, GRANTEE is the owner of Lot 27 in Beach Mobile Home Court as depicted on
that map recorded in Map Book 303, Page 286, Carteret County Registry.
WHEREAS, GRANTEE desires to construct a boat lift facility adjacent to the west side of
their existing dock which would encroach upon the riparian (littoral) area of GRANTOR;
WHEREAS, GRANTOR has agreed to grant an easementto GRANTEE over their riparian
(littoral) area for construction of the boat lift and for their current dock;
NOW THEREFORE, in consideration of the sum of One Dollar ($1.00) and other good and
valuable consideration, the receipt and sufficiency of which is hereby acknowledged, GRANTOR
does hereby grant, bargain and convey unto GRANTEE, their successors and assigns, the
perpetual right, privilege and easement to build, construct, install, enlarge, change, repair, improve,
upgrade, operate and maintain a pier and boat lift, including utilities to serve the same, over, under,
across, in and upon Grantor's riparian (littoral) area as shown on Exhibit A attached hereto, that
Exhibit being incorporated herein by reference.
GRANTOR does further grant, bargain, and convey to GRANTEE, their successors and
assigns, subject to the conditions set forth herein, the perpetual right, privilege, and easement for
ingress, regress and egress over, under, in, across and upon said easement for the purpose of
maintaining and reconstructing its facilities in the easement area described above. GRANTOR
reserves the right to utilize the area within the easement area for all purposes not inconsistent with
the easement rights herein conveyed.
The facilities erected, constructed, or placed in the easementarea shall remain the property
of GRANTEE. GRANTEE shall have the right to inspect, rebuild, remove, repair, improve, and/or
relocate within the areas indicated on Exhibit A and make such changes, alterations orsubstitutions
of its facilities as GRANTEE may from time to time deem necessary or advisable.
For the purpose of constructing, inspecting, rebuilding, removing, repairing, improving,
maintaining, changing, altering, or substituting GRANTEE's facilities and running utility services to
such facilities, GRANTEE shall have the right of ingress to and egress from the easement area
over, and the temporary construction use of, the riparian (littoral) area GRANTOR adjacent to the
easement area in such manner as shall cause the least practicable damage and inconvenience to
GRANTOR.
The consideration herein recited shall constitute payment in full for any encumbrance of the
riparian area of GRANTOR, their heirs, successors or assigns, by reason of any facility or activity
herein referred to. The GRANTEE covenants to maintain the easement area in good repair so that
no unreasonable damage will result from its use to the adjacent riparian (littoral) areas or land of
GRANTOR, their heirs, successors, and assigns.
TO HAVE AND TO HOLD the aforesaid rights, privileges and easements unto said
GRANTEE, its successors and assigns, for so long as GRANTEE maintains facilities in the
easement area.
