I would like to express my objections to the project and strongly recommend this permit be denied. I have previously rejected his requests for me to waive my riparian rights for other projects on this same parcel. My objections are as follows: 1) The parcel in question is a thirty foot wide access strip between my property and my neighbor at 3 Creekside Woods Drive. The intended use of this property is to provide community access to the Queens Creek River for all residents of the Creekside Woods community. Allowing Mr. Hartley to build personal property on this access area without full consent and participation of the community should not be allowed. Anything that is built on this community access site should be constructed to meet public use building codes to ensure the safety of all members of the Creekside Woods community who would use this structure. 2) The specific structure in Mr. Hartley's latest request, proposes a twenty foot extension to his current structure that ends at the water line for Queens Creek. The stated purpose of this ramp is to launch a kayak or canoe. The existing structure is approximately five feet above the mean high tide water line. A ramp of only twenty feet in length at this height would make the ramp angle approximately 14 degrees. This ramp would be too steep to safely use, especially when wet. 3) Mr. Hartley has made his intentions known that he wants a personal dock at this site. The parcel he owns has limited water access space and there are already docks on either side of this property. In my opinion, adding a third dock in the space would be too crowded. Is the approval of this request the limit of what Mr. Hartley can build at this site or is this just the next step in allowing Mr. Hartley to add some type of dock structure? April 1, 2003; August 1, 2000. 15A NCAC 07H .1302 APPROVAL PROCEDURES (a) An applicant for a General Permit under this Subchapter shall contact the Divisio�f Coastal Management and request ,ppproval for development. The applicant shall provide information on ite location, imensions of the project area, and his name and address. (b) The applicant shall provide: (1) confirmation that a written statement has been obtained signed by the adjacent riparian property owners indicating that they have no objections to the proposed work; or ✓(2) confirmation that the adjacent riparian property owners have been notified by certified mail of the proposed work. The notice shall instruct adjacent property owners to provide written comments on the proposed development to the Division of Coastal Management within ten days of receipt of the notice, and, indicate that no response shall be interpreted as no objection. DCM staff shall review all comments and determine, based on their relevance to the potential impacts of the proposed project, if the proposed project can be approved by a General Permit. If DCM staff determines that the project exceeds the guidelines established by the General Permit Process, DCM shall notify / the applicant that he must submit an application for a major development permit. (c) No work shall begin until an on -site meeting is held with the applicant and appropriate Division of Coastal Management representative so that the proposed boat ramp alignment may be appropriately marked. Written authorization to proceed with the proposed development may be issued during this visit. Construction of the boat ramp structure shall be completed within 120 days of this visit or the general authorization shall expire. Individuals shall allow authorized representatives of the Department of Environment and Natural Resources to make periodic inspections at any time deemed necessary in order to be sure that the activity being performed under authority of this general permit is in accordance with the terms and conditions prescribed herein. --rc) There shall be no unreasonable interference with navigation or public use of the waters during or after construction. The proposed project has been determined to comply with the Rules of the Coastal Resources Commission (Title 15A NCAC 7H.1300), and as such, a permit has been issued to authorize the development. I have enclosed a copy of the permit, as well as the relevant rules. If you wish to contest our decision to issue this permit, you may file a request for a Third Party Hearing. The request for a hearing will be considered by the Chairman of the Coastal Resources Commission. The hearing request must be filed with the Director, Division of Coastal Management, in writing and must be received within twenty (20) days after the disputed permit decision is made.
