This permit must be on the project site and accessible to the permit officer when the project is inspected for compliance. The
applicant certifies by signing this permit that 1) prior to undertaking any activities authorized by this permit, the applicant will
confer with appropriate local authorities to confirm that this project is consistent with the local land use plan and all local
ordinances, and 2) a written statement or certified mail return receipt has been obtained from the adjacent riparian
landowner(s) .

In accordance with your application received September 12, 2008, we are forwarding herewith Permit
No. WQ0033438, dated October 17, 2008, to Town of Beaufort for the construction and operation upon
certification of the subject wastewater collection system extension. This permit shall be effective from
the date of issuance until rescinded and shall be subject to the conditions and limitations as specified
therein. This cover letter shall be considered a part of this permit and is therefore incorporated therein
by reference.
Please note the following standard conditions that are contained in this permit.
Condition 3: Requires that the wastewater collection facilities be properly operated and
maintained in accordance with 15A NCAC 2T.0403 or any individual system -wide
collection system permit issued to the Permittee.
Condition 6: Requires that the system be properly certified upon completion of construction
and prior to being placed into operation.
Condition 7: Regarding the installation of gravity sewer at greater than ten percent below the
minimum required slope per the Division's Gravity Sewer Minimum Design Criteria
shall not be acceptable and shall not be certified until corrected.
Condition 12: Regarding Division notification should the system fail to operate including the loss
of wastewater from the collection system. In addition, note Permit Condition 13
regarding the posting of pump stations with emergency contact information.

Permitting of this project does not constitute an acceptance of any part of the project that does not
meet 15A NCAC 2T; the Division of Water Quality's (Division) Gravity Sewer Minimum Design Criteria
adopted February 12, 1996 as applicable; and the Division's Minimum Design Criteria for the Fast -Track
Permitting of Pump Stations and Force Mains adopted June 1, 2000 as applicable, unless specifically
mentioned herein. Division approval is based on acceptance of the certification provided by the North
Carolina -licensed Professional Engineer named in the application.
It shall be Town of Beaufort's responsibility to ensure that the as -constructed project
meets the appropriate design criteria and rules. Failure to comply may result in penalties
in accordance with North Carolina General Statute §143-215.6A through §143-215.6C,
construction of additional or replacement wastewater collection facilities, and/or referral
of the North Carolina -licensed Professional Engineer to the licensing board.
A stormwater management plan shall be submitted to and approved by the Wilmington Regional
Office in accordance with 15A NCAC 2H .1000.
If any parts, requirements, or limitations contained in this permit are unacceptable, you have the right to
request an adjudicatory hearing upon written request within 30 days following receipt of this permit. This
request must be in the form of a written petition, conforming to Chapter 150B of North Carolina General
Statutes, and filed with the Office of Administrative Hearings, 6714 Mail Service Center, Raleigh, NC
27699-6714. Unless such demands are made, this permit shall be final and binding.

In accordance with the provisions of Article 21 of Chapter 143, General Statutes of North Carolina as
amended, other applicable Laws, Rules, and Regulations, and in conformity with 15A NCAC 2T; the
Division's Gravity Sewer Minimum Design Criteria adopted February 12, 1996 and Minimum Design
Criteria for the Fast -Track Permitting of Pump Stations and Force Mains adopted June 1, 2000 as
applicable; and other supporting data subsequently filed and approved by the Department of
Environment and Natural Resources and considered a part of this permit;
PERMISSION IS HEREBY GRANTED TO:
Town of Beaufort
CARTERET COUNTY
For the construction and operation upon certification of approximately 10,300 linear feet of 12 -inch
Force Main, 7,000 Linear feet of 16 -inch Force Main and 6,200 linear feet of 18 -inch Force Main to serve
as sewer upgrading as part of the US 70 Force Main Improvement project, with no additional flow
allocation of wastewater into Town of Beaufort's existing sewerage system, pursuant to the application
received September 12, 2008.
The sewage and wastewater collected by this system shall be treated in the Town of Beaufort
Wastewater Treatment Facility (Permit No. NC0021831) prior to being discharged into the receiving
stream.
This permit shall be effective from the date of issuance until rescinded and shall be subject to the
following specified conditions and limitations:
This permit shall become voidable unless the wastewater collection facilities are constructed in
accordance with the conditions of this permit; 15A NCAC 2T; the Division of Water Quality's
(Division) Gravity Sewer Minimum Design Criteria adopted February 12, 1996 as applicable; the
Division's Minimum Design Criteria for the Fast -Track Permitting of Pump Stations and Force Mains
adopted June 1, 2000 as applicable; and other supporting materials unless specifically mentioned
herein.
2. This permit shall be effective only with respect to the nature and volume of wastes described in the
application and other supporting data.
3. The wastewater collection facilities shall be properly maintained and operated at all times. The
Permittee shall maintain compliance with an individual system -wide collection system permit for the
operation and maintenance of these facilities as required by 15A NCAC 2T .0403. If an individual
permit is not required, the following performance criteria shall be met as provided in 15A NCAC 2T
.0403:
a. The sewer system shall be effectively maintained and operated at all times to prevent
discharge to land or surface waters, and any contravention of the groundwater standards in
15A NCAC 2L.0200 or the surface water standards in 15A NCAC 2B .0200.
b. A map of the sewer system shall be developed and shall be actively maintained.

