The applicant and owner of Airlie Gardens, New Hanover County, intends to utilize the structures for student and visitor educational purposes as well as a stopping point for kayak-type ecotourism. The enclosed project narrative prepared by Haden-Stanziale provides additional information. The main structure consists of a 6'-wide elevated wooden pier with a pentagon-shaped outdoor classroom (open deck) at the waterward end. The overall length of the structure is 266'. An associated 6'x23' floating dock will be positioned to the northwest of the outdoor classroom and will be accessed by an aluminum ramp. Water depths at the floating dock are approximately —1.5' at mean low water, which will be sufficient for expected temporary kayak-type usage. The height of the pier deck boards will be greater than 3' above the coastal wetland substrate to minimize shading and provide for structure protection. The structures will be located approximately 570' feet from the western riparian line and approximately the same distance from the eastern riparian line. The outer limits of the main structure will remain approximately 23' from the near edge of the maintained Bradley Creek Channel. There is no proposed excavation or fill within the open waters or wetland areas in association with this project. Riparian notification has taken place and I have enclosed the signed Adjacent Riparian Property Notification/Waiver Form indicating no objection from St. James Parish as well as the Certified Mail Return Receipt from the Fox notification, which was postmarked 10/7/04. Shortly after historic Airlie Gardens was preserved from development in 1999, New Hanover County requested financial support for a Public Beach and Coastal Waterfront Access improvement project at the Gardens. The first phase of this project was funded and includes a waterfront boardwalk and demonstration buffer planting. The first phase of the boardwalk affords expansive views of the Intracoastal Waterway and out to Wrightsville Beach and provided rare public access to the estuary waterfront. The cool summer breezes coming off the water make the boardwalk a favored spot at Airlie, providing visitors with an accessible and handsome waterfront experience. The boardwalk has become an integral part of the Gardens' environmental education program, serving as an outdoor classroom for school children and their parents, as well as an educational opportunity for garden visitors. Interpretive signage introduces visitors to estuarine ecology and hands-on science education programs help to strengthen the 8th grade hydrosphere curriculum for local school children. The adopted Airlie Gardens Master Plan calls for a second phase of the boardwalk which would extend past the CAMA line into the Bradley Creek to provide additional access to visitors and students interested in learning more about the tidal creeks, and allow direct access to the tidal environment for"hands-on" learning activities. Airlie has already become an important part of local ecotourism, serving as a destination for kayak tours based at Wrightsville Beach. This boardwalk extension will serve several critical roles including: • Expanded visitor access to the waterfront • Enhanced study access to the tidal creeks for monitoring and education • Improved a controlled access point kayak/canoe landing for ecotourists • Extensive demonstration buffer planting Airlie is owned and operated by New Hanover County with the assistance of the Airlie Gardens Foundation, a 501 c3 non-profit organization. Extensive restoration of the Gardens is underway with the construction of the first phase of the visitor center and a Garden Services Center, a base for education, training and maintenance operations scheduled for 2003/2004. Recent improvements include the Landscape Showcase Garden, the Rain Garden, restoration of the pergola Garden, and restoration/adaptive reuse of the caretaker's cottage as administrative offices. Membership in the Friends of Airlie has increased over 700% in the past year and attendance has doubled from the previous year. The environmental education program was launched and has served over 1200 students through on site field trips. The program will be expanded to include a 3`d Grade component in the coming school year. Could you describe the new rules and how they changed with respect to the initial amendment that was passed? With the sunset clause the division was being;nccouraged to replace the previous bill and they did. The bill allowed new non-water dependent buildings!The problem with that was that the corps of engineers would not allow it under section 10 of rivers and harbors act(navigable waters). The new rules only allow for the expansion of buildings vertically,without incresing the size of the existing footprint,and new decks to be built as long as they are n 20 feet. Before original amendment the 30ft rule would have pretty much precluded any develo ent between water street and the river. These rules cover municipalities in a central business district wi minimal undeveloped land and urban services such as police and fire protection. P-64itrj) 1'h..N 1. Are you familiar with the amendment? If so,what is your opinion on the amendment? Yes,the rules are good. The idea is that there are these urban areas that are already impacted and if we're going to have these buffers impacted already,we should let it happen in the developed areas rather than encouraging it in non-developed areas. It encourages more development but encourages it to be done in areas that are already impacted. Also allows people to enjoy the historic city waterfronts. 2. Have you observed any change in the amount of waterfront construction and development that has taken place in Wilmington as a direct result of the 1997 amendment? tbi 0-141bev The City of Wilmington was granted a major permit for the boardwalk and the ondos that were built. That permit was granted within the three year period and extended because they were still working on the project. Normally permits are extended for three years if the project is not complete. The only projects that were constructed were done so under this blanket permit issued to the city between the area just South of Market street all the way to the Coastline Inn. There has certainly been a change in the amount that could be developed. The Almont shipping site is proposing to build a marina for PPD. There don't seem to be any big problems that would prevent this from being passed except for a little bit of marsh impact. 3. Have you observed any change in the environmental quality surrounding the waterfront in Wilmington since the 1997 amendment? How would you describe the change that has occurred? Would you say that there is a connection between this change and any change in waterfront development that has occurred? I haven't observed any,but if anything,it should be better because the urban waterfront rules require storm water plans which is better than even just leaving the existing structures there,because the urban waterfront rules address runoff very well. 4. Have you observed any change in the Wilmington economy since the 1997 amendment? How would you describe the change that has occurred? Would you say that there is a connection between this change and any change in waterfront development that has occurred? • I would assume that if we're allowing development that couldn't otherwise occur there,developers are taking advantage of that and the city is getting benefits from toursism and increasing their tax base. 5. Do you feel that any environmental or economic changes that have occurred will impact the regulation of waterfront development in Wilmington? How would you describe that impact? Sure,I think it has already. For example,a bill was passed that created an urban waterfront.area(SB 732) without having a central business district or services. So potentially,an urban waterfront could be created, "... in the middle of nowhere",rather than in an urban area that is already developed. It's still up to the CRC for a fmal decision on that,but we could see more things like that happening. ' 6. Could you refer me to anyone else that is knowledgeable about this issue,who happens to view the situation differently than yourself? May be a good idea to talk to Henry Wicker with the Corps of Engineers to get a federal viewpoint. He reviews all the CAMA permits(910)251-4930.
