Any violation of these terms may subject the permittee to a fine or criminal or civil action; and may cause the permit to become null and void. This permit must be on the project site and accessible to the permit officer when the project is inspected for compliance. The applicant certifies by signing this permit that 1) prior to undertaking any activities authorized by this permit, the applicant will confer with appropriate local authorities to confirm that this project is consistent with the local land use plan and all local ordinances, and 2) a written statement or certified mail return receipt has been obtained from the adjacent riparian landowner(s) . The State of North Carolina and the Division of Coastal Management, in issuing this permit under the best available information and belief, certify that this project is consistent with the North Carolina Coastal Management Program. Ross Jr., Secretary October 31, 2003 CERTIFIED MAIL RETURN RECIEPT REQUESTED Mr. Edward Taylor 208 Beverly Place Greensboro, North Carolina 27403 Re: Notice of Intent to Revoke Coastal Area Management Act (CAMA) General Permit No. 34665-B Dear Mr. Taylor: This letter is in reference to CAMA General Permit No. 34665-B issued to you on October 7, 2003, for the construction of a 6' x 48' pier with a 16' x 16' T-head platform to serve your property located off SR 1712, Debbie Lynn Lane, on the Pungo River near Belhaven in Beaufort County, North Carolina. This letter confirms the various telephone conversions and the October 20, 2003, meeting with Division of Coastal Management (DCM) Field Representative Steve Trowell concerning the aforementioned General Permit. This letter also confirms the October 9, 2003, Stop Work Order issued to cease pier construction authorized under the aforementioned permit. Based upon information brought to the attention of this Division by your adjacent riparian property owners, CAMA General Permit No. 34665-B was obtained by falsifying prerequisite information. You failed to comply with North Carolina Administrative Code 15A 07H.1202(b)(1) and/or (2), Approval Procedures, because you provided erroneous written statements from the adjacent riparian property owners. Therefore, DCM intends to revoke CAMA General Permit No. 34665-B. You may appeal this permit decision by requesting an administrative hearing within 20 days of receipt of this Notice of Intent to Revoke (G.S. Chapter 150B). You may obtain the proper appeal form by calling (919) 733-2698. I request that you contact Mr. Terry Moore, DCM District Manager in the Washington Regional Office (WARD), at (252) 946-6481 ext. 293 within 10 days of receipt of this Notice of Intent to Revoke. At that time you will need to agree to a time schedule to comply with the necessary prerequisite information for permit application or a time frame for removal of the unalthorized pilings and other construction. sin ly, Donna D.
