Any violation of these terms may subject the permittee to a fine or criminal or civil action; and may cause the permit to become null and void. This permit must be on the project site and accessible to the permit officer when the project is inspected for compliance. The applicant certifies by signing this permit that 1) prior to undertaking any activities authorized by this permit, the applicant will confer with appropriate local authorities to confirm that this project is consistent with the local land use plan and all local ordinances, and 2) a written statement or certified mail return receipt has been obtained from the adjacent riparian landowner(s) . The State of North Carolina and the Division of Coastal Management, in issuing this permit under the best available information and belief, certify that this project is consistent with the North Carolina Coastal Management Program. As you know from your own experience with your property, erosion is a problem along Bogue Sound. We have noticed fairly significant erosion to our lot, and are concerned that the problem will get worse if not checked. After considering many options and talking with several people much more knowledgeable than ourselves, we have determined that a seawall is the best solution for us. Like you, we have a healthy desire to preserve the environment and, in fact, the highlight of our new life here has been the many birds that feed along the shoreline and nest in the vicinity. We have absolutely no desire to disturb any marsh out in the water and simply wish to reclaim the yard that has been lost and preserve what we have from further erosion. As you know, a permit is required for a seawall to be constructed. Enclosed is a form we received from the Division of Coastal Management that provides a brief overview of our proposal. We are forwarding this form as part of the permitting process, and ask that you review it and, if possible, consent to our proposal. An identical form has been submitted to our neighbors on the west, Bob and Sue Grote, and they already have consented to the proposal. Also enclosed is a form that deals with our desire to build a pier. The form specifies a pier not to exceed 200 feet with a platform of not more than 400 square feet. As you are aware, these merely are the limits for a general permit. For a variety of reasons, we actually intend to build a much shorter pier, with a much smaller platform, if any, at the end. Attached to the form is a drawing that more fully captures what we desire to build. As the drawing captures to some extent, we intend to build the pier in the center of our lot. This will be approximately fifty feet from the lot line that we share with you. We are submitting this pier -related form pursuant to the state permitting process and through this form we are asking for your consent to our proposal. As with the proposed seawall, the Grotes already have consented.
