This permit shall be effective from the date of issuance until rescinded and shall be subject to the conditions and limitations as specified therein. This cover letter shall be considered a part of this permit and is therefore incorporated therein by reference. Please note the following standard conditions that are contained in this permit. Condition 3: Requires that the wastewater collection facilities be properly operated and maintained in accordance with 15A NCAC 2T.0403 or any individual system -wide collection system permit issued to the Permittee. Condition 6: Requires that the system be properly certified upon completion of construction and prior to being placed into operation. Condition 7: Regarding the installation of gravity sewer at greater than ten percent below the minimum required slope per the Division's Gravity Sewer Minimum Design Criteria shall not be acceptable and shall not be certified until corrected. Condition 12: Regarding Division notification should the system fail to operate including the loss of wastewater from the collection system. The sewage and wastewater collected by this system shall be treated in the Town of Beaufort Wastewater Treatment Facility (Permit No. NC0021831) prior to being discharged into the receiving stream. This permit shall be effective from the date of issuance until rescinded and shall be subject to the following specified conditions and limitations: This permit shall become voidable unless the wastewater collection facilities are constructed in accordance with the conditions of this permit; 15A NCAC 2T; the Division of Water Quality's (Division) Gravity Sewer Minimum Design Criteria adopted February 12, 1996 as applicable; the Division's Minimum Design Criteria for the Fast -Track Permitting of Pump Stations and Force Mains adopted June 1, 2000 as applicable; and other supporting materials unless specifically mentioned herein. 2. This permit shall be effective only with respect to the nature and volume of wastes described in the application and other supporting data. 3. The wastewater collection facilities shall be properly maintained and operated at all times. The Permittee shall maintain compliance with an individual system -wide collection system permit for the operation and maintenance of these facilities as required by 15A NCAC 2T .0403. If an individual permit is not required, the following performance criteria shall be met as provided in 15A NCAC 2T .0403: a. The sewer system shall be effectively maintained and operated at all times to prevent discharge to land or surface waters, and any contravention of the groundwater standards in 15A NCAC 2L.0200 or the surface water standards in 15A NCAC 2B .0200. b. A map of the sewer system shall be developed and shall be actively maintained. c. An operation an, naintenance plan including pum, Cation inspection frequency, preventative maintenance schedule, spare parts inventory, and overflow response shall be developed and implemented. d. Pump stations that are not connected to a telemetry system (i.e. remote alarm system) shall be inspected by the Permittee or its representative every day (i.e. 365 days per year). Pump stations that are connected to a telemetry system shall be inspected at least once per week. e. High-priority sewer lines shall be inspected by the Permittee or its representative at least once per every six-month period of time. A general observation of the entire sewer system shall be conducted by the Permittee or its representative at least once per year. g. Overflows and bypasses. shall be reported to. the appropriate Division regional office in accordance with 15A NCAC 2B .0506(a), and public notice shall be provided as required by North Carolina General Statute § 143-215.1 C. h. A Grease Control Plan shall be implemented as follows: 1. For publicly owned collection systems, the Program shall include at least bi-annual distribution of educational materials for both commercial and residential users and the legal means to require grease interceptors for new construction and retrofit, if necessary, of grease interceptors at existing establishments. The Program shall also include legal means for inspections of the grease interceptors, enforcement for violators, and the legal means to control grease entering the system from other public or private satellite sewer systems. 2. For privately owned collection systems, the Program shall include at least bi-annual distribution of educational materials to all users of the collection system by the Permittee or its representative. 3. Grease education materials shall be distributed more often than required in Parts 1 or 2 of this sub -paragraph if necessary to prevent grease -related sanitary sewer overflows. Right-of-ways and easements shall be maintained in the full easement width for personnel and equipment accessibility. Documentation shall be kept on file for Sections (a.) through (i.) of this rule for a minimum of three (3) years with the exception of the map, which shall be maintained for the life of the system. 4. This permit shall not be transferable. In the event there is a desire for the wastewater collection facilities to change ownership, or there is a name change of the Permittee, a formal permit request shall be submitted to the Division accompanied by documentation from the parties involved, and other supporting materials as may be appropriate. The approval of this request shall be considered on its merits and may or may not be approved. Construction of the gravity sewers, pump stations, and force mains shall be scheduled so as not to interrupt service by the existing utilities nor result in an overflow or bypass discharge of wastewater to the surface waters of the State. 