SEP 2 0 2004 Morehead City C)C;M 10/08/2004 Ref: General CAMA permit C-40006 OCTPRE", r s noon Wrehead Cit Dear Mr. Glancey and Mrs. Tarr, (riparian land owners): ,y UUM I previously notified you of my intention to clean out erosion from the bottom of Cowpen Creek adjacent to my lot, and place rip rap on the bank where my lot borders Cowpen Creek. Subsequently, Mr. Hardeman of the regional CAMA office provided CAMA general permit C- 40006 for that work, attachment # 1, hereto. Mr. Hardeman limited the excavation of the creek bottom in the "basin, channel" section, to an area 6' x 100' x 2' for a total of 44 cu yds. The limitation of the excavation to 6' from the existing bank would provide no improvement to navigation at the end of the channel, and leave significant erosion in the creek. I requested permission from Mr. Hardeman to increase excavation area to include up to the center of the creek. Mr. Hardeman stated that prior to performing any excavation of the creek bottom in addition to the 6' from the bank; I must provide a bottom profile of the creek, from the mouth of the creek to my property line every 100', and a more detailed bottom profile of the area to be excavated. In accordance with his direction I performed a survey of the creek bottom. Attachment 42 hereto is a map of the portion of Shell Landing subdivision where our lots are located, the creek location to its intersection with the North river, and the points where I performed depth measurements. Attachment #3 hereto documents the depth measurements at the points identified on the map at attachment #2. Depth measurements were taken in the center of the channel which is identified as "CC". I also recorded depth measurement 10' on either side of the center channel (CC). The column marked "+ 10" is the measurement of the depth 10' north or west of center channel, and the column "-10" is a measurement of the depth south or east of the center channel. Attachment #4 is a graph showing the contour of the bottom from the North River to the end of our branch of Cowpen Creek. After completing the survey I went to the CAMA office with the information Mr. Hardeman had requested. During my discussion of the information with Mr. Hardeman, Ms. Barrett of the CAMA office interjected a requirement that I provide a grid of the area to be excavated, with computations of the cu. Yds. of soil to be excavated, Ms. Barrett also stated I had to have written permission or proof of notification of my riparian property owners prior to a modification of the existing permit. It was Tuesday afternoon when Ms. Barrett communicated these requirements. My contractor was to do the work Wednesday or Thursday on low tide. CAMAs notification of these requirements did not provide time to get written permission from both of you riparian property owners before the work was to begin on the low tide. Therefore I am following the standard notification process. I have created the documents specified by Mrs. Barret as follows. Attachment #5 shows a grid of the creek adjacent to my property with the depths measured at grid intersections. The grid area adjacent to my property is the area I plan to excavate. Attachment #6 sheets 1 and 2, illustrate the cross sections of the planned excavation with the included computations of soil to be excavated, approximately 70.11 cu yds total. The modification I plan from the existing CAMA permit at attachment # 1 hereto is a slightly deeper excavation at the south end of the creek, and a slightly shallower excavation at the north end next to Mrs. Tarr's property line. Also the excavation extends to the center of the creek rather than 6' from my bank.
