Any violation of these terms may subject the permittee to a fine or criminal or civil action; and may cause the permit to become null and void. This permit must be on the project site and accessible to the permit officer when the project is inspected for compliance. The applicant certifies by signing this permit that 1) prior to undertaking any activities authorized by this permit, the applicant will confer with appropriate local authorities to confirm that this project is consistent with the local land use plan and all local ordinances, and 2) a written statement or certified mail return receipt has been obtained from the adjacent riparian landowner(s) . The State of North Carolina and the Division of Coastal Management, in issuing this permit under the best available information and belief, certify that this project is consistent with the North Carolina Coastal Management Program. Ross Jr., Secretary This letter is in reference to your April 20, 2002 correspondence objecting as an adjacent riparian property owner to Mr. William F. Horton's request for a CAMA permit for a pier to be constructed on Yeopim Creek adjacent to his property located at Lot #33, New River Drive, Albemarle Plantation off SR 1347 in Perquimans County, North Carolina. I have reviewed your objection to the project which is based on your opinion that the proposed pier would severely impact your view. While it is true that you will be able to see Mr. Horton's proposed pier from your property, the development proposed does not appear to interfere with access to your riparian property. Therefore, the Division of Coastal Management has given your objections careful consideration and that the project as proposed is consistent with the appropriate rules and regulations and that all pre -requisite requirements have been met. Consequently, the Division issued a general permit (copy attached) on May 23, 2002 to Mr. William F. Horton for a new pier. If you wish to appeal this permit decision, you may file a request with the Director of the Division of Coastal Management, Department of Environment, Health and within 20 days of the permit decision.