c. An operation an, naintenance plan including pum, Cation inspection frequency,
preventative maintenance schedule, spare parts inventory, and overflow response shall be
developed and implemented.
d. Pump stations that are not connected to a telemetry system (i.e. remote alarm system) shall
be inspected by the Permittee or its representative every day (i.e. 365 days per year). Pump
stations that are connected to a telemetry system shall be inspected at least once per week.
e. High-priority sewer lines shall be inspected by the Permittee or its representative at least once
per every six-month period of time.
A general observation of the entire sewer system shall be conducted by the Permittee or its
representative at least once per year.
g. Overflows and bypasses. shall be reported to. the appropriate Division regional office in
accordance with 15A NCAC 2B .0506(a), and public notice shall be provided as required by
North Carolina General Statute § 143-215.1 C.
h. A Grease Control Plan shall be implemented as follows:
1. For publicly owned collection systems, the Program shall include at least bi-annual
distribution of educational materials for both commercial and residential users and the
legal means to require grease interceptors for new construction and retrofit, if necessary, of
grease interceptors at existing establishments. The Program shall also include legal means
for inspections of the grease interceptors, enforcement for violators, and the legal means
to control grease entering the system from other public or private satellite sewer systems.
2. For privately owned collection systems, the Program shall include at least bi-annual
distribution of educational materials to all users of the collection system by the Permittee or
its representative.
3. Grease education materials shall be distributed more often than required in Parts 1 or 2 of
this sub -paragraph if necessary to prevent grease -related sanitary sewer overflows.
Right-of-ways and easements shall be maintained in the full easement width for personnel and
equipment accessibility.
Documentation shall be kept on file for Sections (a.) through (i.) of this rule for a minimum of
three (3) years with the exception of the map, which shall be maintained for the life of the
system.
4. This permit shall not be transferable. In the event there is a desire for the wastewater collection
facilities to change ownership, or there is a name change of the Permittee, a formal permit request
shall be submitted to the Division accompanied by documentation from the parties involved, and
other supporting materials as may be appropriate. The approval of this request shall be considered
on its merits and may or may not be approved.
Construction of the gravity sewers, pump stations, and force mains shall be scheduled so as not to
interrupt service by the existing utilities nor result in an overflow or bypass discharge of wastewater
to the surface waters of the State.
6. Per 15A NCAC 2T .01 16, upon completion of construction and prior to operation of these permitted
facilities, the completed Engineering Certification form attached to this permit shall be submitted
with the required supporting documents (as -built or recording drawings and pump station designs, if
applicable) to the address provided on the form. A complete certification is one where the form is
fully executed and the supporting documents are provided as applicable. Any wastewater flow
made tributary to the wastewater collection system extension prior to completion of this Engineer's
Certification shall be considered a violation of the permit and shall subject the Permittee to
appropriate enforcement actions.
If the permit is issued to a private entity with an Operational Agreement, then a copy of the Articles
of Incorporation, Declarations, and Bylaws that have been appropriately filed with the applicable
County's Register of Deeds office shall be submitted with the certification.

force mains) of the wastewater collection system extension. Record drawings are defined as
the design drawings that are marked up or annotated with after construction information and
show required buffers, separation distances, material changes, etc.
b. One copy of the supporting pump station design calculations (selected pumps, system curve,
operating point, buoyancy calculations, available storage if portable generator(s) or storage
greater than longest past three year outage reliability option selected) for any pump stations
permitted as part of this project.

C. Changes to the project that do not result in non-compliance with this permit, regulations, or
the Minimum Design Criteria should be clearly identified on the record drawings, on the
certification in the space provided, or in written summary form. .i
Prior to Certification (Final or Partial): Permit modifications are required for any changes resulting in
non-compliance with this permit (including pipe length increases of 10% or greater, increased flow,
pump station design capacity design increases of 5% or greater, and increases in the number/type
of connections), regulations, or the Minimum Design Criteria. Requested modifications or variances
to the Minimum Design Criteria will be reviewed on a case-by-case basis and each on its own merit.
Please note that variances to the Minimum Design Criteria should be requested and approved
during the permitting process prior to construction. After -construction requests are discouraged by
the Division and may not be approved, thus requiring replacement or repair prior to certification &
activation.
7. Gravity sewers installed greater than ten percent below the minimum required slope per the
Division's Gravity Sewer Minimum Design Criteria shall not be acceptable and shall not be certified
until corrected. If there is an unforeseen obstacle in the field where all viable solutions have been
examined, a slope variance can be requested from the Division with firm supporting
documentation. This shall be done through a permit modification with fee. Such variance requests
will be evaluated on a case-by-case basis. Resolution of such request shall be evident prior to
completing and submitting the construction certification.
8. A copy of the construction record drawings and pump station designs, if applicable, shall be
maintained on file by the Permittee for the life of the wastewater collection facilities.
9. Failure to abide by the conditions and limitations contained in this permit; 15A NCAC 2T; the
Division's Gravity Sewer Design Criteria adopted February 12, 1996 as applicable; the Division's
Minimum Design Criteria for the Fast -Track Permitting of Pump Station and Force Mains adopted
June 1, 2000 as applicable; and other supporting materials may subject the Permittee to an
enforcement action by the Division, in accordance with North Carolina General Statutes §143-
215.6A through § 143-215.6C.
10. In the event that the wastewater collection facilities fail to perform satisfactorily, including the
creation of nuisance conditions, the Permittee shall take immediate corrective action, including
those as may be required by this Division, such as the construction of additional or replacement
facilities.
11. The issuance of this permit shall not exempt the Permittee from complying with any and all statutes,
rules, regulations, or ordinances that may be imposed by other government agencies (local, state
and federal) which have jurisdiction, including but not limited to applicable river buffer rules in 15A
NCAC 2B .0200, erosion and sedimentation control requirements in 15A NCAC Ch. 4 and under the
Division's General Permit NCGO10000, and any requirements pertaining to wetlands under 15A
NCAC 213.0200 and 15A NCAC 2H.0500.

