drawing and attached general and specific conditions. Any
violation of these terms may subject the permittee to a fine,

imprisonment or civil action; and may cause the permit to be-
come null and void.
This permit must be on the project site and accessible to the
permit officer when the project is inspected for compliance.
The applicant certifies by signing this permit that 1) this pro-
ject is consistent with the local land use plan and all local
ordinances, and 2) a written statement has been obtained from
adjacent riparian landowners certifying that they have no
objections to the proposed work.
In issuing this permit the State of North Carolina certifies that
this project is consistent with the North Carolina Coastal
Management Program.

AGREEMENT
This Agreement, made and entered into this theyk day of
April, 1996, by the between Carol Andrews Franklin, j. W. Andrews,
III, and Sallie Boren Andrews hereinafter sometimes referred to as
the "Andrews", and Jeannette Fair Frazier and Clifford Frazier,
Jr., hereinafter sometimes referred to as. the "Fraziers".
WHEREAS, the Andrews and Fraziers own adjoining property at
Long Beach, North Carolina:
(a) The Andrews are the owners of Lots 4 and. 5 of Block 130,
Kings Lynn, a plat of which is recorded in Book 3, at Page 113, in
:he Office. of the Register of Deeds of Brunswick County, North
'�arolina; and
(b) The Fraziers are the owners of all of Let 3 and the
western 10' of Lot 2 of Block 130, Kings Lynn, as per plat recorded
.Ln Book 3, at Page 133, in the Of;ice of the Register of Deeds of
1runswick Countv, North Carolina, said property, having been
conveyed to the Fraziers by deed retarded in Book: 9 3 , beginning at
Page 6 (CON 233N--GRB-FCL15 Febrijary 24, 19v2), cf the Brunswick
,:aunty Registry; and
WHEREAS, a number of years ago the Fraziers, with the
]permission of the Andreas, attached to the Andrews' fixed pier a
walkway ramp and floating dock and accessories; and the floating
Clock and accessories have, from ti-e to tire, bee-_ moved, repaired
,: nd rebuilt for various reasons; the floatin T doc;. and accessories

lie partially within the Andrews riparian rights area with the
balance being within the Fraziers riparian rights area; and
WHEREAS, the Andrews and the Fraziers, and their immediate
Family and guests, have used the fixed pier and floating dock and
accessories, with t hie Fraziers' imnetdiatEe family and guests, have
'lad the right of ingress, egress, and regress over the Andrews'
,;?roperty to and from the facilities; and
NOW, THEREFORE, for and in consideration of these presents and
)ther good and valuable consideration, the part:.es agree as
Follows:
I. The Andrews do hereby agree:
(a) The Fraziers, at their cost, naay remove the steps,
;platform ramp, and floating dock from its present location and
attach them to the fixed pier at a position wes11wardly from the
present location, which will place the pier, floating dock,
platform and steps thereto ("pier facilities") ',�ithin the ,Andrews'
:.,iparian rights area; and
(b) The Fraziers, at their cost, are granted the right to
(:onstruct a walkway frog the ems tern side of t _e Andrews' fixed
pier to such boat lift facility as the Fraziers may construct
within their riparian rights area.
(c) The Andrews and Fraziers, respectively, do hereby waive
the requirement that a pier, dock, -mooring, piling, break water,
boat house, Iif t or sand bags must be setback a ,.;inimum distance of
:..5' (15-foot setback requirement) fzor, their r-spective areas of
:setback access.

2. The parties agree that the Andreas and the Fraziers and
their respective immediate farizlies and friends, shall have the
joint use of the fixed pier, floating pier and accessories ("pier
facilities"), and the Andrews do here-, grant to the Fraziers the
right of ingress, egress and rearess, over thee- property for
access to and From the pier facilities.
3. The parties herebyagree that either �. .her may terminate this
Agreement upon 12 months written notice to the other. If either
party exercises this right to terminate this Agreement, the
Fraziers shall have the right and optzof7 to;
(a) Sell the floating dock and ramp to the Andrews at such
Price as might be agreed upon; or
(b) Remove at their cost the floating deck and ramp, and
relocate them within the Fraziers riparian rights area; or
(c) Leave the floating dock and ramp as then positioned and
the Fraziers shall remove at their cost any walkway from the pier
to their boat lift facility.
This Agreement shall enure tc the benefit of the parties
hereto, their heirs and assigns.