6. Per 15A NCAC 2T .01 16, upon completion of construction and prior to operation of these permitted facilities, the completed Engineering Certification form attached to this permit shall be submitted with the required supporting documents (as -built or recording drawings and pump station designs, if applicable) to the address provided on the form. A complete certification is one where the form is fully executed and the supporting documents are provided as applicable. Any wastewater flow made tributary to the wastewater collection system extension prior to completion of this Engineer's Certification shall be considered a violation of the permit and shall subject the Permittee to appropriate enforcement actions. If the permit is issued to a private entity with an Operational Agreement, then a copy of the Articles of Incorporation, Declarations, and Bylaws that have been appropriately filed with the applicable County's Register of Deeds office shall be submitted with the certification. 2 A complete certificatior ne where the form is fully executed c the supporting documents are provided as applicable. supporting documentation shall include Trie following: a. Record drawings are defined as the design drawings that are marked up or annotated with after construction information and show required buffers, separation distances, material changes, etc. b. One copy of the supporting pump station design calculations (selected pumps, system curve, operating point, buoyancy calculations, available storage if portable generator(s) or storage greater than longest past three year outage reliability option selected) for any pump stations permitted as part of this project. a C. Changes to the project that do not result in non-compliance with this permit, regulations, or the Minimum Design Criteria should be clearly identified on the record drawings, on the certification in the space provided, or in written summary form. .i Prior to Certification (Final or Partial): Permit modifications are required for any changes resulting in non-compliance with this permit (including pipe length increases of 10% or greater, increased flow, pump station design capacity design increases of 5% or greater, and increases in the number/type of connections), regulations, or the Minimum Design Criteria. Requested modifications or variances to the Minimum Design Criteria will be reviewed on a case-by-case basis and each on its own merit. Please note that variances to the Minimum Design Criteria should be requested and approved during the permitting process prior to construction. After -construction requests are discouraged by the Division and may not be approved, thus requiring replacement or repair prior to certification & activation. 7. Gravity sewers installed greater than ten percent below the minimum required slope per the Division's Gravity Sewer Minimum Design Criteria shall not be acceptable and shall not be certified until corrected. If there is an unforeseen obstacle in the field where all viable solutions have been examined, a slope variance can be requested from the Division with firm supporting documentation. This shall be done through a permit modification with fee. Such variance requests will be evaluated on a case-by-case basis. Resolution of such request shall be evident prior to completing and submitting the construction certification. 8. A copy of the construction record drawings and pump station designs, if applicable, shall be maintained on file by the Permittee for the life of the wastewater collection facilities. 9. Failure to abide by the conditions and limitations contained in this permit; 15A NCAC 2T; the Division's Gravity Sewer Design Criteria adopted February 12, 1996 as applicable; the Division's Minimum Design Criteria for the Fast -Track Permitting of Pump Station and Force Mains adopted June 1, 2000 as applicable; and other supporting materials may subject the Permittee to an enforcement action by the Division, in accordance with North Carolina General Statutes §143- 215.6A through § 143-215.6C. 10. In the event that the wastewater collection facilities fail to perform satisfactorily, including the creation of nuisance conditions, the Permittee shall take immediate corrective action, including those as may be required by this Division, such as the construction of additional or replacement facilities. 11. Any and all existing ditches on this project site are assumed to be left undisturbed by the proposed development unless otherwise noted. The removal of vegetation within any existing ditch or channel is prohibited unless the ditch or channel is to be regarded with side slopes of 2 horizontal to 1 vertical or less steep. Bank slopes may be mowed, but stripping of vegetation is considered new earth work and is subject to the same erosion control requirements as new ditches. 