Mavity 3910 Roswell Drive Tallahassee, Florida 32310-4940 9 1 2002 Re: Objection to a bulkhead and pier on adjacent property - Dear Ms. Mavit:y: This letter is in reference to your correspondence received on December 31, 2001, objecting as an adjacent riparian property owner to a request from Mr. Jon Beckner to construct a bulkhead and pier on his property located at Tract 7, Deerfield Woods, Mashoes, in Dare County and adjacent to the Albemarle Sound. Frank Jennings of my staff was recently on site and reviewed Mr. Beckner's proposal. Mr. Jennings noted that the lot frontage along the Albemarle Sound is approximately 212 feet and that the property is suffering erosion as evident by an existing erosion escarpment. Mr. Jennings reviewed the development request for a bulkhead and pier and found both to be consistent with North Carolina Administrative Code T15A 07H .1100 General Permit for Construction of Bulkheads and the Placement of Riprap for Shoreline Protection in Estuarine and Public Trust Waters and 07H .1200 General Permit for Construction of Piers; Docks; and Boat Houses in Estuarine and Public Trust Waters. Mr. Jennings reviewed the points of concern noted in your letter dated December 26, 2001 and found the following: 1) The "present law allows" for the construction of the bulkhead and pier. The bulkhead will not provide adverse action to the tidal flow of the coastline". The tide will continue to flow and the bulkhead will stop shoreline erosion on Mr. Beckner's property. 2) Mr. Beckner made an offer to Mr. Raymond A. Baldone to purchase the property on November 26, 2001 and the offer was accepted on November 29, 2001 by Mr. Baldone. Mr. Beckner has a vested interest and he may apply for a CAMA permit. Therefore, the Division of Coastal Management has given your objections careful consideration and has determined that the project as proposed is consistent with the appropriate rules and regulations of the Coastal Resources Commission and that all prerequisite requirements have been met. The Division issued General Permit #31165A (copy enclosed) on February 19, 2002 to Mr. Jon Beckner. If you wish to appeal this decision you may file a request with the Director of the Division of Coastal Management, Department of Environment and Natural Resources within twenty (20) days of the permit decision.
