The high -resolution aerial photo was taken in February 2004, according to Barry Blackburn (Tel: 252/728-8490) who works at the county office in Beaufort. This is after Isabel but before the current pier construction began. It is obvious that the photo does not indicate any ruins of the four piers they claim existed in front of the clam house before the storm. Unless the piers were totally vanished by the storm, I would have guessed that their remnants should be visible. Mr. Blackburn also said that the County maintains old black & white air photos taken in 1986-88 that have high enough resolutions to notice household piers. They make copies of the air photo available to the public and others. I thought your staff may be able to 1check it out, if you think worthwhile. Thank you again for your help in this matter. Ross Jr., Secretary December 17, 2004 Mr. Sonny Johnson 341 Sonny Road Clayton, NC 27520 Dear Mr. Johnson, I am writing to you with regard to General Permit #37598-C, issued to you on 3/22/04, expired 9/22/04. This permit was written for the reconstruction of structures damaged or destroyed in Hurricane Isabel, which hit the North Carolina coast in September of 2003. Specifically, this permit was issued for the reconstruction and/or repair of 4 piers and a boardwalk. The permit was written based on the plat submitted on 3/15/04, which was supposed to depict pre -hurricane conditions. I visited this site on 9/23/03, immediately following the hurricane. I visited the site again with you at least one more time in the following months before permit issuance on 3/22/04. I can vouch for the presence of the pilings sufficient to have led me to believe that these pier structures had existed previously, and existed during my site visit sufficient for me to ascertain the lengths. In fact, one was sufficiently stable that I indicated on the permit that it simply needed re jetting. You indicated to me at that time that your wish was to reconstruct the piers that were historically used by the community, in order to allow for this continued use. In conjunction with the General Permit for storm repair, you received CAMA Minor Permit #17- 04 to remove a large portion of the existing fish house and renovate the remainder for residential use, to replace a high ground storage building and construct a boardwalk. A problem has arisen since you have installed the pilings and stringers for the new piers. A large number of people living in the community and surrounding area have contended to the Director of DCM, Mr. Charles Jones, that these piers were not in place and functional prior to Hurricane Isabel. Aerial photography indicates that very little of the docking system was in place in the year 2000. There are allegations that perhaps the fish house and piers are being renovated for commercial use. Please explain to the best of your ability what information you had that the piers were in place and functional immediately prior to Hurricane Isabel, and provide any supporting evidence you may have. Also, please describe the intended use of this property. Additionally, I would request that you cease work on this property until these issues are addressed. I came to the same conclusion from all aerial photos dated back to 1980, some of which I emailed to Mr. Jones in the past. All I'm looking for is the evidence, graphic or photographic, that the clam house had had four piers, as well as now an extensive seawall, before Isabel struck. I know I can press on this type of request thru FOIA, but presently I am simply a concerned local citizen looking for firsthand information from your staff. From what I read from Ms. Barrett's email to you, it seemed like she had a plenty of evidence, strong enough to issue the permit. All I'm asking is to share it with the public like me. If you could send me anything, by mail or email, I'd be very appreciative. I'll gladly pay any reproduction cost involved in this. If that is the case, I understand that Mr. Johnson had the right to rebuild them. As you recall, however, we have looked into several air photos (available on websites: Carteret County GIS, NOAA, USGS, and most recently maps.google.com) spanning over a period of more than two decades prior to Isabel. These photos do not show any discernible pier 1 of 3 7/7/2005 2:14 PM [Fwd: FW: Williston clam house] structures in front of the clam house, where the four piers have been built under the GP Ms. Berrett issued after Isabel. There have been and still are three old piers to the west of the clam house on a strip of land owned by Mr. Don Fulcher who lives across the street. The three old piers are clearly seen in all air photos and apparently survived Isabel largely intact - go figure!! The nearest old pier is about 80 feet west of the clam house. The three piers have been "community piers" until recently, under Fulcher's consent, according to Ken Harris. The main issue here is whether the claim that there had been four piers before Isabel destroyed them is factual. If the claim can be proved as a fact, the GP is obviously valid. Otherwise, the GP may have been obtained under an incorrect claim. Ms. Berrett says in her email to you that she "made a site visit, and measured the docks [herself], determining which were beyond 50% damage." If I may, I would love to see any photos of "the damage" she "measured" during her visit. She further says that Mr. Johnson "reconstructed to the dimensions that we measured and were shown on the plats he had when he purchased the property." Is it possible to see his "plats" so that we may be able to compare the pier locations with old air photos? If the air photos agree with the plats, the case can be closed, pronto. Based on what we have seen in the old air photos, however, I believe this matter calls for and merits further scrutiny by the permitting authority to clear the uneasy air that lingers in our beloved town of Williston. At the time, I made a site visit, and measured the docks myself, determining which were beyond 50°% damage. As the applicant (Mr. Sonny Johnson) proposed to reconstruct completely, that became a mute point, and we went the General Permit route instead. He has reconstructed to the dimensions that we measured and were shown on the plats he had when he purchased the property. Most was able to be confirmed on aerials. When he rebuilt, he constructed the lengths we authorized, (with the exception of one) but guessed at where they would connect to the bulkhead. Mark has now flagged the bulkhead, and it is approx 5' landward of where he expected. Thus, when he connects to the 2 of 3 7/7/2005 2:14 PM [Fwd: FW: Williston clam house] bulkhead that he is planning to begin soon, he will cut off that same amount from the end of the docks. The westernmost dock was constructed 16' longer than proposed, and Mr. Johnson will be removing the last 2 sections when he begins construction. The GP has until June 23 before expiration. The high ground work to convert the fish house to a residence was handled under a Minor Permit. Mr. Johnson delcares his intentions as private use. If his intentions are otherwise, I am not privy. This permit was written for the reconstruction of structures damaged or destroyed in Hurricane Isabel, which hit the North Carolina coast in September of 2003. Specifically, this permit was issued for the reconstruction and/or repair of.4 piers and a boardwalk. The permit was written based on the plat submitted on 3/15/04, which was supposed to depict pre -hurricane conditions. I visited this site on 9/23/03, immediately following the hurricane. I visited the site again with you at least one more time in the following months before permit issuance on 3/22/04. I can vouch for the presence of the pilings sufficient to have led me to believe that these pier structures had existed previously, and existed during my site visit sufficient for me to ascertain the lengths. In fact, one was sufficiently stable that I indicated on the permit that it simply needed re -jetting. You indicated to me at that time that your wish was to reconstruct the piers that were historically used by the community, in order to allow for this continued use. In conjunction with the General Permit for storm repair, you received CAMA Minor Permit #17- 04 to remove a large portion of the existing fish house and renovate the remainder for residential use, to replace a high ground storage building and construct a boardwalk. A problem has arisen since you have installed the pilings and stringers for the new piers. A large number of people living in the community and surrounding area have contended to the Director of DCM, Mr. Charles Jones, that these piers were not in place and functional prior to Hurricane Isabel. Aerial photography indicates that very little of the docking system was in place in the year 2000. There are allegations that perhaps the fish house and piers are being renovated for commercial use. Please explain to the best of your ability what information you had that the piers were in place and functional immediately prior to Hurricane Isabel, and provide any supporting evidence you may have. Also, please describe the intended use of this property. Additionally, I would request that you cease work on this property until these issues are addressed.