4. The developer is responsible for obtaining any and all permits and approvals necessary for the development of this project prior to the commencement of this land disturbing activity. This could include agencies such as the Division of Water Quality's stormwater regulations, their enforcement requirements within Section 401 of the Clean Water Act, the U.S. Army Corps of Engineers' jurisdiction of Section 404 of the Clean Water Act, the Division of Coastal Management's CAMA requirements, the Division of Solid Waste Management's landfill regulations, the Environmental Protection Agency and/or The U.S. Army Corps of Engineers jurisdiction of the Clean Water Act, local County or Municipalities' ordinances, or others that may be required. The Land Quality Section must be notified of a relocation of the measures in question to the transition point between the wetlands and the uplands to assure that the migration of sediment will not occur. If that relocation presents a problem or contradicts any requirements of either DWQ, the Corps, or the EPA, it is the responsibility of the developer to inform the Land Quality Section regional office so that an adequate contingency plan can be made to assure sufficient erosion control remains on site. Failure to do so will be considered a violation of this approval. Any borrow material brought onto this site must be from a legally operated mine or other approved source. Any soil waste that leaves this site can be transported to a permitted mine or separately permitted construction sites without additional permits. Disposal at any other location would have to be included as a permit revision for this approval. 7. Crossline pipe shall be removed to allow for proper installation of utility. If crossline pipe is damaged it shall be replaced with new pipe. The utility shall be encased if the clearance is less than four feet. 10) Minimum of two feet clearance below the stream bed or flowline of crossline is required where the utility is located around the end of the crossline. Proper Traffic Control; Devices, Signs, etc., Shall be Installed to Insure Public Safety. 13) The party of the second part agrees to provide traffic control devices, lane closures, road closures, positive protection and/or any other warning or positive protection devices necessary for the safety of motorists and workers during construction and any subsequent maintenance. That the party of the second part hereby agrees to indemnify and save harmless the party of the first part from all damages and claims for damage that may arise by reason of the installation and maintenance of this encroachment. That the party of the second part agrees to restore all areas disturbed during installation and maintenance to the satisfaction of the Division Engineer of the party of the first part. The party of the second part agrees to exercise every reasonable precaution during construction and maintenance to prevent eroding of soil; silting or pollution of rivers, streams, lakes, reservoirs, other water impoundments, ground surfaces or other property; or pollution of the air. There shall be compliance with applicable rules and regulations of the North Carolina Division of Environmental Management, North Carolina Sedimentation Control Commission, and with ordinances and regulations of various counties, municipalities and other official agencies relating to pollution prevention and control. When any installation or maintenance operation disturbs the ground surface and existing ground cover, the party of the second part agrees to remove and replace the sod or otherwise reestablish the grass cover to meet the satisfaction of the Division Engineer of the party of the first part. That the party of the second part agrees to assume the actual cost of any inspection of the work considered to be necessary by the Division Engineer of the party of the first part. That the party of the second part agrees to have available at the construction site, at all times during construction, a copy of this agreement showing evidence of approval by the party of the first part. The party of the first part reserves the right to stop all work unless evidence of approval can be shown. Provided the work contained in this agreement is being performed on a completed highway open to traffic; the party of the second part agrees to give written notice to the Division Engineer of the party of the first part when all work contained herein has been completed. Unless specifically requested by the party of the first part, written notice of completion of work on highway projects under construction will not be required. That in the case of noncompliance with the terms of this agreement by the party of the second part, the party of the first part reserves the right to stop all work until the facility has been brought into compliance or removed from the right of way at no cost to the party of the first part. That it is agreed by both parties that this agreement shall become void if actual construction of the work contemplated herein is not begun within one (1) year from the date of authorization by the party of the first part unless written waiver is secured by the party of the second part from the party of the first part. During the performance of this contract, the second party, for itself, its assignees and successors in interest (hereinafter referred to as the "contractor"), agrees as follows: a. Compliance with Regulations: The contractor shall comply with the Regulations relative to nondiscrimination in Federally - assisted programs of the U. S. Where any information required of a contractor is in the exclusive possession of another who fails or refuses to furnish