This permit is subject to compliance with this application, site
drawing and attached general and specific conditions. Any
violation of these terms may subject the permittee to a fine,
imprisonment or civil action; and may cause the permit to be-
come null and void.
This permit must be on the project site and accessible to the
permit officer when the project is inspected for compliance.
The applicant certifies by signing this permit that 1) this pro-
ject is consistent with the local land use plan and all local
ordinances, and 2) a written statement has been obtained from
adjacent riparian landowners certifying that they have no
objections to the proposed work.

Dear Ms. Curtis:
This correspondence is in reference to your letter whereby you stated objections to a
proposed pier project by your adjacent riparian property owners, Mr. and Mrs. E. A. Guthrie.
The proposed project is for the construction of a 195' long by 4' wide pier with a 4' X 15'
platform. The applicant also proposed a 15' X 25' boathouse attached to the pier adjacent their
property on Queen's Creek near Swansboro, North Carolina.
As I understand it, you essentially objected to the project because the land is part of your
father's estate and has not been closed. However, Mr. Guthrie has provided this office with a
General Warranty Deed in his wife's name for the lot in question (lot #2). Mr. Ted Tyndall,
field representative with the Division of Coastal Management, provided a copy of this document
to our representative with the Environmental Branch of the Attorney General's Office. She
informed Mr. Tyndall that given the information provided, that if the dock proposal was
consistent with the rules adopted by the Coastal Resource Commission, then she saw no reason
not to issue a permit authorizing the structure. At that time, it was determined that the project
proposal was consistent with the Commission's rules. Consequently, the Division of Coastal
Management issued a permit on August 8, 1996 to Mr. and Mrs. Guthrie for the proposed dock.
If you wish to appeal this permit decision, you may file a request with the Director of
the Division of Coastal Management, Department of Environment, Health, and Natural
Resources. If you have any questions regarding this matter, please don't hesitate to contact me
