This permit is subject to compliance with this application, site
drawing and attached general and specific conditions. Any
violation of these terms may subject the permittee to a fine,
imprisonment or civil action; and may cause the permit to be-
come null and void.
This permit must be on the project site and accessible to the
permit officer when the project is inspected for compliance.
The applicant certifies by signing this permit that 1) this pro-
ject is consistent with the local land use plan and all local
ordinances, and 2) a written statement has been obtained from
adjacent riparian landowners certifying that they have no
objections to the proposed work.

This letter concerns your October 11, 1995 CAMA Major Permit
Application. As we have discussed on the above date, you have
modified your request to stabilize the remaining shoreline on your lot in
Currituck County at Egret Lane. This modifications includes a proposal
to construct a dock and wooden breakwater along your shoreline instead
of a backfilled bulkhead or rip -rap structure.
As we discussed, construction of a wooden breakwater may be
authorized through a CAMA General Permit 07H .2100 instead of a
CAMA Major Permit. In regard to your modified proposal, I have
enclosed the following :
1] Your original application for a Major CAMA Permit ;
21 07H. 2100, Rules concerning the General Permit for
construction of marsh enhancement breakwaters for
shoreline protection in Estuarine and Public Trust Waters;
31 Two copies of an adjacent riparian property owner
signoff/notification form letter.

As we have discussed, you will need to fulfill the following before
a general permit can be issued for this proposed breakwater and dock
work.
a) If you wish to place the pier, dock or breakwater within
the 15 ft. setback, you will need to re -notify adjacent
property owner, J.P. Crank to request a waver to
encroach within the 15 ft. riparian setback and present
this signed statement stating no objection to this
encroachment. You should attach a diagram or sketch
which depicts the proposed breakwater and dock in
relation to the property line with your re -notification and
waver request to Mr. Crank ;
b) Provide a fifty dollar ($50.00) filing fee in the form of
a check or money order payable to the Department of
Environment, Health and Natural Resources ;
Once these requirements are completed, please contact my office
so that we may set up an appointmtnt to issue you a CAMA General
Permit to construct the requested dock and breakwater.
I have also requested that your CAMA Major Permit Application
filing fee check for $250.00 be refunded to you by our accounting section.

The Division of Coastal Management hereby acknowledges receipt
of your application for State permits to develop your property at Egret
Lane, Currituck County. We have been coordinating our initial permit
review with the Army Corps of Engineers and have found that your
application lacks information necessary to consider it complete under
Coastal Management regulations. In order to have a complete application
necessary for us to begin processing, you should submit the following
items:
[1] A site location map;
[2] Certified Mail guarantee return receipt cards or copies of
them need to also be submitted with your application;
[3] If your proposed project will include bulkhead construction
and dredging, the adjacent riparian property owners will
need to be notified of all this proposed work. The copy of
the signed September 4, 1995 notification did not indicate
bulkhead construction or dredging as part of this proposed
work. Only pier and breakwater construction are indicated
in this correspondence;

[4] Additional plat work which shows cross -sectional views of
your breakwater structure and canal excavation/dredging
will also need to be submitted. Your application should also
indicate how the dredge spoil will be removed from the
canal and where the dredge spoil will be temporarily placed
to de -water. Your application should address dredge spoil
erosion control and grading if the spoil will be used within
the Estuarine Shoreline of the Currituck Sound or it's
tributaries ;
[5] Each plat submitted, including those already received must
be signed and dated by the applicant.
Since your current application is incomplete at this time, your
application will be placed 'on hold' until the above information can be
submitted. If these requirements are unclear to you or should you have
additional questions concerning this application, please fell free to
contact me at my office in Elizabeth City (264-3901).
Once we have received this additional information, you will be
notified of acceptance of your application as complete, or if further
clarification of your request is required.
