Re: Notice of Intent to Revoke Coastal Area Management Act (CAMA)
General Permit No. 34665-B
Dear Mr. Taylor:
This letter is in reference to CAMA General Permit No. 34665-B issued to you on October 7, 2003, for the
construction of a 6' x 48' pier with a 16' x 16' T-head platform to serve your property located off SR 1712, Debbie
Lynn Lane, on the Pungo River near Belhaven in Beaufort County, North Carolina. This letter confirms the various
telephone conversions and the October 20, 2003, meeting with Division of Coastal Management (DCM) Field
Representative Steve Trowell concerning the aforementioned General Permit. This letter also confirms the October
9, 2003, Stop Work Order issued to cease pier construction authorized under the aforementioned permit.
Based upon information brought to the attention of this Division by your adjacent riparian property owners,
CAMA General Permit No. 34665-B was obtained by falsifying prerequisite information. You failed to comply
with North Carolina Administrative Code 15A 07H.1202(b)(1) and/or (2), Approval Procedures, because you
provided erroneous written statements from the adjacent riparian property owners. Therefore, DCM intends to
revoke CAMA General Permit No. 34665-B. You may appeal this permit decision by requesting an administrative
hearing within 20 days of receipt of this Notice of Intent to Revoke (G.S. Chapter 150B). You may obtain the
proper appeal form by calling (919) 733-2698.
I request that you contact Mr. Terry Moore, DCM District Manager in the Washington Regional Office
(WARD), at (252) 946-6481 ext. 293 within 10 days of receipt of this Notice of Intent to Revoke. At that time you
will need to agree to a time schedule to comply with the necessary prerequisite information for permit application or
a time frame for removal of the unalthorized pilings and other construction.
sin ly,
Donna D. Moffitt
