This permit is subject to compliance with this application, site
drawing and attached general and specific conditions. Any
violation of these terms may subject the permittee to a fine,
imprisonment or civil action; and may cause the permit to be-
come null and void.
This permit must be on the project site and accessible to the
permit officer when the project is inspected for compliance.
The applicant certifies by signing this permit that 1) this pro-
ject is consistent with the local land use plan and all local
ordinances, and 2) a written statement has been obtained from
adjacent riparian landowners certifying that they have no
objections to the proposed work.
In issuing this permit the State of North Carolina certifies that
this project is consistent with the North Carolina Coastal
Management Program.

This letter is in response to your letter of July 14, 1993 to our
office concerning a proposal by Cherry Branch LTD. We have
considered your objections to the project and have determined that
the proposal does meet our standards. Therefore we have issued a
General Permit authorizing the proposed rip rap. The permit was
issued on September 3, 1993 and a copy is enclosed for your review.
You have the opportunity to request an appeal of the permit
pursuant to NCAC 7J.0300 (enclosed). If you choose to request an
appeal, please contact my office at 919-726-7021 to cbtain the
necessary forms. The appeal forms must be submitted to this cffice
within twenty days of the permit issuance.

This letter is in response to your certified letter of June
30, 1993. Kindly be advised that of this date my wife (Doris
Soto) and my self are not in a position to grant your request,
per your proposal to construct a rip -rap bulkhead on property
owned by Cherry Branch Ltd., (Cherry Branch Waterfront) lots
26, 27, and 28, which is adjacent on the shoreline to lot 32
of which we are the owners.
The matter has been reviewed with the Division of Coastal
Management in Morehead City, field representative Mr. Charles
Pigott on this date. I have requested that our decision be
recorded on their records with a follow up letter to be sent
to the attention of field representative Mr. James Mercer, whom
I was advised was responsible for processing the proposal by
Cherry Branch Ltd.
Our concerns at this time are that if in any event after such
construction of rip -rap bulkhead.... if there were any damages
incurred as a result to our property, who would be held
responsible and who would eventually compensate us for our
losses.
If you have any recommendations towards a solution, please do
not hesitate to correspond them to us.

Per a recent conversation (July 13th) with your associate Charles
Pigott, I am writing this letter to your attention regarding
the proposal made by Cherry Branch, LTD. of which I have enclosed
a copy.
Please be advised that my wife (Doris Soto) and I are owners
of lot #32, shoreline property at Cherry Branch West. We are
hereby notifying your office of our objection to said proposal
for a "rip -rap bulkhead" to be constructed on adjacent lots,
numbers 26, 27, and 28.
Our objections to this proposal involve the threat of damages
incurred to our property in the event the bulkhead is
constructed, and who would be held responsible for any
compensation for our losses.
Our understanding as discussed with your office is that such
a threat of damages to our property is very possible if such
a bulkhead is constructed on the adjacent lots.
Correspondence has been mailed to Cherry Branch Ltd. attention
Mr. Donald G. Lawrence, (certified mail/ dated July 13th)
advising him of our decision. I have enclosed a copy of this
letter for your records.
