Any violation of these terms may subject the permittee to a fine or criminal or civil action; and may cause the permit to become null and void. This permit must be on the project site and accessible to the permit officer when the project is inspected for compliance. The applicant certifies by signing this permit that 1) prior to undertaking any activities authorized by this permit, the applicant will confer with appropriate local authorities to confirm that this project is consistent with the local land use plan and all local ordinances, and 2) a written statement or certified mail return receipt has been obtained from the adjacent riparian landowner(s) . The State of North Carolina and the Division of Coastal Management, in issuing this permit under the best available information and belief, certifythatthis project is consistent with the North Carolina Coastal Management Program. Ross Jr., Secretary (� April 16, 2002 It �, � .- Y RE: Objections to the Issuance of General Permit to Construct a Pier in Colington Harbour Dear Mr. and Mrs. Dopler: This letter is in reference to your objections to John Alldredge's request to construct a 6'x 40' pier with mooring pilings that would encroach into your riparian corridor. Lynn Mathis of the Division of Coastal Management staff was recently on site and reviewed the proposal with Mr. Alldredge's agent Mike Byrne. In order to bring the request into compliance with the Division's requirements, Mr. Alldredge is no longer requesting the mooring pilings and has reduced the length of the pier to 30'. Ms. Mathis reviewed the modified request and found it consistent with T15A, Section 07H .1200: General Permit for Construction of Pier: Docks: and Boat Houses in Estuarine and Public Trust Waters, of the North Carolina Administrative Code (See Enclosed Rule). The Division of Coastal Management has given your objections careful consideration and has determined that the project, as modified, is consistent with the appropriate rules and regulations and that all prerequisite requirements have been met. The Division issued General Permit #30114A on April 15, 2002, to John Alldredge (See Enclosed Permit). If you wish to appeal this decision, you may file.a request with the Director of the Division of Coastal Management, Department of Environment and Natural Resources within twenty (20) days of the permit decision. An appeal request form has been enclosed for your convenience.
