Statement of Compliance and Consistency
This permit is subject to compliance with this application, site drawing and attached general and specific conditions. Any
violation of these terms may subject the permittee to a fine or criminal or civil action; and may cause the permit to become
null and void.
This permit must be on the project site and accessible to the permit officer when the project is inspected for compliance. The
applicant certifies by signing this permit that 1) prior to undertaking any activities authorized by this permit, the applicant will
confer with appropriate local authorities to confirm that this project is consistent with the local land use plan and all local
ordinances, and 2) a written statement or certified mail return receipt has been obtained from the adjacent riparian
landowner(s) .
The State of North Carolina and the Division of Coastal Management, in issuing this permit under the best available
information and belief, certify that this project is consistent with the North Carolina Coastal Management Program.

EASEMENT AGREEMENT
THIS EASEMENT AGREEMENT, made this 7wday of September, 1995 by and
between ARTHUR B. CLARK and wife, PATRICIA A. CLARK, hereinafter referred to as
"Grantor", and PAXON McLEAN HOLZ, as Trustee for the W. B. McLean Marital Trust, of
106 Manatee Street, Cape Carteret, Swansboro, NC 28584, hereinafter referred to as
"Grantee";
WITNESSETH:
THAT WHEREAS, Grantor is the owner of Lots 70 and 71, Section One, Bayshore Park
Subdivision, as recorded in Map Book 5, Page 65, Carteret County Registry; and that
WHEREAS, Grantee is the owner of Lots 68 and 69, Section One, Bayshore Park
Subdivision, as shown on Map Book 5, Page 65, Carteret County Registry; and that
WHEREAS, there is an old canal which runs from Bogue Sound through the property
of Grantor and Grantee.
NOW, THEREFORE, Grantor and Grantee do hereby agree as follows:
1. That Grantor warrants that the existing canal has been cleaned out and deepened, it
is thirty-six and one-half (36 1/2) feet wide, the canal has been bulkheaded in accordance with
the various CAMA permits issued for said proposed clean out and construction, and that all costs
incurred have been satisfied.
2. That Grantee has agreed it will pay the sum of Five Thousand Dollars and No Cents
($5,000.00) towards the expense of the dig out and construction of the bulkhead along the canal,
in accordance with the plans and specifications as contained in the CAMA permit. All other
costs of said construction and bulkheaden- have been the obligation of the Grantor.
3. Grantee does further agree that it will relinquish any rights it may have in said canal
that would extend northeastwardly from the proposed terminus of the bulkhead, in which it
would have riparian rights as the canal initially extended onto Lots 68 and 69.
4. Grantor does hereby -rant unto Grantee, in consideration of the sum of Five �\�
Thousand Dollars and No Cents ($5,000.00) riparian �_ 1 s i1 ,
an easement for ingress, egress and regress over said canal to be constructed, a ri-ht-of-way
from Lots 68 and 69 to said canal, said right-of-way being ten (10) feet in width and being more
particularly described to wit:
LYING and being in White Oak Township, Cape Carteret, North Carolina and
commencing at a point where the southern right of way of Edgewater Court
extended would intersect the western right of way of Bogue Sound Drive, and
running with the western edge of Bogue Sound Drive South 16 degrees 16
minutes West 450 feet to the dividing corner betweens Lots 69 and 70 in Section
1 of Bayshore Park as shown on that map of record in Map Book 5, Page 65 in
the Carteret County Registry; thence leaving the right of way of Bogue Sound
Drive and running with the dividing lines between Lots 69 and 70 North 73
degrees 44 minutes West 150.72 feet to a point where the bulkhead of an existing
canal on Lot 70 extended would intersect the dividing line between Lots 69 and
70, this point also being THE POINT OF BEGINNING: thence with the line of
the bulkhead on the existing canal as extended South 51 degrees 01 minutes 53
seconds West 37.25 feet to a point; thence North 38 degrees 58 minutes 07
seconds West 10.6 feet to a point; thence North 51 degrees 01 minutes 53
seconds East 29.89 feet to a point; thence South 73 degrees 44 minutes East 12.9
feet to the POINT OF BEGINNING.
See map entitled, "Survey for Coastal Maintenance, Inc.", dated May 31, 1995
and prepared by Prestige Engineering and Land Surveying, P.A.
It is further agreed and understood that Grantee may utilize up to one-half (1/2) of the
canal that would abut the above described easement area by the placement of piling. Further,
Grantee shall have the right to construct, if it so desires, in said canal, a small dock and a boat
lift. Said easement will be for ingress, egress and regress, water and electrical easements and
for the mooring of a vessel in said area, and Grantee shall have the right to navigate said vessel
to and from said mooring area across the waters in said canal to the navigable waters of Bogue
Sound. Said easement is also to provide ingress, egress and regress and water and electrical
easements from Lots 68 and 69 over the above described area to said canal.
This easement is to run with and be appurtenant to the lands of Grantee.
It is further agreed and understood that after the installation of the bulkhead and the clean
out of said canal, that should the above described premises not abut said canal, this agreement
will be amended to provide that said ten (10) foot easement will be abutting to the canal and that
Grantee will be able to utilize the twenty-five (25) foot area which would abut same, that would
lie immediately to the east and south of said bulkhead.
It is further agreed and understood that Grantee is not to be responsible for any
contractors, subcontractors or other third parties who may contract with the Grantor for the
construction of said canal, and its sole liability is the payment of Five Thousand Dollars and No
Cents ($5,000.00) to Grantor after the construction of said canal and bulkhead is complete.
TO HAVE AND TO HOLD, the aforesaid perpetual easement for ingress, egress and
regress for the installation of a dock and mooring pilings and hereinabove set forth across the
aforesaid land, with all privileges and appurtenances thereto belonging to said Grantee, its heirs
and assigns, to their use and behoof forever.
IN TESTIMONY WHEREOF, said parties have hereunto set their hands and seals the
day and year first above written.
