Statement of Compliance and Consistency
This permit is subject to compliance with this application, site drawing and attached general and specific conditions. Any
violation of these terms may subject the permittee to a fine or criminal or civil action; and may cause the permit to become
null and void.
This permit must be on the project site and accessible to the permit officer when the project is inspected for compliance. The
applicant certifies by signing this permit that 1) prior to undertaking any activities authorized by this permit, the applicant will
confer with appropriate local authorities to confirm that this project is consistent with the local land use plan and all local
ordinances, and 2) a written statement or certified mail return receipt has been obtained from the adjacent riparian
landowner(s) .
The State of North Carolina and the Division of Coastal Management, in issuing this permit under the best available
information and belief, certify that this project is consistent with the North Carolina Coastal Management Program.

The purpose of this letter is to respond to Emerald Isle Realty letter
dated August 26, 2002 (enclosure 1) concerning riparian rights Lot 68
White Oak Bluff Rd ,Stella NC .
We have the following objections to solid bulkheads ( retaining wall ):
Hardened structure material such as arsenic and salt treated wood
can be hazardous to aquatic and wildlife.
Bulkheads frequently cause or increase erosion to non -hardened
shorelines.
Studies show definite decreases in juvenile fish caused by reduction
in spawning grounds and loss of habitat.
A hardened structure will increase wake action along the narrow
creek cutting into the marsh grasses and reducing the habitat and nesting
areas for numerous species of birds, mammals, and reptiles, to include
Clapper rails, red wing blackbirds, kingfishers, alligators, otters,and foxes.
Additionally, reference Division of Coastal Management Adjacent Riparian
Property Owner Notification / Waiver Form (Enclosure 2 ) we do not wish to
waive the 15' setback requirement.

Dear Mr Newman,
Thc; attached is the required document to adjacent property owners for the
procedure in acquiring riparian rights to modify along the waterfront of
the property adjacent to your home located at 224 White Oak Bluffs Road,
Stella, NC.
This document has an attached illustration(not to scale) for erecting a 100'
retaing wall, a 50' pier and a 24' covered boat lift. It meets all the criteria
with reguards to setbacks and size. There is a photo attached of a similar
modification to a lot further down the road in White Oak Bluffs for better
understanding.
This application is being submitted for the buyers of Lot 68, William &
Susan Johnson.
