SECRETARY This letter confirms our meeting of March 19, 1999 onsite property at Pine Knoll
Towne II off NC 58, adjacent to the Atlantic Ocean, in Pine Knoll Shores, Carteret
County. The purpose of my site visit was to address the extent of damage to the
existing sandbags which protect the townhomes.

DIRECTOR From my site inspection, it appears that the latest storm has caused some damage to
the existing sandbags. As you recall, these sandbags were permitted as temporary
erosion control structures and may remain in place for up to five years after the
permitted date of October 9, 1996. Our rules do allow for existing sandbag
structures to be maintained provided that the permitted dimensions are not exceeded.
Based on General Permit #016917-C, approximately 220' of sandbags were installed
along the erosion escarpment in front of the townhomes. Therefore, as long as the
sandbags are tan in color and the base of the structure does not exceed 20' and the
height does not exceed six feet, you are hereby authorized to repair the sandbag
structure, which may include replacing damaged bags.
However, I would like to meet with you and your contractor onsite once you have
chosen one to explain the limits of this repair work. Since expansion of the structure
is prohibited, such a visit would eliminate any vagueness or difference in
interpretations.
