This permit is subject to compliance with this application, site
drawing and attached general and specific conditions. Any
violation of these terms may subject the permittee to a fine,
imprisonment or civil action; and may cause the permit to be-
come null and void.
This permit must be on the project site and accessible to the
permit officer when the project is inspected for compliance.
The applicant certifies by signing this permit that 1) this pro-
ject is consistent with the local land use plan and all local
ordinances, and 2) a written statement has been obtained from
adjacent riparian landowners certifying that they have no
objections to the proposed work.
In issuing this permit the State of North Carolina certifies that
this project is consistent with the North Carolina Coastal
Management Program.

Being the owners of property in Sea Vista Section !V on Windward Drive, Lots Number 2,
3, 4, 5, 6 and 7, we agree to accept spoil from the dredging of the channel off Whittaker Creek
West in the area designated on the attached drawing. The spoil will be used as fill on the
property.
The Dredging Project Group is composed of owners of the property bordering the channel
off Whittaker Creek (West Branch), namely: Ken and Sandra Van Hook, Arthur and Elise
Tierney, Alfred R and Alice J. Tobie, Richard and Cindy Sim, Gregory R. Reese, Philip and Anne
Heckhaus, Ralph and Harriet Schaar, James and Ina McCarthy, and Robert and Pat Pezzoli.
Robert and Pat Pezzoli have the authority to sign obligations for the Group.
The dredging will be done according to all the requirements of C A M A. The Dredging
Project Group, along with Carroll Cowell Dredging Company, will be responsible for complying
with all requirements of that agency. Joseph and Anne Gwaltney will bear no responsibility in
the project.
A 15-foot dike will be erected to contain the spoil which will be pumped through pipes
laid across the street. Return pipes will carry the clean water back to the canal. The pipes will
be protected from traffic as recommended by the highway department with warning signs posted
along the street.
Work will commence as soon as the permit is received from C A M A.
No money will exchange hands in this agreement, both parties having received value by
means of the transaction.

Dear Mr. Noble:
Enclosed are (1) a check for $50.00 made out to D E H N R; (2) signatures from the
property owners of the twelve properties bordering Whittaker Creek West Canal granting their
permission to dredge the canal; (3) a sketch of the canal which will be dredged and (4) a letter
in duplicate from Joseph and Anne Gwaltney granting permission for the spoil from the dredging
to be pumped onto property owned by them.
The amount of spoil to be removed will be under 1,000 cubic yards; therefore we
respectfully request that we be granted a minor permit to dredge this canal. Mr. Cowell who is
going to do the dredging is ready to proceed with his work, the land is ready to receive it and we
await your permit to do the dredging.
Mr. and Mrs. Gwaltney requested that you acknowledge your agreement on their behalf by
signing and returning the copy of their letter to them at the address thereon.

Dear Pat and Bob,
We received your letter on Saturday, Sept. 12th, and greatly appreciated
the detailed breakdown. It surprised us that you got such a good response,
after there was such a poor response to similar work on the adjacent
canal a couple of years back.
WE., will give you a YES providing the cost to us is $1174 or less
(� firm). We would then have to reconsider our position _which is not
a rock -hard NO. We are probably the only family that does not plan
on building on our lot, at least not for now.
As we will be temporarily on the road for the week of the 14th
through the 18th, we will call you at 9:00 a.m. on the 19th to discuss
any new events. If you cannot be there, we will try again another time.
It has certainly worked out well due to your diligent efforts on everyone's
behalf.
WE:, are still planning to start back to Oriental about October 15th,
so we may not be there while the work is ongoing. Appreciate your offer
to watch the work fcr us. Please let us know what costs are involved
with any extra eggress/access work. It will be next to impossible for
us while we are on the road. We are planning on stopping in Norfolk
to see my sister who is very ill and all alone, so that may also slow
our arrival. Of ccurse, we will take care of any expenses on our behalf.

was flat calm, without letup, except for the rock-and-roll of the many

Enclosed are two copies of the drawing of the "Spoil Site for the Pezzoli Group". Joe
Gwaltney was kind enough to allot a full acre for the project.
We appreciate your coming to look over our project. We will stay within 1,000 cubic
yards of spoil in the dredging which you have agreed will keep us within the "minor permit"
parameters.
We have signatures of every one on the canal permitting our go-ahead. As far as we
know that is all we need to do to apply for our permit.
If there is anything else we have to do, please let us know. Otherwise we will await your
response.