12. NON-COMPLIANCE NOTIFI ION:
The Permittee shall verbally report to a Division of Water Quality staff member at the Wilmington
Regional Office, telephone number [phone], as soon as possible, but in no case more than
24 hours or on the next working day, following the occurrence or first knowledge of the occurrence
of either of the following:
a. Any failure, due to known or unknown reasons, that renders the system incapable of
adequate wastewater transport, such as mechanical or electrical failures of pumps, line
blockage or breakage, etc.; or
b. Any failure of a pumping station or sewer line resulting in a by-pass of any wastewater directly
to receiving waters from the station or sewer line.
Voice mail messages or faxed information is permissible, but shall NOT be considered as the initial
verbal report. Overflows and spills occurring outside normal business hours may also be reported to
the Division of Emergency Management at telephone number [phone] or [phone].
Persons reporting any of the above occurrences shall file a spill report by completing Part I of Form
CS-SSO (or the most current Division approved form), within five days following first knowledge of
the occurrence. This report shall outline the actions taken or proposed to ensure that the problem
does not recur. Part 11 of Form CS-SSO (or the most current Division approved form) can also be
completed to show that the SSO was beyond control.
13. Each pump station including simplex stations shall be clearly and conspicuously posted with the
telephone number and name of the owner/operator of the sewer system and instructions to call
the number in the event of alarm activation.

undertaken, as is required by Title 15A NCAC 4B.0029.
2. The developer is responsible for the control of sediment on-site. If the approved erosion and sedimentation control
measures prove insufficient, the developer must take those additional steps necessary to stop sediment from leaving
this site. Each sediment storage device must be inspected after each storm event. Maintenance and/or clean out is
necessary anytime the device is at 50% capacity.
3. Any and all existing ditches on this project site are assumed to be left undisturbed by the proposed development
unless otherwise noted. The removal of vegetation within any existing ditch or channel is prohibited unless the ditch
or channel is to be regarded with side slopes of 2 horizontal to 1 vertical or less steep. Bank slopes may be mowed,
but stripping of vegetation is considered new earth work and is subject to the same erosion control requirements as
new ditches.
4. The developer is responsible for obtaining any and all permits and approvals necessary for the development of this
project prior to the commencement of this land disturbing activity. This could include agencies such as the Division
of Water Quality's stormwater regulations, their enforcement requirements within Section 401 of the Clean Water
Act, the U.S. Army Corps of Engineers' jurisdiction of Section 404 of the Clean Water Act, the Division of Coastal
Management's CAMA requirements, the Division of Solid Waste Management's landfill regulations, the
Environmental Protection Agency and/or The U.S. Army Corps of Engineers jurisdiction of the Clean Water Act,
local County or Municipalities' ordinances, or others that may be required. This approval cannot supersede any other
permit or approval; however, in the case of a Cease and Desist Order from the Corps of Engineers, that Order would
only apply to wetland areas. All highland would still have to be in compliance with the N.C. Sedimentation Pollution
Control Act.
If any area on site falls within the jurisdiction of Section 401 or 404 of the Clean Water Act, the developer is
responsible for compliance with the requirements of the Division of Water Quality, the Corps of Engineers and the
Environmental Protection Agency (EPA) respectively. Any erosion control measures that fall within jurisdictional
wetland areas must be approved by the aforementioned agencies prior to installation. The Land Quality Section must
be notified of a relocation of the measures in question to the transition point between the wetlands and the uplands to
assure that the migration of sediment will not occur. If that relocation presents a problem or contradicts any
requirements of either DWQ, the Corps, or the EPA, it is the responsibility of the developer to inform the Land
Quality Section regional office so that an adequate contingency plan can be made to assure sufficient erosion control
remains on site. Failure to do so will be considered a violation of this approval.
Any borrow material brought onto this site must be from a legally operated mine or other approved source. Any soil
waste that leaves this site can be transported to a permitted mine or separately permitted construction sites without
additional permits. Disposal at any other location would have to be included as a permit revision for this approval.
7. This permit allows for a land disturbance, as called for on the application plan, not to exceed six (6) acres. Exceeding
that acreage will be a violation of this permit and would require a revised plan and additional application fee. As
proposed, the land disturbance width of the utility line should not exceed an average of ten (10) feet.
8. The North Carolina Sedimentation Pollution Control Act mandates a shortened time frame in which to re-establish
vegetative groundcover. Slopes (including cuts, fills, and ditch banks) left exposed will, within 21 calendar days after
completion of any phase of grading, be planted or otherwise provided with groundcover sufficient to permanently
restrain erosion.

