drawing and attached general and specific conditions. Any
violation of these terms may subject the permittee to a fine,
imprisonment or civil action; and may cause the permit to be-
come null and void.
This permit must be on the project site and accessible to the
permit officer when the project is inspected for compliance.
The applicant certifies by signing this permit that 1) this pro-
ject is consistent with the local land use plan and all local
ordinances, and 2) a written statement has been obtained from
adjacent riparian landowners certifying that they have no
objections to the proposed work.

This permit, issued on "A— q � is subject to compliance with the application (where consistent
with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these tennis may
be subject to a fine, imprisonment or civil action: or may cause the permit to be null and void.
Pu`Aic Beach Access Area
1) Title to the one acre public beach access area, as identified on workplan drawing sheet 6 of 7. shall;
be transferred to Carteret County on or before December 31, 1996.
2) The placement of fences or similar structures which would prohibit lateral access to other portions
of the beach outside of the boundaries of the public beach access area is not authorized.
3) The design of all piers in and adjacent to the Straits shall be constructed in such a manner as to
allow for the reasonable movement of the public along the beachfront area. Examples of
acceptable pier designs include, but are not limited to, elevating the piers to allow for pedestrian
passage underneath the structure, or terminating the pier near the waters edge to allow for
pedestrian passage around the pier.

This permit action may be appealed by the permittee or
otho r qualified persons within twenty (20) _,'avs of the
issuing date. An appeal requires resolution prior to work

I have spoken with Donald Ray Allen. He and his wife, Patricia B. Allen are owners of the
property described as Lot 4 Harkers Point, Harkers Point Drive, Harkers Island, NC. My
wife, Susan and I are the adjoining property owners at Lot 3 Harkers Point.
The Allens have not yet applied for their CAMA Permit for their pier, boatlift and tie piles,
however they are aware of the unmarked channel that fronts our pier on Lot 3. Mr. Allen
advises me that the length of his pier will be approximately the same length as our pier and will
end at the front of where the channel is. This is fine with me as my concern was that if his pier
went out too far is that it would block the unmarked channel leading up to our pier. Furthermore,
the Allen's pier will be constructed on the left side of their lot when facing the water so as to not
create a tight area between our pier and theirs.