this information, the contractor shall so certify to the Department of Transportation, or the Federal Highway Administration as appropriate, and shall set forth what efforts it has made to obtain the information. s e. Sanctions for Noncompliance: In the event of the contractor's noncompliance with the nondiscrimination; provisions of this contract, the Department of Transportation shall impose such contract sanctions as it or the Federal Highway Adriinisttation may determine to be appropriate, including, but not limited to, (1) withholding of payments to the contractor under the contract until the contractor complies, and/or (2) cancellation, termination or suspension of the contract, in whole or in part. Any attachment to a bridge or other drainage structure must be approved by the Head of Structure Design in Raleigh prior to submission of encroachment agreement to the Division Engineer. 2. All crossings should be as near as possible normal to the centerline of the highway. 3. Minimum vertical clearances of overhead wires and cables above all roadways must conform to clearances set out in the National Electric Safety Code. 4. Encasements shall extend from ditch line to ditch line in cut sections and 5' beyond toe of slopes in fill sections. 5. All vents should be extended to the right of way line or as otherwise required by the Department. 6. All pipe encasements as to material and strength shall meet the standards and specifications of the Department. 7. In this meeting it was determined that land disturbance material had entered the adjacent water feature along the northern side. As a result of this meeting the following items must be addressed in a timely manner to avoid CAMA penalties: 1. Remove identified remaining fill material from the western bank of the jurisdictional feature with a hand rake sufficiently to expose the base of existing vegetation. No mechanical machines are to be used. 2. Remove any remaining fill material below the water line from the water feature by means of hand equipment. 3. Reinstall existing riprap to original grade on eastern bank of the feature south of the existing US 70 culvert down to the pink pin flag placed on 9/18/09. This should consist of placing the existing stones to the original grade by hand. The finished grade should be similar to that of the riprap located on the eastern bank of the feature north of the existing US 70 culvert. 4. Install temporary check dam with riprap size stones within the roadside ditch south of the disturbed area and reinstalled riprap as discussed in item 3. 5. Remove previously installed temporary check dam located just south of the US 70 culvert by hand. 6. Install silt fence along the top of slope on the western bank from the utility pole to the end of the existing riprap to prevent any material from entering the water feature. 7. Place matting on the western side of the feature along the bank with matting being two -wide on western side of the silt fence. 8. Seed all disturbed areas. Should you have any questions please call. (e) Individuals shall allow authorized representatives of the Department of Environment, Health, and Natural Resources to make periodic inspections at any time necessary to ensure that the activity being performed under authority of this general permit is in accordance with the terms and conditions prescribed herein. (f) This general permit will not be applicable to proposed construction where the Department has determined, based on an initial review of the application, that notice and review pursuant to G.S. 113A-119 is necessary because there are unresolved 54 questions concerning the proposed activity=s impact on adjoining properties or on water quality; air quality; coastal wetlands; cultural or historic sites; wildlife; fisheries resources; or public trust rights. (g) This permit does not eliminate the need to obtain any other required state, local, or federal authorization, nor, to abide by regulations adopted by any federal or other state agency. (h) Development carried out under this permit must be consistent with all local requirements, AEC guidelines, and local Land Use Plans current at the time of authorization. (2) All spoils which are permanently removed must be placed on a high ground disposal site and stabilized so as not to return to waters, marsh or other wetlands. (3) Any additional backfill material required must be clean sand or rock free of organic matter. (4) Cuts through wetlands must be minimized. (5) Finished grades or subaqueous or wetland crossing must be returned to preproject contours. (6) There can be no work within any productive shellfish beds. (7) No excavation or filling activities will be permitted between April 1 and September 30 of any year within any designated primary nursery area. (8) Subaqueous lines must be placed at a depth of six feet below the project depth of federal projects. In other areas they will be installed at a minimum depth of two feet below the bottom contour. (9) The minimum clearance for aerial communication lines or any lines not transmitting electricity will be 10' above the clearance required for bridges in the vicinity. (10) The minimum clearance for aerial electrical transmission lines shall be consistent with those established by the US Army Corps of Engineers and US Coast Guard. (11) The installation of a utility line on pipe bents or otherwise above the elevation of mean high or