Dear Mr. and Mrs. Campbell:
This correspondence is in reference to your letter dated February 18, 1996 whereby you stated
objections to a proposed pier project by your adjacent riparian property owner. Curt Klingmann.
It also serves as a follow up to our telephone conversation of last week. The property in question is
located off SR 1317, in Orchard Creek Estates, lot # 21, adjacent Orchard Creek, near the Town of
Oriental, in Pamlico County, North Carolina. The proposed project is for the construction of a 64' long
X 5' wide pier with a 24' X 8' "L-shaped" platform and two associated mooring pilings.
Although you have requested that the mooring pilings be located 20' from the common riparian
line, our regulations only state that "piers, docks and boathouses, shall not interfere with the access to
any riparian property, and shall have a minimum setback of 15' between any part of the pier and the
adjacent property lines extended into the water at the points that they intersect the shoreline" (see the
attached 7H.1200 regulation for piers and docks). Our rules do not prevent an individual from locating
any part of his dock within his own riparian area if the 15' minimum setback is met. The Division of
Coastal Management has considered your objections and has found that the project as proposed is
consistent with the appropriate rules and regulations for piers and docks. And as a field representative
for the Division of Coastal Management, I have determined the riparian lines and subsequently issued a
permit dated February 29, 1996, to Mr. Klingman for the proposed dock and mooring pilings.
If you wish to appeal this permit decision, you have 20 days to file a request with the Director
of the Division of Coastal Management, Department of Environment, Health, and Natural Resources.

Thank you for meeting with Fran Law on the matter of the proposed dock on Lot #21 in Section One of
Orchard Creek Estates in the Township of Pamlico County. The current proposal calls for building the
dock at least fifteen feet from the riparian rights line you will set. This is not acceptable.
We expect Broad Creek Construction Company to build the dock so that the tie -off poles are twenty feet
from the riparian rights line as we originally stipulated in our letter of January 16. An extract of that
letter follows:
We would prefer that the dock on lot #21 be centered on the property, and that no part on
land be closer than 35 feet from the property line between lots #20 and #21. Further that the
piles pictured in the sketch provided be no closer than twenty feet from a line extended into
the water from the shared property line.
We will withdraw our objection if the Klingmann family and Fran Law abide by the above mentioned
conditions.

Dear Mr. Campbell:
I have met with Mr. Ted Tyndall from Coastal Management on your lot
to discuss your complaints.
He has asked that I do another drawing showing that the Klingmann's
dock including the tie -off poles will be at least 15' from your ripar-
ian rights line. This line will be set by Mr. Tyndall.
The North Carolina Coastal Management Act gives land owners the right to
request that adjacent land owners keep all structures 15' from the
riparian rights line. This will be observed.