The Wilmington Regional Office received a copy of your Erosion Control Plan for the subject utility
project. Staff of the Wilmington Regional Office has reviewed your application for the applicability of the
Stormwater Management rules to this project. Based on our review, you do not appear to be proposing
development activities on this site at this point in time that would be subject to the stormwater
requirements as provided for in 15A NCAC 2H.1000. However, be advised that other regulations will
potentially apply to your proposed activities.
In accordance with 15A NCAC 28.0231 and Division policy, new or continued ditching activities after
March 1, 1999, may be a violation of state wetland standards. Violation of these standards may result in
the assessment of civil penalties and other requirements to bring the project into compliance without
additional wetlands impacts. In addition to the wetland standards, if your project disturbs one acre or
more and has a point source discharge of stormwater runoff, then it is also subject to the National
Pollutant Discharge Elimination System (NPDES) stormwater discharge requirements. You are required
to have an NPDES permit for stormwater discharge from projects meeting these criteria.
If at any time in the future, development of any part of this site is planned, as defined in NCAC
2H.1000, or you do not develop the project in the manner indicated in the application, you must apply

Attached hereto, for your files, is a copy of the Right of Way Encroachment Contract, which has
been properly executed. The contract covers the following:
1030OLF of 12" force main, 7000LF of 6" force main, and 620OLF 18" sewer force main
along US 70, SR 1304, and SR 1412 in Beaufort, Carteret County.
General Requirements:
1) The encroaching party shall notify the District Engineer's office [[phone]] prior
to beginning construction and upon completion of construction.
2) The encroaching party is required to contact the appropriate Utility Companies involved
and make satisfactory arrangements to adjust the utilities in conflict with the proposed
work prior to beginning construction.
3) Trenching, bore pits and/or other excavations shall not be left open or unsafe overnight.
The Contractor shall comply with all OSHA requirements and provide a competent
person on site to supervise excavation at all times.
4) All fill areas backfill shall be compacted to 95% density in accordance with AASHTO
T99 as modified by the NCDOT. All material to a depth of 8 inches below the finished
surface of the subgrade shall be compacted to a density equal to 100% of that obtained by
compacting a sample of the material in accordance with AASHTO T99 as modified by
the Department. The Contractor shall dry or add moisture to the subgrade when required
to provide a uniformly compacted and acceptable subgrade. All material placed in a
maximum of 6" lifts.
5) All earth areas disturbed shall be graded, dressed, seeded, mulched, and tacked with
liquid asphalt or other approved means within 10 days of completion of work in any area.
6) All workmanship and materials shall conform to North Carolina Department of
Transportation Standards and Specifications manual.

7) The encroaching party shall comply with all applicable federal, state and local
environmental regulations, and shall obtain all necessary federal, state and local
environmental permits, including but not limited to, those related to sediment control,
storm water, wetland, streams, endangered species and historical sites.
8) All existing structures, drainage or otherwise, located inside the bight of Way that are
affected by this work shall be restored to meet the NCDOT Standards and Specifications
as directed by the District Engineer.
9) Minimum two feet clearance required for utility installations beneath crossline
pipes. Crossline pipe shall be removed to allow for proper installation of utility. If
crossline pipe is damaged it shall be replaced with new pipe. The utility shall be
encased if the clearance is less than four feet.
10) Minimum of two feet clearance below the stream bed or flowline of crossline is
required where the utility is located around the end of the crossline. The utility
shall be encased for a minimum distance of ten feet on each side of the centerline of
the stream. The utility cannot be located closer than five feet from the end of
crossline pipe.
11) Any pavement or drainage structure disturbed or damaged shall be restored to original or
better condition as directed by the District Engineer
12) All concrete and asphalt driveways within NCDOT right of way shall be crossed by
dry bore methods. Proper Traffic Control; Devices, Signs, etc., Shall be Installed to
Insure Public Safety.
13) The party of the second part agrees to provide traffic control devices, lane closures,
road closures, positive protection and/or any other warning or positive protection
devices necessary for the safety of motorists and workers during construction and
any subsequent maintenance. This shall be preformed in conformance with the
latest NCDOT Roadway Standard Drawings and Standard Specifications for the
Roads and Structures and Amendments or Supplements thereto. When there is no
guidance provided in the Roadway Standard Drawings or Specifications, comply
with the Manuel on Uniform Traffic Control Devices for Streets and Highways and
Amendment or Supplement thereto. Information as to the above rules and
regulations may be obtained from the Division Engineer of the party of the first.
14) The North Carolina Department of Transportation is in the process of developing a
Work Zone Traffic Control Qualification Program that will begin its
implementation in 2009. This program will require qualified and trained Work
Zone Flaggers in every flagging operation (July2009), qualified and trained Work
Zone Traffic Control Installers on every traffic control installation (January 2010),
and qualified and trained Work Zone Traffic Control Supervisors on Significant
Projects (July 2010). It is intended for the program to include anyone working

within the NCDOT right of way including work associated with NCDOT
construction and encroachment agreements as well as all NCDOT operations.
15) Training for this certification will be provided by NCDOT approved training
sources and/or private entities that have been pre -approved to train themselves.

