Field Services Morehead City February 23, 1983 Subject Permit 484 - Gull Harbor Home Pwners Asso. Carteret At approximately 8:30 AM on Feb. 22, 1983, Buck Coyne, attorney, came by my Morehead City office . His client is Mr. J. C. Harvell of Carteret County and is an adjacent property owner to the Gull Harbor properties off Hwy. 24, Bogue Sound. Mr. Harvell had apparently expressed great concern about erosion and sedimentation to his pro- perty and boat basin which adjoins to spoil disposal area of the Gull Harbor project. Mr. Coyne and I reviewed the subject permit for various conditions of which Condition No. 3 of the permit reads that the disposal area ef- fluent shall be contained by pipe, trough, or similar device to a point or below the MLW mark to prevent gully erosion and resultant unnecessary siltation. I showed Mr. Coyne the permit and conditions, as well as the work plat drawing which outlines a ditch, secondary pond and pipe trough that would discharge the dredged effluent to Bogue Sound. Nevertheless, I assured Mr. Coyne that before the day was out that I would make an onsite inspection of the disposal area and try to assess the situation. At about 3 o'clock in the afternoon I made an onsite inspection of the disposal area to find that no work was actually being conducted. In fact, the dredging had been completed some time in mid to late 1982. However, I did find an 8" plastic pipe (what appeared to be a secondary drainage pipe) through the diked disposal area leading to a common drainway adjoining Mr. Harvell's property. The pipe was in fact drain- ing some water. It was my determination that there was no significant damage to the Har- well property, although there is a potential that some damage has oc- curred along with siltation of the existing boat basin owned by Mr. Harvell. I made the decision to contact Mr. Sydnor Borden, the representative of Gull Harbor Homeowners Asso., and drove to his house for a face to face conversation. I advised him of the situation and recommended how to correct the problem - that is, to at least stop up the pipe to pre- vent it from draining onto the Harvell property. I outlined that this was most important to be done in light of the fact that we were expect- ing 3" of rain due to heavy thunderstorms during the night of 2-22 and morning of 2-23. Mr. Borden was very cooperative and outlined the problems he had been faced with the original contractor (C. C. King) in trying to dewater the spoil disposal area and ultimately landscaping the area per their contract with Mr. King. I returned to the office and called Buck Coyne at about 3:35 and re- lated my findings to him. Mr. Coyne seemed pleased that there was not the real damage as indicated by his client. He said he would pro- bably get over to the site and make an inspection that afternoon. I commented to Mr. Coyne that at this time I would not institue viola- tion proceedings against Gull Harbor, depending upon the resolution of the problem. I also indicated that Mr. Borden in Gull Harbor would continue working with C. C. King in an effort to develop a long range cleanup program for the disposal area. At about 4 o'clock that afternoon, Mr. Borden and his friend from Gull Harbor came to my office to report to me that they had in fact been successful in stopping up the pipe so that no further water would drain onto the Harvell property. I advised them that I had contacted the attorney and that he seemed to be pleased with their efforts to cor- rect the problem. Again, I took the opportunity to advise Mr. Borden that at this time there would be no legal violation procedures taken against Gull Harbor Asso. (1) In order to protect juvenile shrimp population, no excavation or filling will be permitted between the dates of April 1 through September 30 of any year without prior approval of the Office of Coastal Management. (2) All excavated materials shall be confined on high ground behind adequate dikes or other retaining structures to prevent spill—over of solids into any marsh or surrounding waters. (3) The disposal area effluent shall be contained by pipe, trough, or similar device to a point at or below the mean low water mark to prevent gully erosion and resultant unnecessary siltation. (4) The terminal end of the pipeline shall be positioned at or greater than 50' from any part of the dike and a maximum distance from spillways to allow adequate settlement of suspended solids. (See attached sheet for Additional Conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. An appeal requires resolution prior to work initiation or continuance, as the case may be. This permit must be accessible