This is with reference to your request to modify State Permit #136-08, which was issued on 12/31/08, and
expires on 12/31/2011. The actions proposed in your submittal include relocating the spoil material from one
deposition site to another.
Accordingly, the Town of Atlantic Beach is requesting, through this refinement, to change the location of the
spoil deposition site from the property owned by the Town of Atlantic Beach, and located off Highway 58 (W.
Fort Macon Blvd.), to the property owned by Joseph Eudy. The new deposition site would be located off
Morgan Street, on Radio Island, in Morehead City, NC.
Upon review of the proposed documentation, I have determined that the proposed action is consistent with
existing State rules and regulations and is in keeping with the original purpose and intent of the permit. I
hereby submit this Letter of Refinement authorizing the modification of State Permit #136-08, as described in
your request dated 2/17/09. By copy of this letter we are also notifying the U. S. Army Corps of Engineers of
our action. If you have any questions concerning the above information, or if I can be of any other assistance,
please do not hesitate to call me at [phone].
Please make note that Conditions #10 and #11 of CAMA permit #136-08 have been eliminated from the permit
requirements. However, if at any time you choose to modify CAMA Major Permit #136-08, including
relocating the spoil deposition to another area, you shall contact a representative with the Division of Coastal
Management at [phone] and inform DCM staff of your requests.