16) During non -working hours, equipment shall be parked as close to right of way lines as
possible and be properly barricaded in order to not have any equipment obstruction
within the Clear Recovery Area.
17) All roadway signs that are removed due to construction shall be reinstalled as soon as
possible, but at least by the end of the same workday.
18) Excavation within 500 feet of a signalized intersection will require notification by
the party of the second part to Steve Hamilton, PE, Division Traffic Engineer at
telephone number [phone]. All traffic signal or detection cables must be
located prior to excavation.
19) Excavation material shall not be placed on pavement. Drainage structures shall not be
blocked with excavation materials.
20) All soils located inside the Right of Nay shall be considered a type "C" soil. All
trenching, shoring and excavation shall follow the OSHA guidelines for this type of soil.
21) All shoulder installation shall remain a minimum of 1 foot distance per 1 foot depth (1:1
slope) from the edge of pavement to the nearest inside wall of excavation.
22) Crossing by bore only no open cuts will be permitted.
23) All roadway crossings that exceed 6" shall be encased.
24) All roadway crossings by dry bore method shall be a minimum of 3 feet below the
elevation of the existing roadway and 2 feet below the existing ditch, which ever is
the deepest.
25) Pipe encasements shall extend from ditch line to ditch line in cut sections, and 5
(five) feet beyond toe of slope in fall sections, and 3 (three) feet behind curb sections.
26) Directional boring using jetting with a Bentonste (or equivalent material) slurry is
approved at a minimum depth of 10 (ten) feet below the roadway surface (15 feet for

controlled access roadways) and 5 (five) feet below any ditch line. Any changes shall be
submitted to the District Engineer for approval prior to construction.
27) All utilities shall be placed in accordance with the manual on Policies and Procedures for
Accommodating Utilities on the Highway Rights of Way.
28) All splice boxes, manholes, and other appurtenances within the NCDOT right of way
shall be located atioutside the right of way line. Manholes and/or vaults shall not be
placed in the ditch line, side slopes of the ditches, or in the pavement.
29) All manholes and/or vaults within NCDOT right of way shall be of pre—approved design.
If any proposed structure is not of a design pre -approved by NCDOT, the encroaching
party shall submit details and design calculations signed and sealed by a State of North
Carolina registered Professional Engineer for approval prior to construction. NCDOT
Design Services may be contacted for an approved design list.
30) Manhole rings and covers, valve covers, and storm drain grates and frames shall be of the
traffic bearing types approved by NCDOT for use within the highway right of way.
31) Proposed traffic -bearing manholes shall be flush mounted and shall be of a NCDOT
approved design for HS -20 loading.
32) Where utility is installed in the Right of Way and are not of ferrous material, a locating
tape shall be installed with the pipeline.

That the installation, operation, and maintenance of the above described facility will be accomplished in accordance with the party of
the first part's latest POLICIES AND PROCEDURES FOR ACCOMMODATING UTILITIES ON HIGHWAY RIGHTS-OF-WAY, and such
revisions and amendments thereto as may be in effect at the date of this agreement. Information as to these policies and procedures
may be obtained from the Division Engineer or State Utility Agent of the party of the first part.
That the said party of the second part binds and obligates himself to install and maintain the encroaching facility in such safe and
proper condition that it will not interfere with or endanger travel upon said highway, nor obstruct nor interfere with the proper maintenance
thereof, to reimburse the party of the first part for the cost incurred for any repairs or maintenance to its roadways and structures
necessary due to the installation and existence of the facilities of the party of the second part, and if at any time the party of the first part
shall require the removal of or changes in the location of the said facilities, that the said party of the second part binds himself, his
successors and assigns, to promptly remove or alter the said facilities, in order to conform to the said requirement, without any cost to the
party of the first part.
That the party of the second part agrees to provide during construction and any subsequent maintenance proper signs, signal lights,
flagmen and other warning devices for the protection of traffic in conformance with the latest Manual on Uniform Traffic Control Devices
for Streets and Highways and Amendments or Supplements thereto. Information as to the above rules and regulations may be obtained
from the Division Engineer of the party of the first part.
That the party of the second part hereby agrees to indemnify and save harmless the party of the first part from all damages and
claims for damage that may arise by reason of the installation and maintenance of this encroachment.
That the party of the second part agrees to restore all areas disturbed during installation and maintenance to the satisfaction of the
Division Engineer of the party of the first part. The party of the second part agrees to exercise every reasonable precaution during
construction and maintenance to prevent eroding of soil; silting or pollution of rivers, streams, lakes, reservoirs, other water
impoundments, ground surfaces or other property; or pollution of the air. There shall be compliance with applicable rules and regulations
of the North Carolina Division of Environmental Management, North Carolina Sedimentation Control Commission, and with ordinances
and regulations of various counties, municipalities and other official agencies relating to pollution prevention and control. When any
installation or maintenance operation disturbs the ground surface and existing ground cover, the party of the second part agrees to
remove and replace the sod or otherwise reestablish the grass cover to meet the satisfaction of the Division Engineer of the party of the
first part.
That the party of the second part agrees to assume the actual cost of any inspection of the work considered to be necessary by the
Division Engineer of the party of the first part.
That the party of the second part agrees to have available at the construction site, at all times during construction, a copy of this
agreement showing evidence of approval by the party of the first part. The party of the first part reserves the right to stop all work unless
evidence of approval can be shown.
Provided the work contained in this agreement is being performed on a completed highway open to traffic; the party of the second part
agrees to give written notice to the Division Engineer of the party of the first part when all work contained herein has been completed.
Unless specifically requested by the party of the first part, written notice of completion of work on highway projects under construction will
not be required.
That in the case of noncompliance with the terms of this agreement by the party of the second part, the party of the first part reserves
the right to stop all work until the facility has been brought into compliance or removed from the right of way at no cost to the party of the
first part.
That it is agreed by both parties that this agreement shall become void if actual construction of the work contemplated herein is not
begun within one (1) year from the date of authorization by the party of the first part unless written waiver is secured by the party of the
second part from the party of the first part.
During the performance of this contract, the second party, for itself, its assignees and successors in interest (hereinafter referred to as
the "contractor"), agrees as follows:
a. Compliance with Regulations: The contractor shall comply with the Regulations relative to nondiscrimination in Federally -
assisted programs of the U. S. Department of Transportation, Title 49, Code of Federal Regulations, Part 21, as they may be
amended from time to time, (hereinafter referred to as the Regulations), which are herein incorporated by reference and
made a part of this contract.
b. Nondiscrimination: The contractor, with regard to the work performed by it during the contract, shall not discriminate on the

