This permit is subject to compliance with this application, site
drawing and attached general and specific conditions. Any
violation of these terms may subject the permittee to a fine,
imprisonment or civil action; and may cause the permit to be-
come null and void.
This permit must be on the project site and accessible to the
permit officer when the project is inspected for compliance.
The applicant certifies by signing this permit that 1) this pro-
ject is consistent with the local land use plan and all local
ordinances, and 2) a written statement has been obtained from
adjacent riparian landowners certifying that they have no
objections to the proposed work.
In issuing this permit the State of North Carolina certifies that
this project is consistent with the North Carolina Coastal
Management Program.

Dear Mr Piggott
I am attaching our original letter of objection to the bulkhead project proposed
at 111 Hoop Pole Creek Drive. i do want the original letter to be kept as part of
the record as the application document has been redone therefore eliminating
any other record of our opposition to the project. I have had conversations
with both Charles Jones and Ted Tyndell on this matter but no other written
record of our position exists.
As now proposed, the bulkhead will run from the eastern property line of the
subject property for a distance of 35 linear feet. This would keep it at least 35
feet from our property line. I have signed off on this proposal
Hmvever, we are documenting the Current lines of the shore, and the vegetation
above & below the high water mark. Should this project backfire, we will remain
in opposition to the extension of this bulkhead in the future. We also intend to
take any legal steps oeressary to protect the shoreline we have preserved. For the
reasons stated in our original letter (attached), we will also tale any legal steps
necessary should our property become adversely impacted by this project.
We believe that your agency should use every opportunity to encourage any
of the available alternative methods of shoreline stabilization in areas where
the majority of shoreline is not already bulk ]leaded. Let this letter serve as a
record of our position and our notice of intent should this current project turn
In another "problem" for our neighbors in the future.

Dear Charles:
Your offices will he in receipt of an Application proposing a bulkhead at 111 hoop
Pule Creek Drive- We are, as adjacent properly owners, opposed to the issuance of
a permit for this bulkhead dare to the following reasons:
1. The applicants, Mr & Mrs Donald Soles, systematically contributed to the
erasion problem That now exists at the southern boundary of their property
by cutting trees and removing other vegetation.
2. They erected a makeshift bulkhead without a permit. this further accelerated
their problem. They were made to remove this by your offices but were
not fined.
3 The Soles then cintinued a coarse of removing live trees mad vegetation in viola-
tion of both LAMA and local regulation despite repeated warnings, most
of which is documented in the Atlantic Beach. Inspections Offices.
We have no problem with an alternative method of shoreline stabdiration.
We do not want to be forced to bulkhead our property due to erosion Mused
by their construction of a hardened structure. Bulkheads are the exception
nether than the ruic on hoop Prole Creek, and left alone, the vegetation has
dme a great job of protecting the shoreline_
We have every intention of pursuing any mad every legal action if the improper
activities of the Soles are rewarded with a remedy (flat causes us expense or beg ins
the erosion of our property. It would abia be the height of irony if an agency that is
now pursuing the prohibition of such structures acts on the behalf of people that
hive violated the rules and thereby caused their own problem. These are people
yppr agency should have tined for improper activities. Will you now instead poten-
tially penalize those who have remained in compliance with the rules? 1 certainly
think that an alternative, passive solution for the Soles would be more than fair.
