Statement of Compliance and Consistency
This permit is subject to compliance with this application, site drawing and attached general and specific conditions. Any
violation of these terms may subject the permittee to a fine or criminal or civil action; and may cause the permit to become
null and void.
This permit must be on the project site and accessible to the permit officer when the project is inspected for compliance. The
applicant certifies by signing this permit that 1) prior to undertaking any activities authorized by this permit, the applicant will
confer with appropriate local authorities to confirm that this project is consistent with the local land use plan and all local
ordinances, and 2) a written statement or certified mail return receipt has been obtained from the adjacent riparian
landowner(s) .
The State of North Carolina and the Division of Coastal Management, in issuing this permit under the best available
information and belief, certify that this project is consistent with the North Carolina Coastal Management Program.

On 18 March 2002 Mr. Steve Trowell and I, Field Representatives for the Division of Coastal
Management (DCM) in the Washington Regional Office met with you at your office in Winton, North
Carolina. The purpose of the meeting was to discuss the Bertie, Hertford, Northampton Water
District's plans to repair/replace failing culverts and perform bank stabilization along portions of
Ahoskie Creek, near Ahoskie, in Hertford County, North Carolina. During the course of that
meeting, the question arose as to whether that section of Ahoskie Creek running between NC
Highway 561 and SR 1427 (Thomas Bridge) was navigable, and therefore a Public Trust Area, which
is an Area of Environmental Concern (AEC) as designated by the Coastal Resources Commission and
subject to permit requirements.
On 28 March 2002, Steve Trowell, Ed Lynch, Planner for DCM, Lynn Henry of the Division
of Marine Fisheries, and I successfully navigated that section of Ahoskie Creek running between NC
Highway 561 and SR 1427 (Thomas Bridge) in canoes. Due to fallen trees, we had to portage for a
short distance (less than 20 feet) on two (2) occasions; however, we observed a discernible creek bed
at all times. Based on this information, that section of Ahoskie Creek is navigable and is a Public
Trust Area. The channelized section of Ahoskie Creek located upstream of the NC Highway 561
bridge crossing (including the proposed project area) is also navigable, is a Public Trust Area AEC,
and is subject to permit requirements.
On 20 March 2002, I issued General Permit No. 30720-B to the Bertie, Hertford,
Northampton Water District for the repair/replacement of failing culverts and to perform bank
stabilization at nine (9) sites along that portion of Ahoskie Creek located between SR 1118 and SR
1101. As we discussed at the time I issued the general permit, those activities authorized by the
permit would be more appropriately authorized via the CAMA major permit process. Therefore, I
encourage you to either have completed all work authorized by the aforementioned general permit by
20 June 2002 (the expiration date of the general permit) or to incorporate these activities, as
previously suggested, in a Major CAMA application for maintenance excavation, etc. of the Ahoskie
Creek drainage project.