grounds of race, color, or national rrigin in the selection and retention of subcontractors, it-'• ding procurements of materials and
leases of equipment. The contrc ,hall not participate either directly or indirectly in the .-amination prohibited by Section 21.5
q)f the Regulations, including emp _,.,lent practices when the contract covers a program st. ,orth in Appendix B of the Regulations.
C. Solicitations for Subcontracts including Procurements of Materials and Equipment: In all solicitations either by competitive bidding
or negotiation made by the contractor for work to be performed under a subcontract, including procurements of materials or leases
of equipment, each potential subcontractor or supplier shall be notified by the contractor of the contractor's obligations under this
contract and the Regulations relative to nondiscrimination on the grounds of race, color, or national origin.
d. Information and Reports: The contractor shall provide all information and reports required by the Regulations, or directives issued
pursuant thereto, and shall permit access to its books, records, accounts, other sources of information, and its facilities as may be
determined by the Department of Transportation or the Federal Highway Administration to be pertinent to ascertain compliance with
such Regulations or directives. Where any information required of a contractor is in the exclusive possession of another who fails
or refuses to furnish this information, the contractor shall so certify to the Department of Transportation, or the Federal Highway
Administration as appropriate, and shall set forth what efforts it has made to obtain the information. s
e. Sanctions for Noncompliance: In the event of the contractor's noncompliance with the nondiscrimination; provisions of this contract,
the Department of Transportation shall impose such contract sanctions as it or the Federal Highway Adriinisttation may determine
to be appropriate, including, but not limited to,
(1) withholding of payments to the contractor under the contract until the contractor complies, and/or
(2) cancellation, termination or suspension of the contract, in whole or in part.
Incorporation of Provisions: The contractor shall include the provisions of paragraphs "a" through "f' in every; subcontract, including
procurements of materials and leases of equipment, unless exempt by the Regulations, or directives issued pursuant thereto. The
contractor shall take such action with respect to any subcontract or procurement as the Department of Transportation or the
Federal Highway Administration may direct as a means of enforcing such provisions including sanctions for noncompliance:
Provided, however, that, in the event a contractor becomes involved in, or is threatened with, litigation with a subcontractor or
supplier as a result of such direction, the contractor may request the Department of Transportation to enter into such. litigation to
protect the interests of the State, and, in addition, the contractor may request the United States to enter into such litigation to
protect the interests of the United States.

When the applicant is a corporation or a municipality, this agreement must have the corporate seal and be attested by the corporation secretary
or by the empowered city official, unless a waiver of corporate seal and attestation by the secretary or by the empowered City official is on file in
the Raleigh office of the Manager of Right of Way. In the space provided in this agreement for execution, the name of the corporation or
municipality shall be typed above the name, and title of all persons signing the agreement should be typed directly below their signature.
When the applicant is not a corporation, then his signature must be witnessed by one person. The address should be included in this
agreement and the names of all persons signing the agreement should be typed directly below their signature.
This agreement must be accompanied, in the form of an attachment, by plans or drawings showing the following applicable information:
1. All roadways and ramps.
2. Right of way lines and.where applicable, the control of access lines.
3. Location of the existing and/or proposed encroachment.
4. Length, size and type of encroachment.
5. Method of installation.
6. Dimensions showing the distance from the encroachment to edge of pavement, shoulders, etc.
7. Location by highway survey station number. If station number cannot be obtained, location should be shown by distance from
some identifiable point, such as a bridge, road, intersection, etc. (To assist in preparation of the encroachment plan, the
Department's roadway plans may be seen at the various Highway Division Offices, or at the Raleigh office.)
8. Drainage structures or bridges if affected by encroachment (show vertical and horizontal dimensions from encroachment to
nearest part of structure).
9. Method of attachment to drainage structures or bridges.
10. Manhole design.
11. On underground utilities, the depth of bury under all traveled lanes, shoulders, ditches, sidewalks, etc.
12. Length, size and type of encasement where required.
13. On underground crossings, notation as to method of crossing - boring and jacking, open cut, etc.
14. Location of vents.
GENERAL REQUIREMENTS
1. Any attachment to a bridge or other drainage structure must be approved by the Head of Structure Design in Raleigh prior to
submission of encroachment agreement to the Division Engineer.
2. All crossings should be as near as possible normal to the centerline of the highway.
3. Minimum vertical clearances of overhead wires and cables above all roadways must conform to clearances set out in the
National Electric Safety Code.
4. Encasements shall extend from ditch line to ditch line in cut sections and 5' beyond toe of slopes in fill sections.
5. All vents should be extended to the right of way line or as otherwise required by the Department.
6. All pipe encasements as to material and strength shall meet the standards and specifications of the Department.
7. Any special provisions or specifications as to the performance of the work or the method of construction that may be required
by the Department must be shown on a separate sheet attached to encroachment agreement provided that such information
cannot be shown on plans or drawings.
8. The Department's Division Engineer should be given notice by the applicant prior to actual starting of installation included in
this agreement.

