Statement of Compliance and Consistency
This permit is subject to compliance with this application, site drawing and attached general and specific conditions. Any
violation of these terms may subject the permittee to a fine or criminal or civil action; and may cause the permit to become
null and void.
This permit must be on the project site and accessible to the permit officer when the project is inspected for compliance. The
applicant certifies by signing this permit that 1) prior to undertaking any activities authorized by this permit, the applicant will
confer with appropriate local authorities to confirm that this project is consistent with the local land use plan and all local
ordinances, and 2) a written statement or certified mail return receipt has been obtained from the adjacent riparian
landowner(s) .
The State of North Carolina and the Division of Coastal Management, in issuing this permit under the best available
information and belief, certifythat this project is consistent with the North Carolina Coastal Management Program.

Issued to William Kincheloe, PO Box 672, Rocky Mount, NC 27802 -
Authorizing development in Carteret County at adj. Bogue Sound, at 1205 Shackleford St.,
Morehead City as requested in the permittee's application dated 7/26/00, including
attached workplan drawing (1), dated 7/26/00.
This permit, issued on October 4, 2000 , is subject to compliance with the application (where consistent
with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may
be subject to fines, imprisonment or civil action; or may cause the permit to be null and void.

1) The height of the permitted groin shall not exceed one (1) foot above the normal high water level
(NHW).
2) The authorized rock groin shall not extend waterward more than 35 feet from the NHW.
3) The riprap material used for construction of the groin must be free from loose dirt or any pollutant. It
must be of a size sufficient to prevent its movement from the site by wave or current action.
4) The riprap material used for construction of the groin must consist of clean rock or masonry materials
such as but not limited to granite or broken concrete.
(See attached sheet for Additional Conditions)
finis permit action may be appealed by the perrmttee or
other qualified persons within twenty (20) days of the issuing
date. An appeal requires resolution prior to work initiation or
continuance as the case may be.
This pertnit must be accessible on -site to Department
personnel when the project is inspected for compliance.
.Any maintenance work or project modification not covered
hereunder requires further Division approval.
.All work must cease when the permit expires on
December 31, 2003
In issuing this permit, the State of North Carolina acrees
that your project is consistent with the North Carolina Coastal
Management Program.

Chairman of the Coastal Resources Commission.

5) The temporary placement or double handling of excavated or fill materials within waters or vegetated
wetlands is not authorized.
6) No excavated or fill material will be placed at any time in any vegetated wetlands or surrounding waters
outside of the alignment of the fill area indicated on the workplan drawing.
7) This permit authorizes no excavation of any shallow water bottom, wetlands or high ground.
General
NOTE: This permit does not eliminate the need to obtain any additional permits, approvals or
authorizations that may be required.
NOTE: Future development of the permittee's property may require a modification of this permit.
Contact a representative of the Division at (252) 808-2808 prior to the commencement of any
such activity for this determination.
NOTE: Should the property to the east be sold prior to the initiation of construction, the permittee shall
be required to obtain a signed riparian corridor waiver from the new property owner prior to the
placement of any structures within the 15 foot riparian corridor.
NOTE: The permittee and/or his contractor is urged to meet with a representative of the Division prior to
project initiation.
NOTE: The N.C. Division of Water Quality has authorized the proposed project under General Water
Qualm Certification No. 3274 (DVdQ Project No. 001124), which was issued on 9/6/00.
NOTE: The U.S. Army Corps of Engineers authorized the proposed project under Nationwide Permit
No. 18 (COE Action Id. No. 200001707) which was issued on 10/4/00.
