Statement of Compliance and Consistency
This permit is subject to compliance with this application, site drawing and attached general and specific conditions. Any
violation of these terms may subject the permittee to a fine or criminal or civil action; and may cause the permit to become
null and void.
This permit must be on the project site and accessible to the permit officer when the project is inspected for compliance. The
applicant certifies by signing this permit that I)prior to undertaking any activities authorized by this permit,the applicant will
confer with appropriate local authorities to confirm that this project is consistent with the local land use plan and all local
ordinances, and 2) a written statement or certified mail return receipt has been obtained from the adjacent riparian
landowner(s).
The State of North Carolina and the Division of Coastal Management, in issuing this permit under the best available
information and belief,certify that this project is consistent with the North Carolina Coastal Management Program.

Coastal Bluffs Dock Special Maintenance Agreement 9/19/2020
On the evening of August 3, 2020 Hurricane Isaias destroyed the common dock shared by the parties
named on the signature page, and subject to the dock agreement executed on January 23, 2015, and
filed with Pender County Register of Deeds on January 26, 2015.
In that the dock structure is over 30 years old, and the integrity of the material is suspect, repairing the
existing dock is not practical.
Bids have been secured to Replace the dock from both entry points to the end of the floating structure.
The bid assumes the 10 pilings used to hold the floating dock will be replaced, the pilings holding the
piers will be used, all other structure on the piers will be removed and replaced.
The parties agree to contract with Southern NC Marine LLC to do the work at a cost of$90,940.This is
the wood frame composite decking. Includes support for permitting, removing all old structure, and
replacing per quote.
The parties agree to provide a check for$22,735 from each house to be delivered to Jim Gainer within
10 days. Jim will deposit in a trust account on the part of the Coastal Bluff Dock Owners and distribute
to the contractor as appropriate.
The parties agree, in any project there are potential contingencies, the parties agree if necessary to
overrun of 10%or$2,274 per home. If the overrun is more than 10%and additional authorization
meeting should be held. Should the final bill be less than$90,940,Jim will refund as appropriate.

RECIPROCAL EASEMENT & MAINTENANCE AGREEMENT
Agreement made, effective as of this the day of January, 2015 by and between Shane
Moran, unmarried, Ines M. Cuadrado, widow, Mark I. Nunalee, Trustee for the Cuadrado Family
Trust, James A. Gainer and wife Lisa C. Gainer, Barbara J. Szem and husband Paul B. Szem
(hereinafter"parties")
W I T N E S S E T H :
WHEREAS; the parties hereto own property commonly known as 324 Olde Point Loop
Road, 100 Coastal Bluffs Court, 104 Coastal Bluffs Court, and 108 Coastal Bluffs Court all in
Hampstead, North Carolina 28443, respectively, (hereinafter referred to as the "Lots") located in
Pender County North Carolina and further described in Exhibit"A'attached hereto;
WHEREAS, the parties own property which shares a common dock and boat slips which
have been previously constructed;
WHEREAS,the dock and boat slips have been the subject of previous litigation which was
voluntarily dismissed,see Pender County file 07 CVS 0977;
WHEREAS,it is the intent of the parties to clarify the ownership, access and maintenance
rights to the dock and boat slips;
WHEREAS,all parties agree that each party,theirs heirs,successors or assigns shall have the
right of access and use of the dock and boat slips and that all shall have a duty to share in the cost
of the maintenance and replacement of said dock and boat slips and that said rights and duties shall
run with the ownership of the land referenced hereinabove and shall not be severed from that
ownership;
WHEREAS; The parties hereto desire to create and convey unto one another a reciprocal
easement for the ingress, egress, and regress over each property and lot hereinabove referenced
limited to the first thirty feet from the high-water line of each Iot for the purpose of accessing,
using, and maintaining said dock and boat slips according to the terms of this agreement
(hereinafter"30 foot easement");

WHEREAS,to facilitate the use of said slips all patties agree to the boat slip assignment as
shown on attached Exhibit"B and B-1"which shall be binding on all parties, their heirs,successors,
and assigns.
WHEREAS, each individual party will be responsible for the upkeep, maintenance, and
replacement of any improvements made by said individual to their respective assigned slip,however,
this duty shall not affect the parties' duty to maintain the dock and slips as a whole as per this
agreement;
WHEREAS, all parties agree that the slips shall be used for personal or private use and no
commercial type use may be used including but not Iimited to charter fishing for fees;
WHEREAS, all parties agree to hold harmless and indemnify one another and release the
other parties, owners, guests, licensees, invitees, employees, subcontractors or assigns (collectively
referred to as"permittees") from any and all liability while using the dock and slips;
NOW THEREFORE,for and in consideration of the sum of Ten Dollars,and other good
and valuable consideration, to each other,in hand paid, the parties hereto do hereby grant, bargain,
sell,and convey unto each other a perpetual right and 30 foot easement over their Lots to access,use
and maintain said dock and boat slips.
It is expressly understood and agreed that all permittees shall have the right of ingress to and
egress over the 30 foot easement on each lot hereinabove referenced for the purpose of accessing,
using,and maintaining said dock and boat slips according to the terms of this agreement.
It is further expressly understood and agreed that all permittees shall use the dock and boat
slips at their own risk and shall indemnify and hold harmless all other owners their permittees, and
successors and/or assigns from any and all liability arising out of the use or ownership of said dock
and boat slips.
The parties hereto agree that parties, their heirs, successors, and assigns shall be jointly
responsible for the continuing maintenance of the dock and boat slips,at equal cost and expense per
lot,with said dock and boat slips to be maintained in such a condition so as to allow the current use
of the dock and boat slips to continue.Decisions on maintenance and upkeep of the dock and boat
slips shall be made by a majority vote with each lot having one vote. All expenses shall be borne
equally by each lot with amounts owed being paid within ten days notice from the majority so
approving.
The land over which said reciprocal easement and rights of ingress, egress, and regress are
granted and over which the maintenance agreement contained herein applies is described as follows:

To have and to hold the aforesaid rights and easements to it, the Grantees, their successors
and assigns, in title forever; it being agreed that the rights and easement hereby granted is
appurtenant to and runs with the land now owned by the Parties hereto.

The parties covenant with one another that they are seized of the above described land in
fee simple in which the aforesaid rights and easement are granted and they have the right to convey
such rights and easements, that the same is free and clear of all encumbrances, and that they will
forever warrant and defend the title to the same against the lawful claims of all persons
whomsoever.

the shore
Lot owners 3&4 will have the slips located on the outside- 3 closest to the
shore
Each slip is 40 feet long with a 11 foot buffer in between 1&2,3&4
11 foot area between slips is a community area shared by all parties.
Any improvements made to the individual slips are at the sole expense of the
owner,and must comply with rules and regulations.
