This permit is subject to compliance with this application, site
drawing and attached general and specific conditions. Any
violation of these terms may subject the permittee to a fine,
imprisonment or civil action; and may cause the permit to be-
come null and void.
This permit must be on the project site and accessible to the
permit officer when the project is inspected for compliance.
The applicant certifies by signing this permit that 1) this pro-
ject is consistent with the local land use plan and all local
ordinances, and 2) a written statement has been obtained from
adjacent riparian landowners certifying that they have no
objections to the proposed work.

Dear Mr. Homey:
The reason for the delay in getting back to you on your request to JTW Investments, Inc. to grant
permission to push up the sand in front of your beach lot is twofold:
1. The stockholders of the corporation have been trying to reach a decision on how, when, and
if to list the property they own, which may join you, for sale. This decision has now been made,
and some of the property is listed for sale with an Emerald Isle Realtor.
2. There has not been a meeting of the Board of Directors lately, in order to have them address
your request. There will be a meeting this coming Monday, April 28, 1997. We will try to have
this matter put on the agenda at that time.
I hope you can appreciate the fact that they are several individuals that have an interest in this
corporation. An attempt had been made to contact them individually to reach a decision on
agreement on this matter, but to no avail. The owners are not all at the same location.
We realize you are facing a deadline, but again, we hope you see that we do need consent of the
other owners. We will let you know of our decision as soon as possible.

Through coordination with the North Carolina Division of Coastal
Management (NCDCM), we learned that you bulldozed sand on the Atlantic Ocean
beachfront, Emerald Isle, Carteret County, North Carolina.
On January 1, 1995, we renewed general permit No. 198000048, (copy
enclosed) that authorizes emergency construction of primary dunes and the
placement of sandbags filled by excavation from areas waterward of the mean
high water (MHW) elevation contour on Atlantic Ocean shorelines in Brunswick,
Carteret, Currituck, Dare, Hyde, New Hanover, Onslow and Pender Counties,
North Carolina.
Your work was authorized if you complied with all general permit
conditions and the following conditions designed to prevent any adverse
impacts on nesting sea turtles or other Federally -listed endangered or
threatened beach strand species. We note that your work was accomplished
prior to April 30, 1997, and there is neither State nor Federal authorization
for continuation of any work beyond that date.
a. No daily construction activities, including the operation of vehicles
or equipment, or the disturbance of the sand surface, shall be initiated until
after a certified Sea Turtle Watch volunteer has inspected the site of any
proposed activity and verified that no new sea turtle nests have been laid
where construction -related impacts will occur.
b. Should a new sea turtle nest be located in an area where construction
activities are planned, those construction activities shall not be initiated
until after a certified Sea Turtle Watch volunteer has relocated the sea
turtle eggs and approved the initiation of daily construction activities;
alternatively, certified Sea Turtle Watch volunteers may, in cooperation with
applicants or contractors employed by applicants, designate and mark by
flagging, sea turtle nest buffer zones where disturbance will be avoided.
C. Prudent measures shall be taken to ensure that permit -related
activities do not interfere with sea turtle nesting activities. Construction -
related activities, or other activities which may injure, confuse, or trigger
avoidance behavior in sea turtles shall not occur during the nighttime (for
the limited purposes of this emergency, nighttime is defined as the period
between one-half hour after dusk and the inspection, by a certified SEA Turtle
Watch volunteer, of impact zones, the following morning). No nighttime
construction is authorized; all vehicles, equipment, supplies, and materials,
including construction debris and demolition material, shall be removed to an

upland area landward of the dune line prior to the cessation of activities for
the nighttime.
To prevent an unintentional violation of Federal law, prior to the
commencement of any additional work on the Atlantic Ocean beachfront or in any
other navigable waters or waters of the United'States, including wetlands, you
should contact us as well as the North Carolina Division of Coastal
Management.
