Prescott, Cathy C. Rivenbark, Henry V. Frazer and J. Cray Winfrey were appointed by the Dolphin Company of Oriental as the Board of. Supervisors for Windward Shores subdivision. (2) In that capacity, the Board of Supervisors unanimously approved an application to construct a pier adjacent to Lot 18 by the then owner, William T. Rango and wife, Marilyn P. Rango. (3) In January, 1996, Mr. and Mrs. Rango conveyed Lot 18 to David C. Grunwaldt and wife, Charlene R. Grunwaldt. In view of the nature of the restrictive covenants of our subdivision, we have indicated on the proposal, NOT an objection, BUT a point that needs clarification. In front of our waterfront property, #17, is an area of approximately 40 feet that has been designated as 'common area' for the subdivision property owners to give them unrestricted access to walk along the bulkheaded area fronting the Neuse River. 'In the past some of this area was reclaimed by the river, but NOT in front of numbers 17 and 18; therefore, the area in front of these properties is still 'common area.' We are concerned that Mr. Charles Rivenbark, the builder, has been misinformed as to the actual meets and bounds of the property. It is our intention to inform the Coastal Management Commission that this 'common area' butts up to the Grunwaldt's property, which does not extend to the shoreline. The drawing of the proposed pier/dock doesn't indicate that common area; it is the 'common area' that butts up to the Neuse River, and is therefore, between lot #18 and the water. According to the subdivision covenants, that area is to be kept free of any debris, shrubbery, fences, etc., therefore, a walkway across that area from the Grunwaldt's property is not permitted. (Please NOTE our explanation on the enclosed copy of the proposal, as was faxed to the Grunwaldts.)