On Friday September 18, 2009, Ben Williams of our office had an on-site meeting with Brad Connell of the local
CAMA office and Michael Hair to discuss the disturbance associated with the force main installation between
stations 5+00 and 8+50. In this meeting it was determined that land disturbance material had entered the adjacent
water feature along the northern side.
As a result of this meeting the following items must be addressed in a timely manner to avoid CAMA penalties:
1. Remove identified remaining fill material from the western bank of the jurisdictional feature with a hand
rake sufficiently to expose the base of existing vegetation. No mechanical machines are to be used.
2. Remove any remaining fill material below the water line from the water feature by means of hand
equipment.
3. Reinstall existing riprap to original grade on eastern bank of the feature south of the existing US 70
culvert down to the pink pin flag placed on 9/18/09. This should consist of placing the existing stones
to the original grade by hand. The finished grade should be similar to that of the riprap located on the
eastern bank of the feature north of the existing US 70 culvert.
4. Install temporary check dam with riprap size stones within the roadside ditch south of the disturbed area
and reinstalled riprap as discussed in item 3.
5. Remove previously installed temporary check dam located just south of the US 70 culvert by hand.
6. Install silt fence along the top of slope on the western bank from the utility pole to the end of the existing
riprap to prevent any material from entering the water feature.
7. Place matting on the western side of the feature along the bank with matting being two -wide on western
side of the silt fence.
8. Seed all disturbed areas.

SECTION .1600 - GENERAL PERMIT FOR THE INSTALLATION OF AERIAL AND SUBAQUEOUS
UTILITY LINES WITH ATTENDANT STRUCTURES IN COASTAL WETLANDS: ESTUARINE WATERS:
PUBLIC TRUST WATERS AND ESTUARINE SHORELINES
15A NCAC 07H.1601 PURPOSE
A permit under this Section shall allow for the installation of utility lines both aerially and subaqueously in the coastal
wetland, estuarine water, public trust areas and estuarine and public trust shoreline AECs according to the authority provided
in Subchapter 7J .1100 and according rules in this Section. This general permit shall not apply to the ocean hazard AECs.

15A NCAC 07H.1602 APPROVAL PROCEDURES
(a) The applicant must contact the Division of Coastal Management and complete an application form requesting approval for
development. The applicant shall provide information on site location, dimensions of the project area, and his name and
address.
(b) The applicant must provide:
(1) confirmation that a written statement has been obtained signed by the adjacent riparian property owners
indicating that they have no objections to the proposed work; or
(2) confirmation that the adjacent riparian property owners have been notified by certified mail of the proposed
work. Such notice should instruct adjacent property owners to provide any comments on the proposed development
in writing for consideration by permitting officials to the Division of Coastal Management within ten days of receipt
of the notice, and, indicate that no response will be interpreted as no objection. DCM staff will review all comments
and determine, based on their relevance to the potential impacts of the proposed project, if the proposed project can
be approved by a General Permit. If DCM staff finds that the comments are worthy of more in-depth review, the
applicant will be notified that he must submit an application for a major development permit.
(c) No work shall begin until an on-site meeting is held with the applicant and appropriate Division of Coastal Management
representative so that the utility line alignment can be appropriately marked. Written authorization to proceed with the
proposed development will be issued during this visit. Construction on the utility line must begin within twelve months of this
visit or the general authorization expires.

15A NCAC 0711.1603 PERMIT FEE

15A NCAC 0711.1604 GENERAL CONDITIONS
(a) Utility lines for the purpose of this general permit or any pipes or pipelines for the transportation of potable water,
domestic sanitary sewage, natural gas, and any cable, line, or wire for the transmission, for any purpose, of electrical energy,
telephone and telegraph messages, and radio and television communication.
(b) There must be no resultant change in preconstruction bottom contours. Authorized fill includes only that necessary to
backfill or bed the utility line. Any excess material must be removed to an upland disposal area.
(c) The utility line crossing will not adversely affect a public water supply intake.
(d) The utility line route or construction method will not disrupt the movement of those species of aquatic life indigenous to
the waterbody.
(e) Individuals shall allow authorized representatives of the Department of Environment, Health, and Natural Resources to
make periodic inspections at any time necessary to ensure that the activity being performed under authority of this general
permit is in accordance with the terms and conditions prescribed herein.
(f) This general permit will not be applicable to proposed construction where the Department has determined, based on an
initial review of the application, that notice and review pursuant to G.S. 113A-119 is necessary because there are unresolved

questions concerning the proposed activity=s impact on adjoining properties or on water quality; air quality; coastal wetlands;
cultural or historic sites; wildlife; fisheries resources; or public trust rights.
(g) This permit does not eliminate the need to obtain any other required state, local, or federal authorization, nor, to abide by
regulations adopted by any federal or other state agency.
(h) Development carried out under this permit must be consistent with all local requirements, AEC guidelines, and local Land
Use Plans current at the time of authorization.

