Schecter, Director March 6, 1996 Alice and Gerry DeBaun 612 Windward Drive Oriental, NC 28571 Dear Mr. and Mrs. DeBaun: NT F This correspondence is in reference to your letter dated January 25, 1996 whereby you stated objections to a proposed dock project by your downstream adjacent riparian property owners, Robert and Carol Seitz. The proposed project is for the construction of a 56' X 8' dock in a manmade canal off Whittaker Creek, adjacent the Seitz's property, on Windward Drive in Oriental, North Carolina. As I understand it, you essentially had two objections: 1) the dock would be used for commercial purposes and 2) navigability within the canal may be negatively affected. The Division of Coastal Management has considered your objections and has found that the project as proposed is consistent with the appropriate rules and regulations of the Division. But specifically addressing your objections, the applicants have assured me that the project is for private, non-commercial uses only. Also, the Division has determined that the limited encroachment of the 8'-wide dock into the canal would not adversely affect navigability of the canal. Consequently, the Division of Coastal Management has issued a permit dated February 29, 1996, to the Seitz's for the proposed dock. If you wish to appeal this permit decision, you may file a request with the Director of the Division of Coastal Management, Department of Environment, Health, and Natural Resources. Yesterday I attempted to contact your office by phone and did leave a message on a machine. I do have objections to the proposed project. My phone call yesterday was to inquire about just what would be valid objections. Because I am under a time constraint to reply to the attached letter I will list the objections as I see them. The proposal calls for a dock in two sections, one 24 ft in length and the other 32 ft in length. At the present time the property owners do not own any boat other than a small outboard. I therefore conclude that the longer section of the dock will be used for rental purposes and herein lies my objection, the fact that the property will be used for commercial use. I could also point out that 54 ft of dockage is rather large for a small piece of property and a small home. Whether or not an 8 It dock and a boat with perhaps a 12 ft beam will crowd the navigable portion of the creek remains to be seen.