mean ordinary water must be of sufficient height to allow for traditional navigation in the water body. December 19, 2008 NCDENR-DCM 400 Commerce Avenue Morehead City, NC 28557 ATTN: Brad Connell RE: US -70 Roadway Improvements at the North River Club Dear Mr. Connell: This letter is in response to your concerns regarding the required widening of US -70 at the North River Club in Beaufort. As you recall, on October 28th we met on the site to review the improvements that NCDOT had required to US -70. This work was then revised based upon our discussions and submitted to you on November 5th. Following that submittal, we received permission from DCM to complete the roadway improvements per the plan, with the condition that we would address concerns regarding the mitigation area as expressed by DCM. The revision requested by DCM included "scalloping” the mitigation area at the existing bend in order to increase the channel area at this point. Upon review of the sketch, we noted that although mitigation area available is within the project limits and therefore under ownership of Guide Group, a third party has an access easement within this location and occasionally directs logging trucks through this location for access to his property to the west. The mitigation area presented was placed in a manner that would continue to allow the access, the revisions you requested would prevent the logging trucks to access at this location due to their required turning radius, thus creating a conflict with the easement. Although Guide Group has attempted on numerous occasions to "swap" easements with the third party over the last several years, the easement holder has proved unwilling to do so. I understand that the nature of your concerns pertains to the potential of "pinching" tidal flow within the ditch. While the new section does result in a narrower ditch, the available area within the new ditch section remains far greater than the available opening within the existing 42" culvert beneath US -70. All tidal flow directed into the roadside ditch must first pass through this existing culvert. To help quantify the tidal flow within this ditch, I have utilized the US EPA "Stormwater Management Model" (SWMM). The hydraulic modeling software will allow for the analysis of culverts and channels and will account for tidal fluctuations at the outfall. The time -step dynamic model was used to account to the varying culvert "tidal tailwater" within an assumed event. Tidal elevations over a period of time were assigned to the outfall of the downstream canal and several links were modeled including the existing 42" culvert, the US -70 drainage ditch (existing and proposed typical sections) Engineering -- Surveying -- Land Planning P.O. Since flow through the system due to tidal elevations is impacted greatly by the available volume upstream (greater flows result from tidal surges filling available upstream volumes), a basin was included upstream of the project based upon existing volume available above the initial hydraulic level. Other conservative assumptions include a storm driven 4.3 foot tidal surge beginning at low tide. This low tide elevation of 0 feet above msl was based upon data published by NOAA as observed at their nearby Cedar Island station. The high tide elevation of 4.3 feet above msl corresponds to the centerline elevation of the roadway, understanding that tidal surges greater than that will no longer be contained within the adjacent ditches. This fluctuation in tidal elevation was assumed to occur over a one-hour period. This period is much faster that one would expect for these tidal surges and hence will conservatively generate higher flows in the channels. The model also assumes no flow within the existing ditch, which create larger available upstream volume, also resulting in higher ditch flows. The ditch sections within the model were adjusted to evaluate both a "pre -project" and "post project" conditions within the narrowed US -70 drainage ditch and the widened mitigation area. I have attached several tables illustrating results from this analysis, including the discharge summary for each section and corresponding hydraulic grade lines for both pre and post developed conditions. The model predicts a peak resulting flow within the narrowed (proposed) US -70 ditch of 26.27 cubic feet per second. The channel cross section is estimated to be 58.8 sf feet at the hydraulic grade line found, which would result in channel velocities less than 0.5 feet per second, which is well below the 3.5 feet per second velocity defined by NCDENR Division of Land Quality as "erosive" for vegetated channels. The model also illustrates the hydraulic grade line to remain at or below the "pre -project" levels. The results of this analysis illustrate that the proposed channel work does not pinch the incoming tidal volumes that are directed through the existing 42 -inch culvert, as adequate area to convey large tidal flows remains within the channel section. The model also illustrates that the storage volume is provided in the mitigation area adequately offsets the storage volume reduction on the US -70 ditch. I have also include a copy of the intersection of the US -70 and access easement area near the mitigation area with a WB -50 (tractor with 42.5' trailer) design vehicle curve superimposed to illustrate the constraints we have with the ditch at this location.