15A NCAC 07H.1605 SPECIFIC CONDITIONS
Proposed utility line installations must meet each of the following specific conditions to be eligible for authorization by this
general permit:
(1)
All domestic sanitary sewer line requests must be accompanied by a statement of prior approval from the
NC Division Water Quality.
(2)
All spoils which are permanently removed must be placed on a high ground disposal site and stabilized so
as not to return to waters, marsh or other wetlands.
(3)
Any additional backfill material required must be clean sand or rock free of organic matter.
(4)
Cuts through wetlands must be minimized.
(5)
Finished grades or subaqueous or wetland crossing must be returned to preproject contours.
(6)
There can be no work within any productive shellfish beds.
(7)
No excavation or filling activities will be permitted between April 1 and September 30 of any year within
any designated primary nursery area.
(8)
Subaqueous lines must be placed at a depth of six feet below the project depth of federal projects. In other
areas they will be installed at a minimum depth of two feet below the bottom contour.
(9)
The minimum clearance for aerial communication lines or any lines not transmitting electricity will be 10'
above the clearance required for bridges in the vicinity.
(10)
The minimum clearance for aerial electrical transmission lines shall be consistent with those established by
the US Army Corps of Engineers and US Coast Guard.
(11)
The installation of a utility line on pipe bents or otherwise above the elevation of mean high or mean
ordinary water must be of sufficient height to allow for traditional navigation in the water body.
Additionally the utility line must not interfere with the waterflow of normal or flood waters.

RE: US -70 Roadway Improvements at the North River Club
Dear Mr. Connell:
This letter is in response to your concerns regarding the required widening of US -70 at the
North River Club in Beaufort. As you recall, on October 28th we met on the site to review the
improvements that NCDOT had required to US -70. This work was then revised based upon
our discussions and submitted to you on November 5th. Following that submittal, we
received permission from DCM to complete the roadway improvements per the plan, with
the condition that we would address concerns regarding the mitigation area as expressed by
DCM. The revision requested by DCM included "scalloping” the mitigation area at the
existing bend in order to increase the channel area at this point. Upon review of the sketch,
we noted that although mitigation area available is within the project limits and therefore
under ownership of Guide Group, a third party has an access easement within this location
and occasionally directs logging trucks through this location for access to his property to the
west. The mitigation area presented was placed in a manner that would continue to allow
the access, the revisions you requested would prevent the logging trucks to access at this
location due to their required turning radius, thus creating a conflict with the easement.
Although Guide Group has attempted on numerous occasions to "swap" easements with the
third party over the last several years, the easement holder has proved unwilling to do so.
I understand that the nature of your concerns pertains to the potential of "pinching" tidal flow
within the ditch. While the new section does result in a narrower ditch, the available area
within the new ditch section remains far greater than the available opening within the
existing 42" culvert beneath US -70. All tidal flow directed into the roadside ditch must first
pass through this existing culvert. To help quantify the tidal flow within this ditch, I have
utilized the US EPA "Stormwater Management Model" (SWMM). The hydraulic modeling
software will allow for the analysis of culverts and channels and will account for tidal
fluctuations at the outfall. The time -step dynamic model was used to account to the varying
culvert "tidal tailwater" within an assumed event. Tidal elevations over a period of time were
assigned to the outfall of the downstream canal and several links were modeled including
the existing 42" culvert, the US -70 drainage ditch (existing and proposed typical sections)

the mitigation area (existing and proposed typical sections) and the existing ditch section
upstream of the project. Since flow through the system due to tidal elevations is impacted
greatly by the available volume upstream (greater flows result from tidal surges filling
available upstream volumes), a basin was included upstream of the project based upon
existing volume available above the initial hydraulic level.
Other conservative assumptions include a storm driven 4.3 foot tidal surge beginning at low
tide. This low tide elevation of 0 feet above msl was based upon data published by NOAA as
observed at their nearby Cedar Island station. The high tide elevation of 4.3 feet above msl
corresponds to the centerline elevation of the roadway, understanding that tidal surges
greater than that will no longer be contained within the adjacent ditches. This fluctuation in
tidal elevation was assumed to occur over a one-hour period. This period is much faster that
one would expect for these tidal surges and hence will conservatively generate higher flows
in the channels. The model also assumes no flow within the existing ditch, which create
larger available upstream volume, also resulting in higher ditch flows. The ditch sections
within the model were adjusted to evaluate both a "pre -project" and "post project" conditions
within the narrowed US -70 drainage ditch and the widened mitigation area.
I have attached several tables illustrating results from this analysis, including the discharge
summary for each section and corresponding hydraulic grade lines for both pre and post
developed conditions. The model predicts a peak resulting flow within the narrowed
(proposed) US -70 ditch of 26.27 cubic feet per second. The channel cross section is
estimated to be 58.8 sf feet at the hydraulic grade line found, which would result in channel
velocities less than 0.5 feet per second, which is well below the 3.5 feet per second velocity
defined by NCDENR Division of Land Quality as "erosive" for vegetated channels. The
model also illustrates the hydraulic grade line to remain at or below the "pre -project" levels.
The results of this analysis illustrate that the proposed channel work does not pinch the
incoming tidal volumes that are directed through the existing 42 -inch culvert, as adequate
area to convey large tidal flows remains within the channel section. The model also
illustrates that the storage volume is provided in the mitigation area adequately offsets the
storage volume reduction on the US -70 ditch. I have also include a copy of the intersection
of the US -70 and access easement area near the mitigation area with a WB -50 (tractor with
42.5' trailer) design vehicle curve superimposed to illustrate the constraints we have with the
ditch at this location. At this time, I understand that the contractor has completed the work
that was outlined within the drawing previously provided. If you have any further concerns
