drawing and attached general and specific conditions. Any
violation of these terms may subject the permittee to a fine,
imprisonment or civil action; and may cause the permit to be-
come null and void.
This permit must be on the project site and accessible to the
permit officer when the project is inspected for compliance.
The applicant certifies by signing this permit that 1) this pro-
ject is consistent with the local land use plan and all local
ordinances, and 2) a written statement has been obtained from
adjacent riparian landowners certifying that they have no

This correspondence is in reference to letter of August 22, 1998 whereby you stated objections
to a proposed bulkhead, pier, "T"-shaped platform and an uncovered boat lift by your adjacent

The Division of Coastal Management has given your objections careful consideration and has
determined that the project as proposed is consistent with the pertinent rules and regulations
of the Division. Consequently, the Division issued a general permit on October 2, 1998 to Mr.
Willard Southerland for the aforementioned development.
If you wish to appeal this permit decision, you may file a request with the Director of the
Division of Coastal Management, Department of Environment and Natural Resources within
20 days of the permit decision. I have enclosed a copy of the permit for your records. If you

We received the enclosed ADJACENT RIPARIAN PROPERTY OWNER NOTIFICATION/
WAIVER FORM from Willard and Yvonne Southerland today, Saturday, August
22, 1998 and would like to register the following objections:
1. This form states that "The individual applying for this permit has
described to me as shown on the attached drawing the development they
are proposing". The fact is that, while Mr. and Mrs. Southerland
have discussed other dock proposals with us in the past, they have
not discussed the current proposal with us. We may have been able to
resolve some of the questions and objections below if we had been
given the opportunity to review this before it was sent to us by
certified mail.
2. This form further states that "A description or drawing, with
dimensions, should be provided with the letter". The fact is that,
while some dimensions are shown on the drawing, a number of important
dimensions are not shown. For example, the width of the proposed
bulkhead is shown as 71' but the dimension showing how far out the
bulkhead will extend toward the water is not given. Also, the
distance from the Southerland yard line to the mean high water line
is not shown. This makes it impossible to determine the precise
length of the dock from the shore. We do not think that CAMA should
approve any dock proposal that does not specifically show all
important dimensions.
3. The drawing does not provide for a boat lift or a boat slip, even
though Mr. and Mrs. Southerland have indicated in the past their
desire to have a boat lift on one side of their dock and a boat slip
on the other side. Please note that addition of a boat lift or a
boat slip on our side of the dock would violate the 15' setback
required from the property line and that we do NOT wish to waive the
15' setback. If Mr. and Mrs. Southerland still intend to have a 121
wide boat lift on one side of their dock and a 12' wide boat slip on
the other side, they need to reduce the width of their "T" from 33'
to 17' in order to meet the 15' setback on each side.
4. Based on the scale shown on the drawing, the bulkhead would appear to
extend out approximately 15' on the Davis side. During an on -site
meeting with Mr. Charles Pigott last summer, Mr. Micah Davis and I,
Robert Norris, were told by Mr. Pigott that, if Mr. Southerland was
allowed to build a bulkhead, then, in order to avoid covering up the
existing marsh grass, it would extend out no more than about 51. If
he is allowed to extend his bulkhead out approximately 15, as
proposed, it would cover up a lot of marsh grass that was present at
this site as recently as July of this year.
We appreciate the opportunity to present our objections to this proposal
and hope that you will find that they have some merit. We would also
like to be informed of any decisions made by CAMA regarding this matter.

BEGINNING at an existing iron pipe set in the northern right of way
of a drive leading to S. R. 1398 said point being further
identified as being located S 48-00-55 E, 690.24 feet from a tack
set in the centerline intersections of S. R. 1386 and S. R. 1398;
running thence from said POINT AND PLACE OF BEGINNING, N 39-30 E,
212.8 feet to an existing axle iron set in the highwater mark of
the North River; continuing thence with the highwater mark of the':
North River, S 15-15 E, 85 feet to an existing iron pipe set in the
Hubert Davis line; running thence S 36-42 W, 160.56 feet to an
