Any violation of these terms may subject the permittee to a fine, imprisonment or civil action; and may cause the permit to become null and void. This permit must be on the project site and accessible to the permit of- ficer when the project is inspected for compliance. The applicant certi- fies by signing this permit that 1) this project is consistent with the local land use plan and all local ordinances, and 2) a written statement has been obtained from adjacent riparian landowners certifying that they have no objections to the proposed work. In issuing this permit the State of North Carolina certifies that this project is consistent with the North Carolina Coastal Management Program. Brooks OCT 2 4 2001 786 Brooks Road Bath, North Carolina Dear Mr. Brooks, This letter is in reference to our 19 October 2001 telephone conversation regarding the construction of a boathouse on your property at 786 Brooks Road in Bath on Back Creek in Beaufort County, North Carolina. On 16 October 20011 issued you General Permit No. 29208-B for the construction of a 12' by 24' uncovered boatlift adjacent your existing pier. By rule, the construction of a boathouse requires that you have a minimum of 75 linear feet of shoreline (North Carolina Administrative Code 07H.0208(b)(6)(G)). You have indicated that you own ±50 linear feet of shoreline on Back Creek. Therefore, you are not eligible for a boathouse with only ±50' of shoreline. You may request a variance from the rule through the Coastal Resources Commission. I am inclosing the forms for a variance.