on-site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Departmental approval. All work must cease when the permit expires on May 31, 1983 in issuing this permit, the State of North CarAina agrees that your project is consistent with the North Carolina Coastal Management Program. Project summary The applicant proposes to maintenance dredge the access channel lead to the boat basin.. w 9. Narrative description 10. The project site consists of the 1100' long access channel that leads from the AIWW in Bogue Sound to the highground boat basin owned by Gull Harbor Homeowners Asso- ciation. This residential subdivision is located off US Hwy. 24 about 6 miles west of the City of Morehead City in Carteret County. The request to maintenance the access channel is being processed as a Major Modifi- cation with a name transer since the proposed work exceeds the original permit re- quest (Permit 484, Walton W. Smith) by at least 20% of the original work. In addi- tion, the permittee's name should be changed or transfered from Walton W. Smith (the developer) to the name of the Homeowners Association (Gull Harbor). Another modification to the original permit is the onsite spoil disposal area which is owned by two individuals: John Eubanks and Wesley Long. As proposed, the appli- cant will contract a hydraulic dredge to maintenance a portion of the access chan- nel - some 300' long by 50' wide - to a depth of -62' MLW. This will generate some 3500 cu.vds. of muddy sand which will be pumped to a highground disposal site. The land between the disposal site and the sound is higher in elevation than the bottom of the spoil area. Therefore, the contractor will create a ditch and secondary clarification pond Ito transport the 4rffluent discharge by gravity to the sound. This project involves no coastal wetlands. Anticipated impacts Maintenance dredging in the access channel will displace those bottom dwelling organisms in the immediate area. However, these forms of marine life can be ex- pected to'repopulate the area eventually based on the adjusted water depth and the amount of boat traffic throughout the year. The spoil disposal site and re- turn water system should be monitored during the course of the operation to en- sure water quality standards. CAMA Review The review of the dredge and fill permit is considered to be sufficient for the purposes of evaluating permit under CAMA guidelines. Conditions are applicable to both permits. The Association wants to dredge the Gull Harbor Marina Channel and needs land to distribute the spoils. John Eubanks agrees to allow the dredge Dine to pass over approx- imately 200 feet of an established lawn portion of hos land. He also agrees to allow a drainage ditch to be dug on this portion of his land. John Eubanks also agrees to allow the spoils of this dredging opera- tion to be distributed on a low portion of his land that starts just to the North of the previously mentioned established lawn. In return, the ,Association agrees to restore the established lawn portion of the Eubanks property by filling and Dacking the trench and replacing all damaged grass with turfed centipede grass. if the turfed centipede grass is not obtainable after diligent search to obtain it, an equivalent southern turfed grass is acceptable. Restoring the grass by seed is not acceptable. The result of filli_n of the low land portion of the Eubanks property will be that the resulting land is higher than the land of adjacent property owners. The Association will see that the dikes used to hold this land, both by their construction and by addition of supporting vegatation, if necessary, will be r_esponsirle for satisfying any litigation initiated by anyone due to damage caused by this dredging operation and any subsequent erosion. The proposed chrnn::l (approximately 60' wide by 5' sleep by 1100' long) would begin at the 5' depth contour in Ucjiie Sound about 6001 offr•hore and long the ere -It cltn.nnol from 400-500' inl.,nrid. Ulie creels channel is bordered by 20' to 50' of Spartina marsh graduating upward into some 20 to 50' of Juncus and herbacious plants and trees. It is proposed that the cl?a.nnel by constructed along the high water mark of the creek drainage area. It is also proposed that n, bullchoad be constructed along the nort1n:,ost enol v�stern edge of the channel. 'ibe bulkileond would then extend to the west along the shore line of Boge Sound for approrlmntely 4001. Title chore line is irregularly shaped and has P. bora..^..r of Sprtrtlna and Juncus r^nn- ing from 5 to 20' trifle, nue to the irregular shore line, the proposed bulkh�le't would extend beyond the marsh.... in some places along the approximate 400' dis- tance.
