Statement of Compliance and Consistency
This permit is subject to compliance with this application, site drawing and attached general and specific conditions. Any
violation of these terms may subject the permittee to a fine or criminal or civil action; and may cause the permit to become
null and void.
This permit must be on the project site and accessible to the permit officer when the project is inspected for compliance. The
applicant certifies by signing this permit that 1) prior to undertaking any activities authorized by this permit, the applicant will
confer with appropriate local authorities to confirm that this project is consistent with the local land use plan and all local
ordinances, and 2) a written statement or certified mail return receipt has been obtained from the adjacent riparian
landowner(s) .
The State of North Carolina and the Division of Coastal Management, in issuing this permit under the best available
information and belief, certify that this project is consistent with the North Carolina Coastal Management Program.

Dear Mr. Rose:
This letter is in response to your correspondence dated May 10, 2002 objecting as an
adjacent riparian property owner to Mr. Jack Burruslrequest to construct a bulkhead, boat dock
and dig out the mouth of his canal on his property located at 509 Highway 64/264 South,
Manteo, Dare County and adjacent to Shallowbag Bay. I have reviewed your objection to Mr.
Burrus' development proposal and, although Mr. Burros has initiated unauthorized development
activities in CAMA Areas of Environmental Concern, he has been cited for CAMA violations,
completed restoration requirements and paid assessments. An engineered plan and scaled
drawings are not requirements for notification for CAMA General Permit.
Therefore the Division of Coastal Management has given your objections careful
consideration and has determined that the project as proposed is consistent with the appropriate
rules and regulations and that all pre -requisite requirements have been met. Consequently, the
Division issued a general permit (copy attached) on June 17, 2002 to Mr. Jack Burrus for a
bulkhead.
If you wish to appeal this permit decision, you may file a request with the Director of the
Division of Coastal Management, Department of Environment and Natural Resources within 20
days of the permit decision. If you have any questions regarding this matter you may contact me
in the Elizabeth City Field Office at 252-264-3901.
