This permit is subject to compliance with this application, site
drawing and attached general and specific conditions. Any
violation of these terms may subject the permittee to a fine,
imprisonment or civil action; and may cause the permit to be-
come null and void.
This permit must be on the project site and accessible to the
permit officer when the project is inspected for compliance.
The applicant certifies by signing this permit that 1) this pro-
ject is consistent with the local land use plan and all local
ordinances, and 2) a written statement has been obtained from
adjacent riparian landowners certifying that they have no
objections to the proposed work.

Dear Mr. Pickett:
It was good talking to you this morning for close to 1/2
hour. I appreciate the time spent in discussing the Biddle
dock/piling configuration and the Johnson/Stribling request.
Enclosed find a typed attachment together with sketch
that states the facts and shows graphically what this case is
all about. Also included in the typed portion are the actions
taken by the Fairfield Harbour Waterfront Committee and
represents a fair and equitable resolution of what it will
approve for both Mr. Biddle and Ms. Johnson(StRibling).
Mr. Stribling wants what he's not entitled to. He wants
to force the committee to see things his unreasonable way. We
have bent over backwards in his reguard to present a dock
plan that meets his general needs and then some. Truly
speaking, his size lot is entitled to a 12' wide access at
the entry to his dock. By suggesting that he get Mr.Biddle's
permission to use his left outermost tie pole we have widened
his access to 141.
The exercise that Mr. Stribling has put us to will not
guarantee that the above dock recommendations will be
approved in the future as State and Local rules change with
time. The next committee may not be as tractable. The only
way he can guaranty a specific dock configuration is too
build it now. He has 90 days from permit approval to complete
it.

Re: Dock construction permit application, Mr. Walt Biddle, Fairfield
Harbor.
Dear Sirs:
Mr. Walt Biddle has contacted me as agent for my aunt Nora Johnson, in
regard to his desire to obtain a dock construction permit for lot 311,
Fairfield Harbor. On behalf of my aunt. Nora Johnson,owner of ajoining
lot 310, I have informed Mr. Biddle of her objection to his proposed
dock design.
The objectionable design includes pilings projecting 40 ft. into the
cul-de-sac of the canal. The cul-de-sac has a radius of only 50.96 ft.
per the subdivision plat of record. The pilings would create a perman-
ent obstruction the manuvering of boats and the reasonable free use of
of Public Waters by adjacent property owners. Construction under the
proposed plan would encroach further into public waters than any other
structure on this canal and would violate the intent of the C.A.M.A.
one-third rule of extension into waterways when applied to cul-de-sacs.
Futher, it is my understanding from meetings with the Fairfield Harbor
Property Control Committee that their present guidelines prohibit any
construction beyond 25 ft. from the bulkhead and that the 8 ft. radius
point offset is intended for canal cul-de-sacs having radii of less than
30 feet.
An attempt at compromise with Mr. Biddle was made with negative results.
Mr. Biddle stated that he considered his plans as minimun for his needs
for dockage ofboth his 38ft. sailboat and his 23 ft. power boat. The
outcome of our discussion of this date was his stated intent to proceed
without the consent of Mrs. Johnson.
Therefore, please consider this as a letter of record confirming Mrs.

Johnson's continued objection to the issuance of a permit for Mr. Biddels
dock construction permit for lot 311. A copy of his plan as provided to
us is attached hereto for your reference.
