Any violation of these terms may subject the permittee to a fine or criminal or civil action; and may cause the permit to become null and void. This permit must be on the project site and accessible to the permit officer when the project is inspected for compliance. The applicant certifies by signing this permit that 1) prior to undertaking any activities authorized by this permit, the applicant will confer with appropriate local authorities to confirm that this project is consistent with the local land use plan and all local ordinances, and 2) a written statement or certified mail return receipt has been obtained from the adjacent riparian landowner(s) . The State of North Carolina and the Division of Coastal Management, in issuing this permit under the best available information and belief, certify that this project is consistent with the North Carolina Coastal Management Program. You have requested Department of the Army (DA) permit authorization to bulldoze sand from the Atlantic Ocean beachfront for the purpose of establishing a protective dune waterward of your house and septic tank. The house has been determined to be "imminently threatened" by the North Carolina Division of Coastal Management (NCDCM). I am in receipt of a copy of NCDCM's Certificate of Exemption, dated June 4, 1999. The Corps of Engineers' regional general permit (RGP), Action ID No. 198000048, (copy enclosed) authorizes the emergency construction of primary dunes for the protection of imminently threatened structures. Work authorized by this RGP, pursuant to Section 10 of the Rivers and Harbors Act of 1899 and Section 404 of the Clean Water Act, includes the bulldozing of sand from the beach waterward of the mean high water elevation contour. Because of the difficulty in determining the mean high water elevation contour in the field, the "wet sand line" (the most landward reach of waves at high tide on a normal day) is used as the jurisdictional line. Bulldozing sand waterward of the wet sand line requires DA permit authorization pursuant to Section 10 because work is being conducted in a navigable water of the United States. This type of work also requires DA permit authorization pursuant to Section 404 because a discharge of dredged or fill material in jurisdictional waters of the United States is occurring. If all work or activity associated with such a project occurs landward of the wet sand line, DA permit authorization is not required. However, please be advised that it is very difficult to bulldoze a sufficient quantity of sand to create a protective dune from the beach landward of the wet sand line. �/t -J/ rl-- s s I/ -2- Please note Special Condition "f' on page 2 of the RGP. Enclosed is a copy of correspondence from the U.S. Fish and Wildlife Service (USFWS) dated May 14, 1999. This letter expresses the USFWS opinion with regard to Special Condition "f'. As a result, RGP 198000048 does not authorize your proposed work from April 1 through November 15 or until the USFWS determines that your proposed work will have "no effect" on Federally threatened or endangered species.
