I am writing this letter to clarify the fine points of the permit some of which we have discussed over the past several weeks. The Association decided to start the pier just on the waterward side of the live oak tree overhanging into your yard. They have committed to starting the access ten feet south of the property line. The pier will then run at a slight angle until it intersects the water just on the south side of a small dead oak along the shoreline. The pier will then run at an angle similar to the Vick pier to its "L" platform on the end. These changes from the submitted plat originally sent to you were an attempt to find some common ground between both parties. I am also forwarding you the appeal forms unless you change your mind about the issued permit or believe it was issued incorrectly. You have 20 days to file any type of appeal from the date the permit was issued. I am also forwarding you the unsigned permit, the POA will be picking it up within the next couple of days. This plan is, by and large, a far better solution than that which has been attempted before by some members of the HOA board. Our main concern is that the drawing shows a dogleg at the beginning of the pier (under a live oak tree) that is on or against our property. This bend in the pier's construction is unnecessary since a slightly longer extension past the tree would start the walkway on solid ground belonging to HOA and marked as recreation area. Enclosed also is a proposal sent to the HOA from us to make access to the pier less of a contentious issue by proposing a transfer of property in exchange for surrendering the excess right-of-way. This proposal and the drawing with it were sent earlier and probably crossed in the mail. You will note on the drawing that the pier access does not have to come to the edge of our property; it can connect directly with the land marked in red. (This is true even if our proposed transfer of property is not accepted; a portion of the public access easement would still be used.) I have been on the phone with Randall Harrell, a member of the HOA board, and he assured me that the full length of the pier and access would remain 15 feet from our property outside the 20-foot easement. He stated that the drawing was incorrect in showing the bend near the live oak tree. We would like to be assured that all portions of the pier or any constructed access to the pier remain 15 feet from the property line of Lot 46. Moreover, this should be reflected in a revised plan for the location of the pier and access. Clearly, despite the abuse of our property in the past, we do not plan to protest or resist a reasonable solution to the Association's legitimate desire for a community day pier. If this one matter is resolved, perhaps the community can begin to realize its long desired pier construction project. Sincerely, °n Millie Green and Fess Green (540) 731-1502 , -' TRANSFER OF PROPERTY AUK 04 2004 A PROPOSAL Morehead City D Now that issues regarding the location of a community pier have been partly resolved, a transfer and exchange of property is hereby proposed to facilitate access. The owners of Lot 46 are prepared to offer a wedge of property in a strategic location to the Hickory Shores Subdivision Owners Association (HSSOA). The attached drawing shows the current solid ground near Lot 46 that is owned by the HSSOA (red). It also shows the 20 foot easement starting at the tip of Hickory Nut Court, where the land drops quickly due to drainage into the pond. Here, there is no convenient access to HSSOA property without running the risk of trespass. Note also that further along the 20 foot easement, the marsh has encroached to the extent that there is no solid ground for a stretch before the end of the lot at Goose Creek. This also renders the easement less useful than it might have been in prior years. A solution is suggested in the drawing showing where a path and walkway could be built to make use of solid ground and provide access to a pier. The wedge of property (noted in yellow) would resolve the access problem. It is proposed that the HSSOA consider accepting full ownership, by deed, of this access area in exchange for surrendering, by deed, the rest of the 20 foot easement on Lot 46. The specific dimensions of this wedge of land being offered have not been decided since it would be a matter of negotiation and survey. Moreover, such access is offered to facilitate a walkway or footpath, not for the purpose of vehicular use. Consideration must also be given to the protection of the large trees on this land. This proposal is presented in good faith as perhaps a way to eliminate any future confusion or problems with the establishment of uncontested access to HSSOA property and a possible future pier. Along with requiring special care by those who build and develop, the General Assembly directed the Coastal Resources Commission (CRC) to implement clear regula- tions which minimize the burden on the applicant. This application for a minor development permit under CAMA is part of the Commission's effort to meet the spirit and intent of the General Assembly. It has been designed to be straightforward and require no more time or effort necessary from the applicant. Please go over this folder with the Local Permit Officer (LPO) for the locality in which you plan to build to be certain that you understand what information he or she needs. Under CAMA regulations, the minor permit is to be issued within 25 days once a complete application is in hand. Often less time is needed if the project is simple. The process generally takes about 18 days. You can speed the approval process by making certain that your application is complete and signed, that your drawing meets the specifications given inside and that your application fee is attached. Other permits are sometimes required for development in the coastal area. While these are not CAMA-related, we urge you to check with the Local Permit Officer to determine which of these you may need. A listing is included on page 2 of this folder.
