Box 322 Kitty Hawk, NC 27949 Dear Mr. Towler: EHNR Recently the North Carolina Department Of Transportation (NCDOT) has notified you by letter regarding their intention to construct a shoreline stabilization riprap structure at the SR 1208 creek crossing adjacent to your property at the man made canal near Jean Guite Creek. The purpose for this work is to stabilize and protect the existing road structure. Currently the normal water level is within 5 feet of the asphalt portion of the road structure. I have received your August 19, 1996 comments concerning NCDOT's request. In your comments, you have noted that you do object to this project as proposed but do not object to the shoreline's stabilization using conventional bulkhead. Although, I do sympathize with your "bulkhead versus riprap" rational, the typical approach to stabilize such a shoreline as the one discussed here is by using concrete or stone riprap. Although the lawn cutting maintenance may be somewhat more convenient with a conventional bulkhead, it has been found in this type of application, that rock riprap structures offer a more effective approach both through effectiveness and cost than a typical wooden bulkhead. The subject project, as proposed, meets all the Coastal Resources Commission Rules concerning shoreline stabilization structures. Since the normal water level has moved within 5 feet of the asphalt roadway, the proposed work also conforms with the conditions necessary for the issuance of an emergency general permit. In this regard, on August 27, 196, over your objection, I issued the NCDOT an Emergency General Permit (Permit No. 017301A) concerning this project. Such a request must be officially received at the Raleigh CAMA Headquarters Office within 20 days of this permit issuance. Requests are reviewed by the chairman of the Coastal Resources Commission to determine whether a hearing should be granted. This determination is the sole discretion of the chairman. In this regard, I have enclosed a copy of the request for appeal forms in the event you should wish to request an appeal. We appreciate your comments concerning this project.
